MINUTES OF THE DECEMBER 3, 2001

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

The meeting was called to order by President Benincasa at 7:00PM. Ogline gave the invocation and led the meeting in the Pledge of Allegiance

ROLL CALL: Dean Ashbrook, Brant Luther, Mike Ogline, Phyllis Phillips, Jim Puckett, Mark Roller and Alex Zumbar present.

MINUTES: Motion by Ashbrook: second by Zumbar to receive and file minutes of the regular meeting of the Alliance City Council of November 19, 2001; MOTION PASSED BY ACCLAMATION OF ALL MEMBERS

  • Letter from State Senator Robert Hagan to R. Mark Locke, Clerk Alliance City Council dated November 14, 2001. Re: offered his support of Resolution 102-01 requesting the Ohio Department of Transportation to undertake the prompt extension and construction of SR 62.
  • Ohio Municipal League Legislative Bulletin # 25.
  • Minutes from the November 20, 2001 Planning Commission Meeting.
  • Memo from Auditor Andrei Dordea to all department heads. Re: 2001-year end closing.
  • Examination Announcement from the Department of Administrative Services, Human Resources Division.
    1. Donna Batton regarding placing a sign on the N. Union train overpass. Motion by Luther, 2nd by Zumbar to send a copy to our consultants studying the bridge issue.
    2. Letter from Time Warner regarding notification of new channels and rates.
    3. News release from Mayor Middleton regarding tree lighting ceremony on Thursday, December 06, 2001 at 7:00 P.M.

    9) Letter from Mayor Middleton regarding the receipts collected through the Mayor’s Office during the month of November 2001 totaling $545,021.33.

    Motion by Zumbar to receive and file all communications tendered to Clerk Locke: Second by Luther: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

    ADMINISTRATIVE REPORTS:

    Mayor Middleton: Asked for support and action on Ordinance 130 & 131-01.

    MLM properties are in discussions with Washington Township regarding creating a CEDA. Maybe back to Council in the future regarding CEDA.

    Discussed the Time Warner letter regarding channels and rates.

    Discussed that Congressman Regula was successful in providing funding for the proposed Alliance Railroad Station ($3,000,000). He will keep council up to date. He will be working with the City of Sebring on the 62 project.

    Several committee openings next year. He would appreciate Council submitting names of possible candidates.

    Offered thanks to those involved with the City Christmas tree.

    Safety Service Director Blaser: He met with ODOT to discuss the signing off on the W. State St. project. He told ODOT of his concerns which include pavement quality, buried water service curb boxes, weak road sub-base, a number of street lights still do not work, sidewalk cracks, and the traffic light at Tanglewood and W. State St. does not function properly. He will eventually accept the project, but wanted the City’s concerns on record.

    ODOT plans on paving Union Ave. next year from between City limits, and also part of West State St. – West of the new improvements. ODOT will pay 80% of the cost – the City is required to pay the remaining 20%. ODOT needs our decision by 12/10/2001, however, they my grant the City addition time.

    He discussed Ordinance No. 135-01 – a transfer to purchase a dump truck.

    Alex Zumbar asked about the W. State Street project.

    Dean Ashbrook asked about the W. Main Street and Freshley Project.

    Law Director Zumbar: Andrew Zumbar discussed Ordinance No’s 130 & 131-01. Asked that both be acted upon. He indicated that the Judge was in favor of Ordinance 132-01 – contract with Public Defender’s Office. Contract includes a $10 increase per case. This is the first increase since 1996.

    Auditor Dordea: Andrei Dordea handed out exhibit "A" of Ordinance No. 125-01 – Temporary Appropriations Budget for 2002. Discussed Resolution No. 134-01 – authorizing Auditor and Treasurer to enter into five-year agreement with banks for depository contacts.

    Streets & Alleys: Luther: Asked for action on Ordinance No.’s 133 & 135-01 with rules suspension.

    Community Development: Ogline: No report

    Property & Lands: Phillips: No report

    Planning, Zoning, & Housing: Puckett: Asked for action on Ordinance No.’s 130 & 131-01 with rules suspension.

    Safety and Judiciary: Roller: Announced a committee meeting on the Senior Captains Position to be held on Thursday, December 06, 2001 at 5:00 P.M. in the conference room of the City Administration Building.

    Finance: Zumbar: Asked for action on Ordinance No.’s 130, 131, 132, 133, & 135-01 & Resolution No. 134-01.

    PUBLIC SPEAKS: Mr. Harold E. Davis of 1109 S. Liberty Ave., spoke of his concerns regarding work done by an adjacent property owner that has caused damage to his property and caused a possible dangerous situation.

    THIRD READINGS

    Ordinance 122-01: introduced by Ashbrook: an Ordinance accepting and approving the replat of part of lots 1160 through 1162 located at the intersection of High Street and Webb Avenue in the City of Alliance, County of Stark and State of Ohio; and declaring an emergency. . Motion to adopt: Ogline: second: Zumbar: Roll Call: unanimous: ADOPTED

    Ordinance 125-01: introduced by Zumbar: an Ordinance making temporary appropriations for 2002 for the General Fund, Water Fund, Sewer Fund and other City funds, and authorizing the Auditor to draw payments from those appropriations upon receiving proper certifications and vouchers; and declaring an emergency.

    Ordinance 130-01: introduced by Puckett: an Ordinance indicating what services the City of Alliance, Ohio, will provide to the MLM Property Area upon annexation to the City of Alliance and declaring an emergency.     Ordinance 132-01: introduced by Roller/ Zumbar: an Ordinance authorizing the Safety Service Director to enter into a contract to provide legal counsel to indigent persons charged with loss of liberty offenses in the City of Alliance Municipal Court; and declaring an emergency.
