MINUTES OF SEPTEMBER 6, 2011

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

The meeting was called to order by President Benincasa at 7:00 P.M. Councilman Andreani gave the Invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Larry Dordea, Steve Okey, Phyllis Phillips, Roger Rhome, and Larry Thompson.

 

Motion and Second to excuse councilman Clunk that is out of state on family matters. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

Motion and second to approve the minutes of August 15, 2011, Regular Council Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

COMMUNICATIONS: The Clerk noted the following communications tendered to the clerk for Council:

 

1.  Memorandum from Auditor Knowles  RE: Municipal Income Tax Recapitulation.

2.  Memorandum from Director Mayor Middleton RE: Receipts collected in August 2011.

Motion and second to receive and file all communications tendered to the Clerk.  MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

ADMINISTRATIVE REPORTS:

 

Mayor Middleton: Absent on City business. No Formal Report.

 

Safety Service Director Blaser:  Noted the new Exhibit “A” to be included in Ordinance 65-11 regarding the City Auction.

 

Announced paving bids have been opened and awarded.  Bid was under estimates and additional paving will be added

 

Announced the establishment of Trick or Treat for this year.

 

Mayor and John Gross are in New York picking up the artifacts of the World Trade Center for the City Memorial and announced the ceremonies for the Remember 9-11 that starts at 8:15 AM.

 

Reviewed Ordinances 73-11; 74-11; and 75-11

 

Addressed concerns over Resolution 76-11

 

Law Director Andrew Zumbar:  Announced Concerns regarding Resolution 76-11 and will reserve discussion to the appropriate time regarding role of Council, Police Chief and Safety Service Director.

 

Auditor Knowles: Reviewed the Municipal Income Tax Recapitulation.

 

STANDING COMMITTEE REPORTS:

 

Safety & Judiciary: Andreani:  Reported on the committee meeting of September 1, 2011 to discuss police policies regarding towing vehicles and the poverty summit. 

 

Streets & Alley: Clunk:  Absent, no formal report.

 

 

 

 

 

 

 

 

 

 

 

Properties and Lands: Dordea: No formal report.  Asking for support on passage of Ordinance 74-11

 

Finance: Okey:  Discussed the Technology Alliance Board Meeting (Business Incubator) they are working on a job description for the director and a search committee has been formed.

 

Will hold a committee meeting to address Ordinance  85-10 and Fire Apparatus funding

 

Community Development: Phillips:  Reported on the committee meeting of August 25, 2011 to discuss Ordinance 64-11.  Addressed that that led to a Council Workshop tonight and more work needs done.

 

Announced Never forget Stark County taking place at McKinley Memorial on Sunday September 11, 2011.

 

Utilities:  Rhome: Reported on the morning Water and Sewer Advisory Board meeting there was no quorum but it was noted that there were no violations or complaints. 

 

Planning, Zoning, & Housing: Thompson:  No formal report

 

PUBLIC SPEAKS:  Cindy King of 837 South Haines Ave. addressed Police Department Matters and termination of an officer.

 

SPECIAL REPORTS:  David Lundgren of the Revolving Loan Fund review committee addressed Ordinance 75-11 and the Committee recommendations regarding the loan application.

 

Greg Carpenter of American Recycling addressed Council regarding Ordinance 75-11 and his business and creation of jobs.  Mr. Carpenter further discussed the nature of the business and also addressed the potential of utilizing remaining portions of the facility to facilitate other small businesses.

 

THIRD READINGS:

 

Ordinance 65-11: Introduced by Andreani: An Ordinance determining that the City of Alliance has items of personal property which are not needed for municipal purposes which may exceed one thousand dollars ($1,000.00) in estimated value, authorizing the sale of such personal property by written contract to the highest and best bidder at public sale by the Director of Public Safety and Service, and including in said public sale, personal property designated by the Alliance Board of Park Commissioners and the Alliance City Board of Health; and declaring an emergency. Motion and second to amend to include new Exhibit “A”: Roll Call: Unanimous to amend. Motion and Second to adopt as amended; Roll Call: Unanimous ADOPTED.

 

Ordinance 67-11: Introduced by Thompson: An Ordinance accepting and approving the replat of part of lot 10582 and all of lot 10583 located on the North side of Overlook Drive between Federal Avenue and Fernwood Boulevard in the City of Alliance, County of Stark and State of Ohio. Motion and second to adopt: Roll Call: unanimous: ADOPTED

NEW BUSINESS:

 

Resolution 73-11: Introduced by Clunk and  Andreani: An Ordinance authorizing the Director of Public Safety and Service and the City Engineer to prepare and submit an application to participate in the Ohio Public Works Commission (OPWC) State Capital Improvement Program and to execute contracts as may be necessary for the purpose of obtaining funds for the State Route 183 grade lowering project; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rule suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED

 

Ordinance 74-11: Introduced by Dordea: An Ordinance adopting new FEMA flood damage reduction regulations and repealing existing Chapter 1330 Flood Plain Regulations of the Codified Ordinances of the City of Alliance; and declaring an emergency. Ordinance 75-11: Introduced by Council as a Whole: An Ordinance authorizing the execution of a loan agreement in the amount of $154,000.00 to American Recycling Services LLC.; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rule suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED

 

Resolution 76-11: Introduced by Okey: A Resolution creating an advisory committee to study the Facebook Page of the Alliance Police Department and make recommendations; and declaring an emergency Motion and second to suspend rules: Roll Call: 3 in favor (Okey, Phillips, and Thompson) to 3 opposed (Andreani, Dordea, and Rhome). Motion failed
