MINUTES OF JUNE 21, 2010

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

The meeting was called to order by President Benincasa at 7:00 P.M. Councilperson Dordea gave the Invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Roy Clunk, Larry Dordea, Steve Okey, and Roger Rhome present.  

Motion and second to excuse Councilperson Phyllis Phillips who is ill and Larry Thompson Who is out of Town. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Motion and second to approve the minutes of the June 7, 2010, Regular Council Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

COMMUNICATIONS:

The Clerk noted the following communications tendered to the clerk for Council:

1. Notice of City Council Meeting June 21, 2010 @ 12:00 @ Courtney Banquet Center for Jobs Summit

2. Memorandum Auditor Knowles  RE: Operational Budget Report.

3.  Agenda for the June 15, 2010 Board of Zoning Appeals Meeting.

5.  Notice of  June 2, 2010 Downtown Special Events Commission Meeting.

6.  Public Notice of Proposed Consent Order from the Ohio EPA.

ADMINISTRATIVE REPORTS:

Mayor Middleton: No Formal Report

Safety Service Director Blaser: Reported that the Planning Commission has approved Ordinances 40-10, 41-10, 45-10, and 46-10 and reviewed Ordinance 52-10

Law Director Andrew Zumbar:  Reported on the Horton Lawsuit and the Appeal on the Bartolet Matter.

Auditor Knowles: Reported on the Operational Budget Report.

STANDING COMMITTEE REPORTS:

Safety & Judiciary: Andreani:  No Formal Report

Streets & Alley: Clunk: No formal report

Properties and Lands: Dordea: No formal report.  

Finance: Okey:  No formal report

Community Development: Phillips:  Absent, however Councilman Okey reported on the Jobs summit held earlier in the day with some of the resources and coordination available and still needed.

Utilities:  Rhome: No formal report.

Planning, Zoning, & Housing: Thompson: Absent, formal report. 

PUBLIC SPEAKS: Paul Ray of 2832 Blenheim Ave. Spoke of City clean up of litter

Chuck McClaugherty of 1623 South Freedom Spoke of the Shade Tree Commission

Motion and Second for Council as a Whole sponsor a Proclamation Declaring  A City Wide Litter clean up day in honor of Scott Weitzel.

THIRD READINGS:

Ordinance 40-10: Introduced by Clunk: An Ordinance vacating Rice Street from South Union Avenue to lots 12919 and 12920 Owned by the Alliance Community Hospital, in the City of Alliance, County of Stark, and State of Ohio; and Declaring an Emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED.

Ordinance 41-10: Introduced by Clunk: An Ordinance accepting and approving the replat of all of outlots 256 thru 260, 641 and 653; and all of lots 51, 52, 57 thru 60, 4913 thru 4916, 4923, 11101, and 12067 thru 12080; and part of lots 53 thru 56, 11068 and 11069 and a vacated portion of Rice Street in the City of Alliance, County of Stark, and State of Ohio ; and Declaring an Emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED.

SECOND READINGS:

Ordinance 44-10: Introduced by Thompson: An Ordinance accepting and approving the replat of lot 9967, part of lots 9966 and 9968 through 9970, part of lots 11073 and  12255, and part of outlot 630 located on West State Street in the City of Alliance, County of Stark, and State of Ohio; and Declaring an Emergency. NO FORMAL ACTION.

Ordinance 45-10: Introduced by Thompson: An Ordinance accepting and approving the replat of part of outlots  457 and 465 and all of lots 462,463 and 464 located on West State Street in the City of Alliance, County of Stark, and State of Ohio ; and Declaring an Emergency. NO FORMAL ACTION.

Ordinance 46-10: Introduced by Thompson: An Ordinance accepting and approving the replat of lot 6737, part of lot 6738, and part of outlot 234 located on South Union Avenue in the City of Alliance, County of Stark, and State of Ohio ; and Declaring an Emergency. NO FORMAL ACTION.

NEW BUSINESS:

Ordinance 52-10: Introduced by Rhome: An Ordinance approving the final draft solid waste management plan update of the Stark  - Tuscarawas – Wayne Joint solid Waste Management District; and Declaring an Emergency. Motion and second to suspend rules: Roll Call: Unanimous for rule suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED.
