MINUTES OF NOVEMBER 1, 2010

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

The meeting was called to order by President Benincasa at 7:00 P.M. Councilperson Phillips gave the Invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Roy Clunk, Larry Dordea, Steve Okey, Phyllis Phillips, Roger Rhome and Larry Thompson present. President.

 

Clerk informed Council of a clerical mistake in the July 19, 2010 and August 2, 2010 minutes related to Ordinance 54-10.

 

Motion and second to amend and correct the minutes of July 19, 2010, and the August 2, 2010 Regular Council Meetings. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

Motion and second to approve the minutes of October 18, 2010, Regular Council Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

Motion and second to approve the minutes of October 21, 2010, Special Council Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

COMMUNICATIONS: The Clerk noted the following communications tendered to the clerk for Council:

 

1. Memorandum Auditor Knowles  RE: October Municipal Income Tax Recapitulation.

2.   Memorandum / e-mail from Director Blaser RE: Geosmin and MIB levels in the Water.

3.   Memorandum from Councilman Okey  RE: Concerns over the CFA loan addressed @ last meeting.

4.  Various e-mail communications forwarded RE: CFA loan and passage of Ordinance 84-10.

5.  Letter Dale Wells of Alliance Community Hospital RE: Bond Indenture.

6.  Minutes of the September 15, 2010 Planning Commission meeting.

7.  Agenda for the November 17, 2010 Planning Commission meeting.

Motion and second to receive and file all communications tendered to the Clerk.  MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

ADMINISTRATIVE REPORTS:

 

Mayor Middleton:  Addressed Ordinance 86-10 and noted the parties present to discuss this including Hospital CEO, City Auditor and City Law Director.  Reported City Administration supports its passage.

 

Safety Service Director Blaser:  Addressed the comparison of Canton Water and Alliance Water and referred to Canton Repository article addressing Canton Water quality

 

Addressed accolades provided to Development department and Director Marion for getting CFA loan and package done for relocation

 

Law Director Andrew Zumbar:  Reported that City did receive a dismissal on Geisberger case and updated status on Horton case in Federal Court

 

Addressed Ordinance  87-10  and the need for it.

 

Addressed issue of circumstances in which Council can enter Executive Session to address Revolving Loan applications.  Reported he will provide a written opinion on the matter to Council.

 

Auditor Knowles: Reviewed the October Municipal Income Tax Recapitulation.

 

Addressed Ordinance 86-10 and report from Bond Council. 

 

STANDING COMMITTEE REPORTS:

 

Safety & Judiciary: Andreani:  No Formal Report.  Reported on Possible dates to Meet with Robertson Family.

 

 

 

 

 

 

 

 

 

Motion and second to hold a workshop meeting of Council as a committee of the whole with the Robertson Family on November 15, 2010 at 6:00 pm MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

Addressed Ordinance 88-10 and noted its introduction tonight but not asking for action tonight

 

Streets & Alley: Clunk: No formal report

 

Properties and Lands: Dordea: No formal report Commended Alliance Police Department for investigation into the Leeson Murder and the Conviction of Jeffery Phillips.

 

Finance: Okey:  Discussed Ordinance 85-10 and asking it be referred to committee of Council of the Whole for further action.

 

Need a meeting to discuss several matters including meeting with Safety and Judiciary Committee to address the COPS grant.

 

Community Development: Phillips:  No formal report 

 

Utilities:  Rhome: Reported on the Morning Water and Sewer Advisory Board Meeting. Reported on MIB levels in Walborn and Deer creek

 

Planning, Zoning, & Housing: Thompson: No formal report.

NEW BUSINESS:

 

Ordinance 85-10: Introduced by Okey: An Ordinance to reform and amend Chapter 177 of the Alliance Codified Ordinances to improve the information provided to City Council relating to proposed loans from the Economic Development Revolving Loan Fund;  and Declaring an Emergency. Motion and second to refer to Council as a Committee of the Whole. Roll Call: Unanimous. REFERRED TO COUNCIL AS COMMITTEE AS A WHOLE.

 

Ordinance 86-10: Introduced by Council as a Whole: An Ordinance authorizing the issuance and sale of not to exceed $17, 630,000 aggregate principal revenue bonds, series 2010 (Alliance Obligated Group), for the purpose of financing and refinancing costs of hospital facilities; authorizing the execution of a first supplemental base lease, a first supplemental lease, a first supplemental bond indenture, a first supplemental assignment to bond trustee, and an assignment of rights under a first supplemental base lease and a first supplemental lease to master trustee, all to secure payment of bond service charges on the series 2010 bonds; authorizing the execution and delivery of a bond purchase agreement and tax agreement for the series 2010 bonds and nay necessary escrow agreements; and authorizing and approving related matters; and Declaring an Emergency. Ordinance 87-10: Introduced by Andreani: An Ordinance amending Alliance Codified Ordinances Section 513.17, et.seq., providing for prohibition of the possession or use of the substance commonly referred to as “K-2” of “Spice”; and Declaring an Emergency. Motion and second to suspend rules: Roll Call: Unanimous for rule suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED

                                        

Ordinance 88-10: Introduced by Andreani: An Ordinance providing for the repayment of the $500,000 loan to the General Fund from the Master Capital Improvement Fund and the Water Income Tax Fund. NO FORMAL ACTION

 

Proclamation: Introduced by Council as a Whole: A Proclamation expressing to Alliance City Fire Inspector Guy Aumend the sincere appreciation of this Council, the Administration, and the Citizens of the City of Alliance for his continuing service and recognizing his award as Stark County Firefighter of the year. Motion and second to adopt: Roll Call: unanimous: ADOPTED

 

 

OLD BUSINESS:

 

Ordinance 70-10: Introduced by Thompson: An Ordinance accepting and approving the replat of lots 7758 and 7759 located on North Johnson Avenue in the City of Alliance, County of Stark and State of Ohio. Motion and second to adopt: Roll Call: unanimous: ADOPTED
