MINUTES OF OCTOBER 19, 2009

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

 

 

The meeting was called to order by President Benincasa at 7:00 P.M. Councilman Thompson gave the Invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Roy Clunk; Steve Okey, Phyllis Phillips Roger Rhome, Sue Ryan, and Larry Thompson present.

 

Motion and second to approve the minutes of the October 5, 2009, Regular Council Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

 

COMMUNICATIONS:

 

The Clerk noted the following communications tendered to the clerk for Council:

ADMINISTRATIVE REPORTS:

 

Mayor Middleton:  Asked for Council approval of appointments to the Planning Commission and the Contractor Licensing Board.  Announced First Energy representatives are present to discuss Ordinance 92-09.

 

Safety Service Director Blaser:  Reviewed Ordinancse 91-09 and 93-09

 

Law Director Andrew Zumbar:  Addressed the “First Day Motions” memo regarding PTC Alliance.

 

Advised status on motions in the Jail dispute litigation and the appeal pending.

 

Auditor Knowles: Reviewed General Fund Summary / Operational Budget Report as of September 30, 2009.

 

 

STANDING COMMITTEE REPORTS:

 

Safety & Judiciary: Andreani:  No formal report.

 

Motion and second to approve the Mayor’s appointment of Tiffany Gravlee to the Planning Commission. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

Motion and second to approve the Mayor’s appointment of Ralph Fluharty and Craig Bolog to the Contractor Licensing Board. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

Properties and Lands: Clunk: No formal report.


 

Finance: Okey: Reported on the October 14, 2009 joint meeting with Utilities Committee to discuss Ordinance 55-09.  Committees recommended passage of Ordinance 55-09.

 

Community Development: Phillips:  No formal report.

 

Utilities:  Rhome:  No formal report. Asking for support on Ordinance 87-09 and 55-09

 

Streets & Alley: Ryan: Addressed the Summary of 2009 Farmers’ Market activity.  Asking for support on Proclamation recognizing the Farmer’s Market.

 

Planning, Zoning, & Housing: Thompson: No formal report. 

 

 

PUBLIC SPEAKS: Sarah Brown of 1200 Fernwood Blvd. spoke of UV light study at water treatment plant and Cap & Trade legislation.

 

Caroline Crites of 964 Overlook Drive spoke of Legislative Breakfast of the Community Coalition at the YWCA Saturday October 24, 2009 @ 9:00 AM.

 

 

THIRD READINGS:  

 

Ordinance 82-09: Introduced by Ryan: An Ordinance vacating part of the unnamed alley West of Scranton Avenue between West Cambridge Street and West Summit Street, in the City of Alliance, County of Stark, and State of Ohio; and declaring an emergency. NO FORMAL ACTION.

 

Ordinance 83-09: Introduced by Thompson: An Ordinance accepting and approving the replat of Lots 1965, 1967, 1969, 3931, 3932 and part of a vacated 20 foot unnamed East-West alley between West Cambridge Street and West Summit Street, in the City of Alliance, County of Stark, and State of Ohio; and declaring an emergency. NO FORMAL ACTION.

 

Ordinance 87-09: Introduced by Rhome & Andreani: An Ordinance authorizing the Director of Public Safety and Service to accept a bid from a prior bidding if available or to advertise for bids and enter into a contract for the purpose of purchasing a new sludge applicator truck for the Wastewater Treatment Plant; and declaring an emergency. NO FORMAL ACTION.

Ordinance 91-09: Introduced by Andreani: An Ordinance authorizing and directing the Director of Public Safety and Service to advertise for bids and enter into contracts for the purchase of various supplies for the year 2010 to include options to renew where practical or to accept existing options to renew; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

 

Ordinance 92-09: Introduced by Rhome: An Ordinance authorizing and directing the Director of Public Safety and Service to execute an amendment to the Master Agreement with First Energy Solutions to provide services to Commercial and Residential users within the Alliance Aggregate Group; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and Second to Amend Exhibit “A” to reflect correct grant amount. Ordinance 93-09: Introduced by Andreani: An Ordinance making appropriations and transfers of funds in the 2009 Appropriations to provide for necessary expenses and adjustments; and declaring an emergency. Proclamation – A Proclamation recognizing the Alliance Farmer’s Market on the Completion of a successful year of activity. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

 

OLD BUSINESS:

 

Ordinance 55-09: Introduced by Rhome and Andreani: An Ordinance authorizing and directing the Director of Public Safety and Service to request qualifications and enter into a professional services contract for engineering and design services of integrating Ultraviolet light into t he treatment process at the Water Treatment Plant; and declaring an emergency. Motion and second to amend Ordinance 55-09 to include “not to exceed $100,000” Roll Call: Unanimous to amend. Motion and Second to Adopt Ordinance 55-09 as amended. Roll Call: Unanimous: ADOPTED AS AMENDED.
