MINUTES OF JULY 20, 2009

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

 

The meeting was called to order by President Benincasa at 7:00 P.M. Councilman Clunk gave the Invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Roy Clunk; Steve Okey, Phyllis Phillips, Roger Rhome, Sue Ryan, and Larry Thompson present.

 

Motion and second to approve the minutes of the July 20, 2009, Regular Council Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

COMMUNICATIONS:

 

The Clerk noted the following communications tendered to the clerk for Council:

 

1.         Notice of  the July 29, 2009 Downtown Special Events Commission Meeting.

2.         Memorandum from Auditor Knowles RE: July 2009 Alliance Municipal Income Tax Recapitulation.

3.         Notice of  the July 31, 2009 Planning, Zoning, & Housing Committee Meeting.

4.         Letter from the Ohio Division of Liquor Control RE: License application of Wing warehouse.

5.         Letter and Documents from Law Director Zumbar RE: St. Nicholas Annexation.

6.         Letter from Mayor Middleton RE: Veto of Ordinance 49-09.

7.         E-Mail from Engineer Bungard RE: Estimated schedule for Brayton Ave. traffic signal installation.

8.         Letter from Mayor Middleton RE: Receipts collected in Mayor’s Office during July 2009.

Motion and second to receive and file all communications tendered to the Clerk.  MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

ADMINISTRATIVE REPORTS:

 

Mayor Middleton:  No Formal Report.

 

Safety Service Director Blaser: Reported we did not receive funding under the COPS grant. Application has been held pending further appropriations.

 

Informed Council of the status of the work for Ordinance 55-09 with no more cost information available yet.  Asked Council to defer any action to a later date after more information is received and hope to know more soon. 

 

Reported no new information on Ordinance 52-08 and 53-08.

 

Reviewed Ordinances 69-09; 70-09; 71-09; and 72-09

 

Law Director Andrew Zumbar:  Absent. No Report.

 

Auditor Knowles: Reviewed the July 2009 Alliance Municipal Income Tax Recapitulation.

 

STANDING COMMITTEE REPORTS:

 

Safety & Judiciary: Andreani:  No Formal Report.

 

Noted the Liquor permit application received for the Wing Warehouse and noted no need for immediate action and a desire to address it with the Police Chief and Law Director prior to recommendation on potential action.

 

Properties and Lands: Clunk: No formal report.

 

Finance: Okey: No Formal Report.

 

Motion and Second to override the Mayor’s Veto on Ordinance 49-09. Roll Call: 5 (Clunk, Okey, Phillips, Ryan, and Thomson) in favor - 2 (Andreani and Rhome) against Veto Overridden.

 

Community Development: Phillips: 

 

Utilities:  Rhome:  Reported on the August 3, 2009 Morning meeting of the Water and sewer advisory board.  Reported on Beech Street water line progress and the need to replace board members.


 

Streets & Alley: Ryan: No formal report.

 

Planning, Zoning, & Housing: Thompson: Reported on the July 31, 2009 to discuss Ordinance 23-09-S and 45-09.  Need more work on 23-09-S and asking for no action on it tonight

 

There are numerous changes to the Zoning Code in Ordinance 45-09 addressing signs, wood burners windmills etc. a public hearing is needed and committee recommends passage.

 

Motion and second to set public hearing for September 8, 2009 @ 7:30 P.M on Ordinance 45-09. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

THIRD READINGS:  

 

Ordinance 57-09: Introduced by Thompson: An Ordinance vacating a 15 foot alley North of Overlook Drive and West of Rockhill Avenue in the City of Alliance, County of Stark, and State of Ohio. Motion and second to adopt: Roll Call: Unanimous against adoption: DEFEATED.

 

SECOND READINGS:

 

Resolution 61-09: Introduced by Council as a Whole: A Resolution providing for the Alternative Tax Budget for 2010; and declaring an emergency. NO FORMAL ACTION.

 

Ordinance 23-09-S: Introduced by Andreani and Thompson: An Ordinance amending Chapter 1327, “Licensing of Contractors” to provide citizens with the ability to Grieve issues relating to contractors. NO FORMAL ACTION.

 

NEW BUSINESS:  

 

Ordinance 69-09: Introduced by Rhome and Andreani: An ordinance authorizing and directing the Director of Public Safety and Service to advertise for bids and enter into a contract for the purchase or lease including installation costs of granular activated carbon at the water treatment plant, or to renew the existing contract for granular activated carbon for a period of three years in either case; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

 

Ordinance 70-09: Introduced by Andreani: An ordinance to approve replacement pages to the Alliance Codified Ordinances; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

 

Ordinance 71-09: Introduced by Andreani: An ordinance making appropriations and transfers of funds in the 2009 appropriations to provide for necessary expenses and adjustments; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

 

Ordinance 72-09: Introduced by Ryan Clunk & Andreani: An ordinance authorizing the Director of Public Safety and Service to enter into a consent agreement  attached as Exhibit “A” with the Ohio Department of Transportation for intersection improvements on U.S. 62 at Rockhill Avenue and Parkway Blvd.; and declaring an emergency. NO FORMAL ACTION.

 

Motion and Second to remove Proclamation regarding Cap and Trade from the table: Roll 2 in favor (Andreani and Rhome) 5 against (Clunk, Okey, Phillips, Ryan, and Thompson)

 

ADJOURNMENT: Noting no further business to come before this Council, President Benincasa adjourned the meeting at 7:45 P.M.
