MINUTES OF MARCH 16, 2009

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

 

The meeting was called to order by President Benincasa at 7:00 P.M. Council person Ryan gave the Invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Roy Clunk,   Steve Okey, Phyllis Phillips, Roger Rhome, Sue Ryan, and Larry Thompson present.

 

Motion and second to approve the minutes of the March 2, 2009, City Council Workshop Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

COMMUNICATIONS:

 

Motion and second to receive and file all communications tendered to the Clerk.  MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

 

ADMINISTRATIVE REPORTS:

 

Mayor Middleton:  No Formal Report.

 

Safety Service Director Blaser: Reported on MIB’s on City Water Supply and the work on water taste and smell improvement.  Also reported on work at identifying things entering the watershed

 

Addressed the new substitute exhibits for Ordinance 13-09 and 14-09

 

Addressed public request by councilman Okey regarding Countywide leachate treatment at wastewater treatment plant.  Discussed how treatment of Countywide leachate has affected the plant and how it has been addressed with the Ohio EPA.

 

Reviewed Ordinance 22-09; 24-09; and 25-09.

 

Law Director Andrew Zumbar: Reviewed the Thunder Hill annexation and WMMT annexation and a motion to reconsider has been filed with the 5th District Court of Appeals

 

Updated Council on the Kayes Litigation matter and the status.

 

Auditor Knowles: Reviewed the General Fund Summary as of February 28, 2009

Motion and Second to waive the hearing for the new liquor permit for the Carnation Car Wash and Drive Thru. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Utilities:  Rhome:   Reported on the March 6, 2009 Meeting of the Water and Sewer Advisory Board Meeting with a tour of the Water Treatment Plant.

Planning, Zoning, & Housing: Thompson: No formal Report

Ordinance 10-09: Introduced by Okey: An Ordinance to authorize and require a one-time credit of ten percent to the monthly water bill of each residential customer of water from the City of Alliance; and to declare an emergency.   NO FORMAL ACTION.

Ordinance 13-09: Introduced by Thompson: An Ordinance vacating part of a 15 foot alley East of Madison Avenue North of Vine Street in the City of Alliance, County of Stark, and State of Ohio, and declaring an emergency. Motion and Second to set Public Hearing for April 6, 2009 @ 7:30 PMRoll Call: Unanimous to set Public Hearing. PUBLIC HEARING SET FOR APRIL 6, 2009 AT 7:30 PM.

 

Ordinance 14-09: Introduced by Thompson: An Ordinance accepting and approving the replat of lot 6079 and part of a vacated 15 foot alley located on Madison Avenue in the City of Alliance, County of Stark, and State of Ohio NO FORMAL ACTION.

 

Ordinance 15-09: Introduced by Thompson: An Ordinance accepting and approving the replat of lot 11735 and part of Outlot 290 located on South Union Avenue in the City of Alliance, County of Stark, and State of Ohio NO FORMAL ACTION.

 

Ordinance 20-09: Introduced by Andreani: An Ordinance making permanent appropriations for 2009 for the General Fund, Water Fund, Sewer Fund, and other City Fund, and authorizing the Auditor to draw his warrants for payment of any appropriations upon receiving proper certificates and vouchers; and declaring an emergency NO FORMAL ACTION.

 

 

 

NEW BUSINESS:

 

Ordinance 22-09: Introduced by Andreani: An Ordinance determining that the Alliance Police Department has items of personal property which are not needed for municipal purposes which may exceed $1,000.00 in estimated value; authorizing the sale of such personal property by written contract to the highest and best bidder at public sale; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

 

Ordinance 23-09: Introduced by Andreani and Thompson: An Ordinance amending Chapter 1327, “Licensing of Contractors” to provide citizens with the ability to Grieve issues relating to contractors. Motion and Second to refer to the Planning Zoning and Housing Committee: Roll Call: Unanimous. REFERRED TO PLANNING, ZONING AND HOUSING COMMITTEE.

 

Ordinance 24-09: Introduced by Clunk and Rhome: An Ordinance authorizing the Director of Public Safety and Service to enter into an easement agreement with the Army Corps of Engineers for the Deer Creek Dam, access and appurtenances; and declaring an emergency. . Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

 

Ordinance 25-09: Introduced by Okey: An Ordinance authorizing and directing the Director of Public Safety and Service to submit an application to the U.S. Department of Justice’s Office of


 

Community Oriented Policing Services for the purpose of acquiring grant funds to increase manning levels in the Alliance Police Department; and declaring an emergency.
