MINUTES OF DECEMBER 21, 2009
REGULAR MEETING OF THE ALLIANCE CITY COUNCIL
The meeting was called to order by President Benincasa at 7:00 P.M. Councilperson Rhome gave the Invocation and led the meeting in the Pledge of Allegiance.
ROLL CALL: Alan Andreani, Roy Clunk, Steve Okey, Roger Rhome, and Sue Ryan present.
Motion and Second to excuse Phyllis Phillips and Larry Thompson due to family obligations. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
Motion and second to approve the minutes of the December 7, 2009, Regular Council Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
COMMUNICATIONS:
The Clerk noted the following communications tendered to the clerk for Council:
1. Memorandum from Auditor Knowles RE: Operational Budget Report by Department as of November 30, 2009.
2. Letter from Ohio Auditor of State RE: Recognizing Alliance for Excellent Financial Accountability.
3. Minutes of the November 17, 2009 Planning Commission Meeting.
4. Notice of the Special December 16, 2009 Special Planning Commission Meeting.
5. Minutes of the December 7, 2009 Water and Sewer Advisory Board Meeting.
6. E-mail from Director Blaser RE: Proposed Amendment to Ordinance 101-09.
7. E-mail request from Director Blaser for Executive Session to discuss contract negotiations.
8. Notice from Ohio Division of Liquor Control RE: New Permit for Silver Bullet.
9. Letter from Alliance Professional Firefighters Local 480 RE: Change in Union Leadership
10. Letter from Clerk of Council RE: Reappointment for new term.
Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
ADMINISTRATIVE REPORTS:
Mayor Middleton: Asked for the Re-appointment of members to various boards:
Board of Health: .Gloria Whiteley-Magrath
Historical Preservation: .Rick Wilt and Amado Sandoval
Park Board: .Blair Young
Shade Tree Commission: .Charles McClaugherty and Kathryn Miller
Motion and second to make appointments as set forth by Mayor. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
Safety Service Director Blaser: Reviewed MIB levels and taste and odor in water.
Reviewed Amendments to Exhibit A of Ordinance 101-09
Addressed Ordinances 52-08 and 53-08 pending in old business file and the progress toward resolving the issue.
Announced we need a Special Meeting to finish out the years finances and do a final appropriations adjustment.
Asked for an executive Session to review Collective Bargaining Unit negotiations.
Motion and second to hold executive session following regular session to discuss collective bargaining agreements including Council Members, Council President, Council Clerk, Mayor, Safety Service Director, Law Director, Auditor and Councilman Elect Dordea present. Roll Call: Unanimous. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
Law Director Andrew Zumbar: Addressed the annual liquor license renewals announced deadline to get complaints in to proceed with any possible objections.
Auditor Knowles: Reported on the Operational Budget Report by Department as of November 30, 2009 and the Letter from Ohio Auditor of State RE: Recognizing Alliance for Excellence in Financial Accountability.
STANDING COMMITTEE REPORTS:
Safety & Judiciary: Andreani: No formal report. Noted the Liquor application for the Silver Bullet and will review with Law Director and Police Chief prior to next meeting.
Properties and Lands: Clunk: No formal report.
Finance: Okey: No Formal Report. Motion and Second to hold Special Meeting on December 28, 2009 @ 7:00 PM in Council Chambers to address Ordinance 101-09, year end appropriations and any other business that comes before Council.
Community Development: Phillips: Absent. No formal report.
Utilities: Rhome: No formal report.
Streets & Alley: Ryan: No formal report.
Planning, Zoning, & Housing: Thompson: Absent. No formal report.
PUBLIC SPEAKS: None
THIRD READINGS:
Ordinance 98-09: Introduced by Okey, Phillips, and Ryan: An Ordinance to amend section 154.02 of the Codified Ordinances of Alliance, Ohio, relating to the membership of the Water/Sewer Advisory Board; and declaring an emergency. NO FORMAL ACTION.
SECOND READINGS:
Ordinance 101-09: Introduced by Andreani: An Ordinance making temporary appropriations for 2010 for the General Fund, Water Fund, Sewer Fund, and other city funds and authorizing the Auditor to draw payments from those appropriations upon receiving certificates and vouchers; declaring an emergency. NO FORMAL ACTION.
Councilman Okey and President Benincasa expressed appreciation to Councilman Ryan for her service.
Council entered executive session at 7:25 PM with Council Members, Council President, Council Clerk, Mayor, Safety Service Director, Auditor and Councilman elect Dordea to discuss collective bargaining agreements.
Council re-entered regular session at 8:00 P.M.
ADJOURNMENT: Noting no further business to come before this Council, President Benincasa adjourned the meeting at 8:01 P.M.
