MINUTES OF THE APRIL 21, 2008
REGULAR MEETING OF THE ALLIANCE CITY COUNCIL
The meeting was called to order by President Benincasa at 7:00 P.M. Councilman Thompson gave the Invocation and led the meeting in the Pledge of Allegiance.
ROLL CALL: Alan Andreani, Roy Clunk, Steve Okey, Roger Rhome, Sue Ryan and Larry Thompson present.
Motion and second to Excuse Councilperson Phillips due to a family illness. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
Motion and second to approve the minutes of the April 7, 2008, 2008 Regular Council Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Safety Service Director Blaser: Reviewed some old business Ordinances and suggested defeat of 132-07 and 133-07 due to lack of interest by the proponent. Suggested postponing any action on 29-08 pending further review and reported the Planning Commission approved 30-08 and 38-08.
Reviewed Ordinances 39-08; 40-08; 41-08; 42-08; and 43-08
Law Director Andrew Zumbar: Asking for an executive session possibly with insurance counsel to discuss pending litigation.
Auditor Alexander Zumbar: No formal report.
STANDING COMMITTEE REPORTS:
Safety & Judiciary: Andreani: Need to schedule a meeting with the law director regarding review of loud party repeat police response ordinance.
Asking council to defer action on Liquor permit request by Alliance Country Club until next meeting so it can be reviewed with the law director and police chief.
Reported on the organizational meeting of the community relations committee.

Ordinance 38-08: Introduced by Thompson: An Ordinance accepting and approving the replat of parts of Lots 2053, 2313, and 2372 and a all of lots 2335 through 2341, 2305 through 2311, 9666, 9667, 111179, 13022 a vacated 10 foot alley, and part of a vacated 20 foot alley on South Union Avenue between Milner Street and Rosenberry Street in the City of Alliance, County of Stark, and State of Ohio. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. No further action until after action on Ordinance 30-08.
NEW BUSINESS:
Ordinance 39-08: Introduced by Andreani: An Ordinance authorizing and directing the Director of Public Safety and Service to enter into a contract for the purpose of purchasing a new Chief’s Car for the Fire Department through the cooperative purchasing programs of the Ohio Department of Transportation or to advertise for bids and enter into a contract with another vendor at the lowest and best price, but for a cost not to exceed $16,750 in any case; and declaring an emergency. Ordinance 40-08: Introduced by Rhome: An Ordinance authorizing and directing the Director of Public Safety and Service to advertise for bids and enter into a contract with the lowest and best bidder for replacement and rehabilitation of the raw influent screw lift pumps at the wastewater treatment plant; and declaring an emergency. Ordinance 41-08: Introduced by Okey and Ryan: An Ordinance accepting the proposed annual consolidated plan for the City of Alliance pursuant to the FY-2008 community development block grant program in an amount not to exceed $680,281.00; and declaring an emergency. Ordinance 42-08: Introduced by Andreani: An Ordinance authorizing and directing the Director of Public Safety and Service to accept a $4,200 grant from the Ohio Department of Commerce, Division of State Fire Marshal; appropriating the grant funds for use by the Alliance Fire Department; and declaring an emergency. Motion and second to bring to the floor for action: Roll Call: Unanimous for bringing to the floor for action. Motion and second to adopt: Roll Call: Unanimous against adoption: DEFEATED.
Ordinance 133-07: Introduced by Price: An Ordinance accepting and approving the replat of Lots 8767 and 7361 and a vacated portion of a 15 foot alley on Hartshorn Street in the City of Alliance, County of Stark, and State of Ohio. Motion and second to bring to the floor for action: Roll Call: Unanimous for bringing to the floor for action. Motion and second to adopt: Roll Call: Unanimous against adoption: DEFEATED.
PUBLIC HEARING: At 7:30 P.M. Council proceeded with its scheduled public hearing on Ordinance 30-08. Council Clerk Yost read the Notice of Public Hearing President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Upon observing no response President Benincasa made three (3) calls for all those wishing to speak in opposition to the Ordinance. Upon observing no response President Benincasa declared the public hearing closed at 7:32 P.M.
Ordinance 30-08: Introduced by Ryan: An Ordinance vacating a North South Alley and an East West Alley East of South Union Avenue between Rosenberry Street and Milner Street, in the City of Alliance, County of Stark, and State of Ohio. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

Motion and second to conduct an executive session to discuss pending litigation with council, council president, council clerk, mayor, safety service director, law director, auditor, and Police Chief. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
Council entered executive session at 7:35 P.M. with council, council president, council clerk, safety service director, law director, auditor, and Police Chief discuss pending litigation.
Council returned from executive session to regular session at 8:01 P.M.
ADJOURNMENT: Noting no further business to come before this Council, President Benincasa adjourned the meeting at 8:01 P.M.
