MINUTES OF THE OCTOBER 15, 2007

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

The meeting was called to order by President Benincasa at 7:00 P.M. Councilperson Andreani gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.

Motion and second to approval the minutes of the October 1, 2006 regular Council Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Mayor Middleton:. Explained Resolution 124-07.

Announced Skate park will officially open October 27, 2007 @ 10:00 a.m. with an opening ceremony.

Announced there will be a Flu Clinic at the Senior Center on November 5, 2007 from 1:00 to 3:00 p.m.

Safety Service Director Blaser: Review of Ordinance 122-07.

Announced that the ODOT paving on East Street is substantially complete with discussion the raising of manholes still needing done and discussions ongoing with ODOT about responsibility.

City Paving substantially complete.

Law Director Andrew Zumbar: Reviewed the 5^th District Court of Appeals Opinion RE: Sherry’s Treasures v. City of Alliance Board of Zoning Appeals.

Auditor Alexander Zumbar: Reviewed the Operational Budget Report by Department as of 9-30-07

Ordinance 110-07: Introduced by Andreani: An Ordinance making appropriations and transfers of funds to provide for necessary expenses and adjustments; and declaring an emergency. Motion and second to excuse Councilman Okey from voting due to conflict of interest: Roll Call: Unanimous to excuse Councilman Okey. Motion and second to adopt: Roll Call: Unanimous (5-0): ADOPTED.

SECOND READINGS:

Ordinance 117-07: Introduced by Okey, Price and Ryan: An Ordinance to authorize and direct the Director of Public Safety and Service to install a traffic control signal at the intersection of U. S. 62 and Brayton Avenue, consistent with the provisions of the Ohio Department of Transportation manual and specifications for a uniform system of traffic control devices; and declaring an emergency. NO FORMAL ACTION.

Resolution 121-07: Introduced by Council as a Whole: A Resolution Supporting Governor Ted Strickland’s Energy, Jobs and progress plan and urging passage of Senate Bill 221 introduced by Senator Schuler at the request of Governor Strickland. NO FORMAL ACTION.

NEW BUSINESS:

Ordinance 116-07: Introduced by Rhome and Andreani: An Ordinance authorizing the Director of Public Safety and Service to create a program to provide assistance to property owners in the City of Alliance for sidewalk improvements. Motion and second to refer to the Streets and Alleys Committee: Roll Call: Unanimous: REFERRED TO STREETS AND ALLEYS COMMITTEE.

Ordinance 118-07: Introduced by Andreani: An Ordinance making appropriations and transfers of funds in the 2007 appropriations to provide for necessary expenses and adjustments; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

Ordinance 119-07: Introduced by Andreani and Rhome: An Ordinance authorizing charging cable/video service providers that have obtained a video service authorization or renewal pursuant to the authority of the State of Ohio a Video service provider fee in the amount of five percent (5%) of gross revenues, and authorizing the Safety Service Director to deliver notice of this ordinance to video service providers within ten (10) days of receiving notice of the provider’s intent to offer service in the City of Alliance; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

Resolution 120-07: Introduced by Rhome : A Resolution encouraging support for the City of Alliance Park and Recreation Levy. Motion and second to adopt: Roll Call: 4 in favor (Andreani, Rhome, Ryan, Thompson) 3 against (Okey, Phillips, Price): ADOPTED.

OLD BUSINESS:

Ordinance 96-07: Introduced by Rhome: An ordinance accepting and approving the replat of Lot 4568 and 4569 Located on North Lincoln Street in the City of Alliance, County of Stark; and declaring an emergency. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.
