MINUTES OF THE OCTOBER 1, 2007
REGULAR MEETING OF THE ALLIANCE CITY COUNCIL
The meeting was called to order by President Pro Tem Price at 7:00 P.M. Councilperson Thompson gave the invocation and led the meeting in the Pledge of Allegiance.
ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.
Noted that President Pro Tem Price was conducting the meeting in the absence of President Benincasa who was out of town on family business.
Motion and second to approval the minutes of the September 17, 2006 regular Council Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADMINISTRATIVE REPORTS:
Mayor Middleton:. Explained the situation with the strike at PTC Alliance and Noted that the City has offered any assistance it can to assist resolving the situation.
Explained Resolution 121-07.
Safety Service Director Blaser: Discussed the problems with the East State Street paving and the lowered manholes. In the process of reviewing how the situation will be resolved.
Reviewed Planning commission action on Ordinance 53-07 (Denied), 96-07 (Approved) and 103-07 (Approved).
Reviewed Ordinance 114-07, 115-07, 116-07, and 118-07.
Law Director Andrew Zumbar: Reviewed Ordinance 119-07.
Auditor Alexander Zumbar: Reviewed the State Audit and noted there were no findings for recovery or citations.
Reviewed the September 2007 Alliance Municipal Income Tax Recapitulation.

STANDING COMMITTEE REPORTS:
Safety & Judiciary: Andreani: No formal report.
Asking for action on Resolution 113-07, Ordinance 118-07, and Ordinance 119-07.
Finance: Okey: Commented on the Finance Committee needing to set a meeting in the near future to review the situation with the Clerk of Court Budget.
Explained Ordinance 117-07 and not asking for action on the matter. Merely prepared it to be ready to go following the study of the matter. Also complimented the Police and Fire chiefs for their review of the action and in a prompt manner.
Community Development: Phillips: No formal report.
Planning, Zoning, & Housing: Price: No formal report. Need to schedule a meeting to discuss Ordinance 53-07 in old business.
Utilities: Rhome: Reviewed the October 1, 2007 morning meeting.
Requesting action on Ordinance 120-07.
Streets & Alley: Ryan: Discussed the September 25, 2007 meeting regarding pedestrian safety issues and will meet again to further address the issues such as lights and sidewalks.
Properties and Lands: Thompson: No formal report.

THIRD READINGS:
Ordinance 103-07: Introduced by Rhome: An Ordinance accepting and approving the Replat of part of outlot 398 on Sawburg Avenue in the City of Alliance, County of Stark and State of Ohio. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.
SECOND READINGS:
Ordinance 110-07: Introduced by Andreani: An Ordinance making appropriations and transfers of funds to provide for necessary expenses and adjustments; and declaring an emergency. Motion and second to excuse Councilman Okey from voting due to conflict of interest: Roll Call: Unanimous to excuse Councilman Okey. Motion and second to suspend rules: Roll Call: 5 to 0 for rules suspension motion fails. NO FORMAL ACTION TAKEN.
NEW BUSINESS:
Resolution 113-07: Introduced by Andreani: A Resolution accepting the amounts and rates as determined by the budget commission and authorizing the necessary tax levies and certifying them to the County Auditor. Revised Code, Secs. 5705.34-5705.35. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.
Ordinance 114-07: Introduced by Thompson: An Ordinance amending Ordinance 102-07 for the purpose of adding Exhibit “A” listing Items of personal property which are not needed for municipal purposes which exceed $1,000.00 in estimated value; and declaring an emergency.Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.
Ordinance 115-07: Introduced by Okey: An Ordinance authorizing the Director of Public Safety and Service to advertise for bids and enter into contracts for the purchase of various supplies for the year 2008 to include options to renew where practical, or to accept existing options to renew; and declaring an emergency.Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Ordinance 116-07: Introduced by Rhome and Andreani: An Ordinance authorizing the Director of Public Safety and Service to create a program to provide assistance to property owners in the City of Alliance for sidewalk improvements. Ordinance 117-07: Introduced by Okey, Price and Ryan: An Ordinance to authorize and direct the Director of Public Safety and Service to install a traffic control signal at the intersection of U. S. 62 and Brayton Avenue, consistent with the provisions of the Ohio Department of Transportation manual and specifications for a uniform system of traffic control devices; and declaring an emergency.

Ordinance 119-07: Introduced by Andreani and Rhome: An Ordinance authorizing charging cable/video service providers that have obtained a video service authorization or renewal pursuant to the authority of the State of Ohio a Video service provider fee in the amount of five percent (5%) of gross revenues, and authorizing the Safety Service Director to deliver notice of this ordinance to video service providers within ten (10) days of receiving notice of the provider’s intent to offer service in the City of Alliance; and declaring an emergency. Resolution 120-07: Introduced by Rhome : A Resolution encouraging support for the City of Alliance Park and Recreation Levy. Motion and second to adopt: Roll Call: 4 in favor (Andreani, Rhome, Ryan, Thompson) 3 against (Okey, Phillips, Price): ADOPTED.
Resolution 121-07: Introduced by Council as a Whole: A Resolution Supporting Governor Ted Strickland’s Energy, Jobs and progress plan and urging passage of Senate Bill 221 introduced by Senator Schuler at the request of Governor Strickland. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.
