MINUTES OF THE NOVEMBER 19, 2007

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

 

The  meeting was called to order by President Benincasa at 7:00 P.M.  Councilperson Phillips gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Steve Okey,  Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.

 

Motion and second to approval the minutes of the November 5, 2007 regular Council Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

COMMUNICATIONS:

 

1.                   Ohio Division of Liquor control Letter RE: objections to annual permit renewals.

2.                   Agenda for the November 20, 2007 Board of Zoning Appeals Meeting.

3.                   Minutes of the October 16, 2007 Board of Zoning Appeals Meeting.

4.                   Minutes of the November 5, 2007 Water and Sewer Advisory Board Meeting.

5.                   Announcement of a Step-Aerobics class sponsored by the Friends of the Park.

6.                   Announcement of a Holiday Workshop sponsored by the Friends of the Park.

7.                   Memorandum from Auditor Zumbar RE: Operational Budget by Department as of October 31, 2007.

8.                   Letter from Mayor Middleton RE: Traffic Signal at East State Street and Brayton Avenue.

 

Motion and second to receive and file all communications tendered to the Clerk.  MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

ADMINISTRATIVE REPORTS:

 

Mayor Middleton:. Absent. No Formal Report.

 

Safety Service Director Blaser:  Reviewed the letter from Mayor Regarding Traffic Signal at State Street and Brayton Avenue.

 

Review of Exhibit “A” for Ordinance 123-07 and review of Ordinance 131-07.

 

Law Director Andrew Zumbar:  Reviewed the status of the sexually oriented business lawsuit filed against law directors and prosecutors.

 

Reported that the Thunder Hill Annexation appeal is assigned to Judge Sinclair and the City should expect an expedited assignment schedule and prompt decisions.

 

Reviewed the Division of Liquor Control objection procedure letter and requested any concerns of establishments be directed to law director of police chief as soon as possible to gather information for possible objection to renewal.

 

Auditor Alexander Zumbar:   Reviewed the Operational Budget by Department as of October 31, 2007.

 

Reviewed the temporary budget in ordinance 123-07.

 

STANDING COMMITTEE REPORTS:

 

Safety & Judiciary: Andreani:  No formal report.  Will need to set a meeting the 1st week in December to review any possible objections to renewal of liquor permits.

 

Finance: Okey: No formal report. 

 

Community Development: Phillips: No formal report. 

 

Discussion of concern over placement of alcohol drive thru facilities in 2nd ward and in particular the new one being constructed at Arch Street and Oxford street.  Response by Law director that no liquor has been sought yet and strongly suggest that if one is sought, the City should object to its issuance.

 

Planning, Zoning, & Housing: Price: Discussion of the meeting on November 19, 2007 @ 5:30 PM  to discuss Ordinance 53-07. Committee recommends denying the replat.

 

Asking that 53-07 be brought back to the table with a recommendation that it be defeated.

 

Committee will hold a final meeting to clean up old business still held in committee before the end of the year.

 

Utilities:  Rhome: No formal report.  Asking that Ordinance 134-07 be sent to a committee of Council as a whole and a workshop be set to discuss the matter.

 

Streets & Alley: Ryan: No formal report. 

 

Question Status of Safety Service Director report on sidewalks. (Report not complete).

 

Question and discussion of planned use of property in Ordinance 132-07.

 

Properties and Lands: Thompson: Discussion and report on meeting of November 13, 2007 to discuss Ordinance 124-07.  Reference was made to Ordinance 19-06SS and how it is related.  Noted that reports on energy savings efforts are to be generated annually.  Committee recommends passage of Ordinance 124-07.

THIRD READINGS: 

 

Ordinance 123-07: Introduced by Andreani:  An Ordinance making temporary appropriations           2008 for the General Fund, Water Fund, Sewer Fund and other City Funds, and authorizing the Auditor to draw payments from those appropriations upon receiving proper certificates and          vouchers; and declaring an emergency Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

 

Resolution 124-07: Introduced by Andreani:  A Resolution establishing a "Go Green Duel Fuel        Initiative" Committee. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

NEW BUSINESS:

 

Ordinance 131-07: Introduced by Phillips:  An Ordinance Authorizing and directing the Director of Public Safety and Service of the City of Alliance to enter into a contract with the Stark County Regional Planning Commission to provide housing rehabilitation technical assistance services to the City of Alliance; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

 

Ordinance 132-07: Introduced by Ryan:  An Ordinance vacating a portion of the North South alley West of Parkway Boulevard between Hartshorn Street and Roseland Road in the City of Alliance, County of Stark and State of Ohio. Motion and second to refer to the Alliance City Planning Commission: Roll Call: Unanimous for referral: REFERRED TO PLANNING COMMISSION.

 

Ordinance 133-07: Introduced by Price:  An Ordinance accepting and approving the replat of Lots 8767 and 7361 and a vacated portion of a 15 foot alley on Hartshorn Street in the City of Alliance, County of Stark, and State of Ohio. Motion and second to refer to the Alliance City Planning Commission: Roll Call: Unanimous for referral: REFERRED TO PLANNING COMMISSION.

 

 

Ordinance 134-07: Introduced by Rhome:  An Ordinance authorizing modifying the compensation for the elected offices of Mayor, Law Director, Auditor, Treasurer, Clerk of the Alliance Municipal Court, President of Alliance City Council, and all Council Representatives; and declaring an emergency. Motion and second to refer a committee of Council as a whole: Roll Call: Unanimous for referral: REFERRED TO COUNCIL AS A COMMITTEE OF THE WHOLE.

 

OLD BUSINESS:

 

Ordinance 53-07: Introduced by Price: An Ordinance accepting and approving the replat of lots 10157 and 10164 North of West State Street and South of Hartshorn Street in the City of Alliance, County of Stark and State of Ohio. Motion and second to adopt: Roll Call: Unanimous: DEFEATED.

 

Ordinance 117-07: Introduced by Okey, Price and Ryan:  An Ordinance to authorize and direct the Director of Public Safety and Service to install a traffic control signal at the intersection of U. S. 62 and Brayton Avenue, consistent with the provisions of the Ohio Department of Transportation manual and specifications for a uniform system of traffic control devices; and declaring an emergency. Motion and second to return to council floor without committee action: Roll Call: Unanimous for return to council floor. Motion and second to amend to request no expenditures on the project until appropriate appropriations are allotted and budgeted : Roll Call: Unanimous for amendment. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

 

            ADJOURNMENT: Noting no further business to come before this Council, President Benincasa adjourned the meeting at 8:01 P.M..
