MINUTES OF THE MARCH 19, 2007

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

The meeting was called to order by President Benincasa at 7:00 P.M. Councilperson Thompson gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.

MINUTES: Motion and second to approve the minutes of the March 5, 2006 regular meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Law Director Andrew Zumbar: Explained Ordinance 36-07and the Ballot language for Issue 14 (the City Income Tax Issue).

Auditor Alexander Zumbar: No Formal Report.

STANDING COMMITTEE REPORTS:

Safety & Judiciary: Andreani: Reported on the March 19, 2007 committee meeting that recommended passage of Resolution 23-07 with amendments and Ordinance 32-07 with amendments

Motion and Second to waive hearing on the liquor license transfer involving the Crystal Lounge. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Motion and Second to waive hearing on the liquor license transfer involving the Cesar’s Cantina. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Finance: Okey: Reported that the committee met on March 1,, 2007 and again on March 15, 2007 and reviewed the 2007 budget in Ordinance 19-07. Reported the Committee recommendation to council is to pass Ordinance 19-07 as amended.

Motion and second to approve the minutes of the March 1, 2007 Finance Committee Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Community Development: Phillips: No Formal Report.

Planning, Zoning, & Housing: Price: Reported the Committee recommends passage of Ordinance 35-07 to clarify 130-05 and the committee will meet on April 2, 2007 @ 5:30 P.M. to consider Ordinance 103-06.

Utilities: Rhome: No Formal Report.

Streets & Alley: Ryan: No Formal Report.

Properties and Lands: Thompson: No Formal Report.

THIRD READINGS:

Ordinance 11-07: Introduced by Price: An Ordinance vacating Ann Street Between North Webb Avenue and a 15 foot North South Alley West of West North Webb Avenue, and that 15 foot North South Alley from the South line of Lot 2554 to the Corporate line in the City of Alliance, County of Stark and State of Ohio; and declaring an emergency. Request that any action be postponed until after the Public Hearing set for 7:30 P.M.

Ordinance 12-07: Introduced by Price: An Ordinance vacating part of a 20 foot Alley South of Keystone Street Between Walnut Avenue and North Park Avenue in the City of Alliance, County of Stark and State of Ohio. Request that any action be postponed until after the Public Hearing set for 7:45 P.M.

Ordinance 13-07: Introduced by Price: An Ordinance accepting and approving the replat of Lot 86, part of Lot 87, and part of a vacated 20 foot alley at the Southwest corner of Keystone Street and Walnut Avenue in the City of Alliance, County of Stark and State of Ohio. Request that any action be postponed until after the Public Hearing set for 7:30 P.M.

Ordinance 14-07: Introduced by Okey: An Ordinance ratifying a contract between the City of Alliance and the Federation of United Employees; and declaring an emergency. NO FORMAL ACTION.

PUBLIC HEARING: At 7:30 P.M. Council proceeded with its scheduled public hearing on Ordinance 11-07. President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Upon observing no response President Benincasa made three (3) calls for all those wishing to speak in opposition to the Ordinance. Upon observing no response President Benincasa declared the public hearing closed at 7:34 P.M.

Ordinance 19-07: Introduced by Okey: An Ordinance making appropriations for 2007 for the General Fund, Water Fund, Sewer Fund, and other City Fund, and authorizing the Auditor to draw his warrants for payment of any appropriations upon receiving proper certificates and vouchers; and declaring an emergency. Motion and second to amend to include new schedules: Roll Call: Unanimous: Amended. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

Resolution 23-07: Introduced by Andreani: A Resolution adopting policy and procedures for the use of motor vehicles by City of Alliance Employees. Motion and second to amend to include language changes: Roll Call: Unanimous: Amended. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

Ordinance 27-07: Introduced by Price: An Ordinance accepting and approving the replat of Lots 2544 through 2558, the vacated portion of a 15 foot alley, and the vacated portion of Ann Street on North Webb Avenue in the City of Alliance, County of Stark and State of Ohio. . Ordinance 33-07: Introduced by Okey: An Ordinance authorizing and directing the Director of Public Safety and Service to enter into a renewal agreement for various types of comprehensive Municipal liability coverage if rates are favorable or to advertise for bids for up to a three year period and to enter into a contract with the lowest and best bidder; and declaring an emergency. Ordinance 36-07: Introduced by Rhome: An Ordinance authorizing and permitting the placement of survey monuments within the right of way of west Main Street between Freshley Avenue and Sawburg Avenue as set forth on attached Exhibit “A”. PUBLIC HEARING: At 7:45 P.M. Council proceeded with its scheduled public hearing on Ordinance 12-07. President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Upon observing no response President Benincasa made three (3) calls for all those wishing to speak in opposition to the Ordinance. Upon observing no response President Benincasa declared the public hearing closed at 7:47 P.M. (Noted that the Ordinance is awaiting Planning Commission action.)

Ordinance 37-07: Introduced by Okey: An Ordinance authorizing and directing the Director of Public Safety and Service to purchase two thermal imaging cameras for use by the Alliance Fire Department, and to seek competitive price quotes for such cameras and enter into a purchase agreement for the lowest and best quote, but in no event for such expenditure to exceed $25,000.00; and declaring an emergency.
