MINUTES OF THE MARCH 5, 2007

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

 

The meeting was called to order by President Benincasa at 7:00 P.M. Councilperson Ryan gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.

MINUTES: Motion and second to approve the minutes of the February 20, 2006 regular meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

COUNCIL RULES: Motion to amend Rule 6.10 of the Rules of Alliance City Council. Motion and second to refer to committee of Council as a whole. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

1. Letter from Ohio EPA Dated February 14, 2007 RE: Pretreatment Program Modification - Local Industrial Discharge Limitations.

2. Legislative Bulletin from Ohio Municipal League Dated February 16, 2007 with announcement of Legislative luncheon on March 20, 2007

Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADMINISTRATIVE REPORTS:

Mayor Middleton: Explained Ordinance 26-07 and the $300,000 UDAG Loan to Globalpak. Discussed the annexation of area of West Main Street and Beeson Street and talks with Lexington Township to enter a possible CETA for the area.

Safety Service Director Blaser: Reported that the Fire Department received a $600 gift from Quota Club and $600 Walmart card from Women’s Division of the Chamber of Commerce which will be used in total to purchase supplies.

Assistant Law Director Robert Hunter Jr.: No Formal Report.

Auditor Alexander Zumbar: No Formal Report.

STANDING COMMITTEE REPORTS:

Safety & Judiciary: Andreani: Reported that the committee needs to schedule a meeting to review Ordinance 26-07 and 32-07

Finance: Okey: Reported that the committee met on February 22, 2007 with the Fire Department and discussed ideas and options of generating revenue through the department operation and they will meet again following the budget process.

The Committee met on March 1, 2007 and reviewed the 2007 budget and will meet again on March 14, 2007 and report recommendation back to council.

Community Development: Phillips: Recommend passage of Ordinance 26-07.

Planning, Zoning, & Housing: Price: Reported on the meeting earlier on March 5, 2007 with the Comprehensive Land Use Steering Committee and concluded review of Ordinance 130-05. The Committee recommends passage of Ordinance 130-07 with minor changes and 125-07.

Utilities: Rhome: Reported that the committee met earlier today and all operations are in order.

Streets & Alley: Ryan: No Formal Report.

Properties and Lands: Thompson: No Formal Report.

SPECIAL COMMITTEE REPORTS: Larry Pyers of the UDAG revolving loan fund reported on the application of Globalpak contained in Ordinance 26-07 and the Committee recommendation for passage.

SECOND READINGS:

Ordinance 11-07: Introduced by Price: An Ordinance vacating Ann Street Between North Webb Avenue and a 15 foot North South Alley West of West North Webb Avenue, and that 15 foot North South Alley from the South line of Lot 2554 to the Corporate line in the City of Alliance, County of Stark and State of Ohio; and declaring an emergency. Motion and Second to set a Public Hearing for March 19, 2007 @ 7:30 P.M. and again April 16, 2007 @ 7:30 P.M. if necessary. Roll Call: Unanimous public hearing set for March 19, 2007 @ 7:30 P.M. and again April 16, 2007 @ 7:30 P.M. if necessary.

Ordinance 12-07: Introduced by Price: An Ordinance vacating part of a 20 foot Alley South of Keystone Street Between Walnut Avenue and North Park Avenue in the City of Alliance, County of Stark and State of Ohio. Ordinance 13-07: Introduced by Price: An Ordinance accepting and approving the replat of Lot 86, part of Lot 87, and part of a vacated 20 foot alley at the Southwest corner of Keystone Street and Walnut Avenue in the City of Alliance, County of Stark and State of Ohio. NO FORMAL ACTION.

Ordinance 14-07: Introduced by Okey: An Ordinance ratifying a contract between the City of Alliance and the Federation of United Employees; and declaring an emergency. NO FORMAL ACTION.

Ordinance 19-07: Introduced by Okey: An Ordinance making appropriations for 2007 for the General Fund, Water Fund, Sewer Fund, and other City Fund, and authorizing the Auditor to draw his warrants for payment of any appropriations upon receiving proper certificates and vouchers; and declaring an emergency. Resolution 23-07: Introduced by Andreani: A Resolution adopting policy and procedures for the use of motor vehicles by City of Alliance Employees. NO FORMAL ACTION.

Ordinance 26-07: Introduced by Phillips: An Ordinance authorizing the execution of a loan agreement with respect to the proceeds derived from Urban Development Action Grants (UDAG) in the amount of $300,000.00 to RFIPM Holdings LLC (DBA Globalpak); and declaring an emergency. Ordinance 130-05: introduced by Schwarz: an ordinance to adopt a new City of Alliance Planning and Zoning Code and sub-Division/ Development Regulations to completely replace the existing Planning and Zoning Code, Map and Sub-Division Regulations in the Codified Ordinances of the City of Alliance, Counties of Stark and Mahoning and State of Ohio. Ordinance 125-05: introduced by Schwarz: an Ordinance creating new Chapter 117-Fees of the Codified Ordinances of the City of Alliance and amending sections of the codified Ordinances for the purpose of giving the Director of Public Safety and Service the authority to review, update and establish permit, plan review, and inspection fees for Engineering, Planning and Zoning and to make them compatible to other local communities with the approval of Council, approving new fees; and declaring an emergency.
