MINUTES OF THE JUNE 18, 2007

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

The  meeting was called to order by President Benincasa at 7:00 P.M..  Councilperson Ryan gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.

 

MINUTES: Motion and second to approve the minutes of the June 4, 2006 regular meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

COMMUNICATIONS:

 

1.         Notice of Public Hearing on Ordinance 142-06 dated June 12, 2007.

2.         Notice of Public Meeting of the Planning, Zoning and Housing Committee dated June 15,     2007.

3.         Ohio Municipal League Legislative Bulletin No. 12 dated June 1, 2007.

4.         Minutes of the June 4, 2007 Water and Sewer Advisory Board meeting.

5.         Letter from Law Director Zumbar RE: Thunder Hill - Quality Annexation hearing on August 7, 2007 at 7:00 P.M. at the Lexington Township Hall dated June 4, 2007.

6.         Memo from Auditor Zumbar RE: Certification of the Election Results on the increase of the  Alliance Municipal Income dated June 11, 2007.

7.         Memo from Keep Alliance Beautiful RE: 2007 Litter Index.

8.         Memorandum from Auditor Zumbar RE: Operational Budget by Department as of May 31, 2007.

 

Motion and second to receive and file all communications tendered to the Clerk.  MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

ADMINISTRATIVE REPORTS:

 

Mayor Middleton: No Formal Report.

 

Safety Service Director Blaser:  Reviewed Ordinances 142-06; and 143-06 and the action taken by the Planning Commission on them and further explained how 74-07 is related.

 

 Reviewed Ordinance 77-07.

 

Law Director Andrew Zumbar:  Addressed presentation and legal review of Ordinance 78-07 and  reviewed and explained Ordinance 76-07

 

Auditor Alexander Zumbar:  Reviewed the Operational Budget by Department as of May 31, 2007

 

STANDING COMMITTEE REPORTS:

 

Safety & Judiciary: Andreani:  Announced the Committee will meet on June 29, 2007 @ 8:30 A.M. in the Administration building conference room for the third quarter review of the first responder program.

 

Asking for no action on Ordinance 75-07.

 

Asking for action on Ordinance 77-07

 

Asking for Ordinance 63-07 to be brought back to the floor for action depending on finance committee report.

 

Finance: Okey: Reported on the June 15, 2007 Meeting and reported that the Parks Board is seeking approval of council to place a parks and recreation levy on the November ballot.

 

Reported on the committee review of Ordinance 63-07 and requesting council defer action until it can be discussed with labor counsel.

 

Motion and second to hold a special council meeting on June 25, 2007 @ 7:00 P.M. to review Ordinance 63-07 with Labor Attorney Robert Tscholl.

 

Discussed the appropriations for skate park.

 

PUBLIC HEARING: At 7:30 P.M. Council proceeded with its scheduled public hearing on Ordinances 142-06.  Clerk Yost read the Notice of the Public hearing and its publication.  President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance.  Upon observing no response President Benincasa made three (3) calls for all those wishing to speak in opposition to the Ordinance. Upon observing no response President Benincasa declared the public hearing closed at 7:35 P.M.

Planning, Zoning, & Housing: Price: Committee will meet on July 2, 2007 @ 5:30 P.M. in the Administration Building Conference Room to review Ordinances 103-06; 53-07; 54-07; and 55-07.

 

Discussion on Ordinance 142-06 and not asking for Committee referral.

            Resolution 67-07: Introduced by Council as a Whole: A Resolution providing for the annual tax budget for 2008. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

 

 

SECOND READINGS:

                       

Ordinance 73-07: Introduced by Ryan: An Ordinance Authorizing and Directing the Safety Service Director and the Law Director to execute a funding agreement with the Alliance Neighborhood Center and the City of Alliance Community Development Block Grant fund for fiscal year 2006 consolidated plan in an amount not to exceed $25,000; and declaring an emergency. NO FORMAL ACTION.

Ordinance 74-07: Introduced by Rhome: An Ordinance repealing Ordinance 76-00 to vacate the East-West alley between Penn Avenue and Miller Avenue and the North-South alley between West State Street and Chestnut Street; and declaring an emergency. Ordinance 75-07: Introduced by Andreani: An Ordinance authorizing and directing the Mayor and Safety Service Director to enter into an Alliance Community reinvestment area agreement with James G. Ordinance 142-06: Introduced by Price: An Ordinance vacating a 15 foot North South alley West of Penn Avenue, South of West State Street for a distance of 120 feet, and a 15 foot East West Alley South of West State Street, West of Penn Avenue for a distance of 120 feet in the City of Alliance, County of Stark and State of Ohio. Ordinance 143-06: Introduced by Price: An Ordinance accepting and approving the replat of lots 31 and 32 and parts of two vacated 15 foot alleys South of West State Street and West of Penn Avenue in the City of Alliance, County of Stark and State of Ohio.
