MINUTES OF THE JUNE 4, 2007
REGULAR MEETING OF THE ALLIANCE CITY COUNCIL
The meeting was called to order by President Benincasa at 7:00 P.M.. Councilperson Rhome gave the invocation and led the meeting in the Pledge of Allegiance.
ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.
MINUTES: Motion and second to approve the minutes of the May 7, 2006 regular meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
Motion and second to amend the minutes of the May 21, 2006 regular meeting to reflect passage of Ordinance 04-07 under old business. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
Motion and second to approve the minutes of the May 21, 2006 regular meeting as amended. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
COMMUNICATIONS:
1. Notice of Public Hearing on Resolution 67-07 and Ordinance 52-07 dated May 21, 2007.
2. Notice of Public Meeting on the Planning, Zoning and Housing Committee dated May 22, 2007.
3. Ohio Municipal League Legislative Bulletin No. 11 dated May 25, 2007.
4. Agenda for the June 20, 2007 Planning commission meeting dated May 30, 2007.
5. Letter and attachments from Law Director Zumbar RE: Thunder Hill - Quality Annexation dated May 30, 2007.

7. Memo from Auditor Zumbar RE: May 2007 Alliance Municipal Income Tax Recapitulation dated June 1, 2007.
8. Memorandum from Law Director Zumbar RE: Ethics violation and CBDG funding for the Alliance Neighborhood Center dated June 1, 2007.
9. Memo from Mayor Middleton reflecting receipts collected through the mayor’s office for the month of May 2007.
Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
ADMINISTRATIVE REPORTS:
Mayor Middleton: explained the maps provided for the two pending annexations and reported that there will be a commissioners hearing on the first on July 17, 2007 in council chambers and on August 7, 2007 in Lexington township on the second.
Safety Service Director Blaser: Reviewed Ordinances 71-07; and 72-07. Explained the planned purchase of two new canine police vehicles with federal seizure funding and possible need to front that money from master capital improvement until federal funding arrives.
Law Director Andrew Zumbar: Explained Ordinance 73-07 and ethics violation giving rise to need for the ordinance.
Disclosure of conflict of interest by both Okey and Price. Motion and second to excuse Okey and Price from voting on 73-07. MOTION PASSED BY ACCLAMATION OF ALL REMAINING MEMBERS.
Auditor Alexander Zumbar: Reported on the May 2007 Municipal Income tax Recapitulation. Asking for no action on Resolution 67-07 and reported that letters were sent to business reporting the changes affected by new income tax and passage of 04-07.
STANDING COMMITTEE REPORTS:
Safety & Judiciary: Andreani: No formal report. Committee will meet with Fire Department to review third quarter status of the First Responder program.
Asking for action on Ordinance 72-07.
Finance: Okey: Reported that the committee will need to meet to review Ordinance 63-07.
Community Development: Phillips: No formal report
Planning, Zoning, & Housing: Price: Reported on the June 4, 2007 Committee meeting to review Ordinances 52-07; 53-07; 54-07; and 55-07. Committee recommends the passage of 52-07. The Committee tabled 53-07; 54-07; and 55-07 following the same course of action as the planning commission. Explained the dispute involved with ordinances 53-07 and 54-07 and the hope of finding a resolution.
Committee will meet again to review ordinance103-06 and also again address ordinances 53-07 and 54-07.
PUBLIC HEARING: At 7:30 P.M. Council proceeded with its scheduled public hearing on Resolution 67-07. Clerk Yost read the Notice of the Public hearing and its publication. President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Upon observing no response President Benincasa made three (3) calls for all those wishing to speak in opposition to the Ordinance. Upon observing no response President Benincasa declared the public hearing closed at 7:32 P.M.
Motion and second to hold a public hearing on Ordinance 142-06 on June 18, 2007 @ 7:30 P.M. in Council chambers. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
Utilities: Rhome: Reviewed the Water and Sewer advisory board meeting this morning and asking for action on Ordinance 71-07.
Streets & Alley: Ryan: No Formal Report.
Properties and Lands: Thompson: No Formal Report.

SECOND READINGS
Ordinance 63-07: Introduced by Andreani: An Ordinance ratifying a contract between the City of Alliance and the Federation of United Employees; and declaring an emergency. NO FORMAL ACTION.
Resolution 67-07: Introduced by Council as a Whole: A Resolution providing for the annual tax budget for 2008. NO FORMAL ACTION.
Resolution 70-07: Introduced by Okey: A Resolution to hold a regular meeting of Alliance City Council on the third Monday of May each year at Alliance High School. Motion and second to bring to the floor with the intention of defeating it: Roll Call: Unanimous: DEFEATED.
NEW BUSINESS:
Ordinance 71-07: Introduced by Rhome: An Ordinance Authorizing and Directing the Director of Public Safety and Service to advertise for bids and enter into a contract for the purchase of a new High Service Drive Unit for the Water Treatment Plant in an amount not to exceed $55,000.00; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED
Ordinance 72-07: Introduced by Andreani: An Ordinance amending a lease agreement with the Ohio Department of Public Safety Bureau of Motor Vehicles for the use of 537 East Main Street; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED
Ordinance 73-07: Introduced by Ryan: An Ordinance Authorizing and Directing the Safety Service Director and the Law Director to execute a funding agreement with the Alliance Neighborhood Center and the City of Alliance Community Development Block Grant fund for fiscal year 2006 consolidated plan in an amount not to exceed $25,000; and declaring an emergency. NO FORMAL ACTION.

MISCELLANEOUS BUSINESS: Motion and Second to hold a regular meeting of Alliance City Council on the First Monday of May each year at Alliance High School at a time to be determined. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
