MINUTES OF THE JULY 16, 2007
REGULAR MEETING OF THE ALLIANCE CITY COUNCIL
The meeting was called to order by President Benincasa at 7:00 P.M.. Councilperson Okey gave the invocation and led the meeting in the Pledge of Allegiance.
ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.
Motion and Second to Excuse Councilman Warren price from voting on action regarding the approval of minutes from the July 6, 2007 Special Council Meeting and July 11, 2007 Special Council Meeting due to his absence at both of those meetingl. MOTION PASSED BY ACCLAMATION OF ALL REMAINING MEMBERS.

ADMINISTRATIVE REPORTS:
Mayor Middleton: No formal report.
Safety Service Director Blaser: Reported that the City Engineer has completed the street list for summer paving but further review is necessary
Reviewed Ordinance 86-07.
Law Director Andrew Zumbar: Reviewed and discussed the annexation hearing set for July 17, 2007 @ 6:30 in council chambers and relayed that Lexington Township had refused discussions on a CETA related to the matter.
Reviewed Ordinance 88-07 and requested no action related to it.
Auditor Alexander Zumbar: No formal report.
STANDING COMMITTEE REPORTS:
Safety & Judiciary: Andreani: No Formal Report. Requested action on Ordinance 85-07 and 86-07.
Finance: Okey: Reported committee will cancel the July 17, 2007 meeting to consider Ordinance 84-07 due to rejection by Lexington Township.
Community Development: Phillips: No Formal Report.
Planning, Zoning, & Housing: Price: Reported that the July 16, 2007 meeting had to be cancelled due to a work conflict.
Utilities: Rhome: No Formal Report.
Streets & Alley: Ryan: No Formal Report.
Properties and Lands: Thompson: No Formal Report.

NEW BUSINESS:
Ordinance 86-07: Introduced by Andreani: An Ordinance making appropriations and transfers of funds in the 2007 appropriations to provide for necessary expenses and adjustments; and declaring an emergency. Motion and Second to amend to include the amount of $35,000.00 in the blank in Exhibit “A” Roll Call: Unanimous for amendment. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt as amended: Roll Call: Unanimous: ADOPTED AS AMENDED.
Ordinance 87-07: Introduced by Andreani: An Ordinance amending the rules of City Council to add a rule to require an estimate of the cost of ordinances introduced by any member of Council in the City of Alliance, Stark and Mahoning Counties and State of Ohio.
Resolution 88-07: Introduced by Rhome, Thompson, Ryan and Andreani: A Resolution Certifying to the Board of Elections the issue of a 2.75 Mill additional tax levy for park and recreation purposes pursuant to Ohio Revised Code Section 5705.19(H) for a period of five years to be voted upon by the electors of the City of Alliance; and declaring an emergency.
Council went into recess at 7:21 P.M.
Council returned to regular session at 7:30 P.M.
At 7:30 P.M. Council proceeded with its scheduled public hearing on Ordinances 38-07-S. Clerk Yost read the Notice of the Public hearing and its publication. President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Mona Henderson of 739 North Sawburg Avenue spoke in favor of the Ordinance Upon observing no further response President Benincasa made three (3) calls for all those wishing to speak in opposition to the Ordinance. Upon observing no response President Benincasa declared the public hearing closed at 7:33 P.M.
Motion and second to adopt Ordinance 38-07-S: Roll Call: Unanimous: ORDINANCE 38-07-S ADOPTED
Council went into recess at 7:35 P.M.
Council returned to regular session at 7:45 P.M.
At 7:45 P.M. Council proceeded with its scheduled public hearing on Ordinances 85-07. Clerk Yost read the Notice of the Public hearing and its publication. President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Upon observing no response President Benincasa made three (3) calls for all those wishing to speak in opposition to the Ordinance. Upon observing no response President Benincasa declared the public hearing closed at 7:46 P.M.
ADJOURNMENT: Noting no further business to come before this Council, President Benincasa adjourned the meeting at 7:46 P.M..
