MINUTES OF THE DECEMBER 3, 2007
REGULAR MEETING OF THE ALLIANCE CITY COUNCIL
The meeting was called to order by President Benincasa at 7:00 P.M. President Benincasa gave the invocation and led the meeting in the Pledge of Allegiance.
ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.
Motion and second to approval the minutes of the November 19, 2007 regular Council Meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
COMMUNICATIONS:
1. Ohio Ethics Commission Request for updated list of City Elected Officials.
2. Letter from Mayor Middleton RE: Board of Zoning Appeals Appointments.
3. Minutes of the November 21, 2007 Alliance City Planning Commission Meeting.
4. Briefing Schedule for the Thunder Hill Annexation Appeal.
5. Memorandum from Auditor Zumbar RE: November 2007 Income Tax Recapitulation.
6. Letter and attachments from Councilman Price RE: Ordinance 134-07 and three new proposed ordinances.
7. Letter from President Benincasa RE: Elected official pay increases

9. Letter from Mayor Middleton RE: Receipts collected in Mayor’s Office in November 2007.
Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
ADMINISTRATIVE REPORTS:
Mayor Middleton:. Discussed appointments to the Board of Zoning Appeals as outlined in letter.
Safety Service Director Blaser: Reviewed the status of the City leaf collection. First pass is complete and second pass has begun.
Review Ordinance 135-07; 136-07; and 137-07.
Discussed the Drive thru at Arch and Oxford and number of Liquor permits by ward.
Law Director Andrew Zumbar: Reviewed the status Seymour lawsuit – Summary Judgment Motion has been filed and a briefing schedule set.
Reviewed the re-issuing of the Hospital Bonds. Reported that the Hospital uses the City Bond rating but that the bonds do not count against the City in the City’s Debt ratio.
Auditor Alexander Zumbar: Reviewed the November 2007 Income Tax Recapitulation.
STANDING COMMITTEE REPORTS:
Safety & Judiciary: Andreani: Set a meeting for December 14, 2007 @ 9:00 AM following the Finance committee meeting to discuss the city liquor permits and any possible renewal objections.
Motion and second to accept the appointments to the Board of Zoning Appeals as set forth by the Mayor. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
Finance: Okey: Set a meeting for December 14, 2007 @ 8:30 AM to discuss budget restrictions placed on the Clerk of Court before resignation of Kevin Ward and review the Clerk of Court Budget situation.
Community Development: Phillips: No formal report.
Thanked Director Blaser for research of Liquor establishments by ward.
Planning, Zoning, & Housing: Price: No formal report
Utilities: Rhome:. Reported on the Morning Water and Sewer Advisory Board meeting and that all appears to be in order.
Streets & Alley: Ryan: No formal report.
Question Planning Commission action on Ordinance 132-07 (Reported tabled at last meeting).
Properties and Lands: Thompson: No formal report.
Public Speaks: Mary Hada of NRP discussed Resolution 136-07 and the housing unit plans.

Ordinance 132-07: Introduced by Ryan: An Ordinance vacating a portion of the North South alley West of Parkway Boulevard between Hartshorn Street and Roseland Road in the City of Alliance, County of Stark and State of Ohio. NO FORMAL ACTION.
Ordinance 133-07: Introduced by Price: An Ordinance accepting and approving the replat of Lots 8767 and 7361 and a vacated portion of a 15 foot alley on Hartshorn Street in the City of Alliance, County of Stark, and State of Ohio. NO FORMAL ACTION.
Ordinance 134-07: Introduced by Rhome: An Ordinance authorizing modifying the compensation for the elected offices of Mayor, Law Director, Auditor, Treasurer, Clerk of the Alliance Municipal Court, President of Alliance City Council, and all Council Representatives; and declaring an emergency. NO FORMAL ACTION.
NEW BUSINESS:
Ordinance 135-07: Introduced by Andreani: An Ordinance authorizing and directing the Director of Public Safety and Service to apply for and receive a Law Enforcement Continuing Professional Educational Training Grand and authorizing the Auditor of the City of Alliance Ohio to Establish the Law Enforcement Continuing Professional Education fund, and to establish revenue and expenditure codes; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.
Resolution 136-07: Introduced by Phillips: A Resolution extending support fron the City of Alliance to the Proposed Alliance Elderly. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.
Ordinance 137-07: Introduced by Andreani: An Ordinance making appropriations and transfers of funds in the 2007 appropriations to provide for necessary expenses and adjustments; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.
Ordinance 138-07: Introduced by Price: An Ordinance creating and funding a downtown special events commission; and declaring an emergency. NO FORMAL ACTION.
Ordinance 139-07: Introduced by Price: An Ordinance allocating an additional ten thousand dollars ($10,000) per year to the Alliance Area Development Foundation for the purpose of Maintaining and attracting living wage jobs to the City of Alliance; and declaring an emergency. NO FORMAL ACTION.
