MINUTES OF THE APRIL 16, 2007

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

The meeting was called to order by President Benincasa at 7:00 P.M. Councilperson Okey gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.

MINUTES: Motion and second to approve the minutes of the April 2, 2006 regular meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

COMMUNICATIONS:

1. Minutes of the February 20, 2007 Board of Zoning Appeals Meeting.

2. Minutes of the April 2, 2007 Water and Sewer Advisory Board Meeting.

3. Agenda for the April 17, 2007 Board of Zoning Appeals Meeting.

4. Notice of Public Hearing on Ordinance 40-07 Dated April 12, 2007

5. Agenda for the April 18, 2007 Planning Commission Meeting.

6. Memorandum from Auditor Alexander Zumbar RE: Operational Budget by department as of March 31, 2007.

7. Letter from Walter and Haverfield Attorneys at Law RE: Statewide Cable Video franchise bill.

8. Letter from County Arts Council RE: Stark Arts festival.

 

Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADMINISTRATIVE REPORTS:

Mayor Middleton: Absent.

Safety Service Director Blaser: Reviewed Ordinances and Resolutions 44-07; 45-07; 46-07; 47-07; 48-07; 49-07; 50-07 and 51-07.

Questions by Councilmen Okey and Price RE: Ordinance 45-07 addressed by Director Blaser and Wastewater Treatment Plant Superintendent Amabeli.

Law Director Andrew Zumbar: Explained Ordinance 50-07 and sponsors for Resolution 51-07 under new Council Rules.

Auditor Alexander Zumbar: Reported on the Operational Budget by department as of March 31, 2007.

STANDING COMMITTEE REPORTS:

Safety & Judiciary: Andreani: Reported committee will meet first week of May with Fire Department to review issues including reviewing the progress and status of the First Responder Program.

Asking for action on Ordinances 49-07 and 50-07.

Finance: Okey: Reported that the committee will meet May 10, 2007 @ 8:30 a.m. to review Ordinance 14-07.

Community Development: Phillips: Asking for no formal action of Ordinance 46-07 at this time.

Planning, Zoning, & Housing: Price: Reported the Committee will meet to continue work on pending Ordinances.

Asked for passage of Ordinance 50-07.

Utilities: Rhome: Asking for action on Ordinances 44-07; 45-07; 47-07 and 48-07.

Streets & Alley: Ryan: No Formal Report. Welcomed the Boy Scout Troop members in attendance in audience.

Properties and Lands: Thompson: No Formal Report.

SPECIAL COMMITTEE REPORTS: None

PUBLIC HEARING: At 7:30 P.M. Council proceeded with its scheduled public hearing on Ordinance 40-07. Clerk Yost read the Notice of the Public hearing and its publication. President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Upon observing no response President Benincasa made three (3) calls for all those wishing to speak in opposition to the Ordinance. Upon observing no response President Benincasa declared the public hearing closed at 7:31 P.M.

 

PUBLIC SPEAKS:

Robb Hankins of 3968 Ashford NW in Jackson Township spoke regarding the Shark County Arts Council and the Arts in Stark Festival.

Garrie McDaniels of 405 2nd Street NW Canton spoke regarding the Neighbors helping Neighbors re-entry program and utilizing the old Hope House for the program

THIRD READINGS:

Ordinance 38-07: Introduced by Okey and Price: An Ordinance to promote the Downtown Business area of Alliance; and to amend Section 1134.07(d) of the Codified Ordinances of Alliance, Ohio. NO FORMAL ACTION.

SECOND READINGS

Ordinance 39-07: Introduced by Okey: An Ordinance amending Alliance Codified Ordinance Section 181.13 “Allocation of Funds”; and declaring an emergency. NO FORMAL ACTION.

Ordinance 40-07: Introduced by Ryan: An Ordinance vacating parts of two 20 foot alleys East of North Park Avenue between Keystone Street and Wayne Street in the City of Alliance, County of Stark and State of Ohio. NO FORMAL ACTION.

Ordinance 41-07: Introduced by Okey: An Ordinance repaying James Stout and M. Katherine Stout for overpayments made in the construction of West Main Street and the development of the Industrial Park. NO FORMAL ACTION.

NEW BUSINESS:

Resolution 44-07: Introduced by Rhome: A Resolution recognizing the Arts and Declaring April 13, to April 22, 2007 Stark Arts Festival Week and Urging Citizens to enjoy the Activities scheduled. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

Ordinance 45-07: Introduced by Rhome: An Ordinance authorizing and directing the Director of Public Safety and Service to Request Qualifications and to enter into a professional services contract for preliminary engineering and design services for the raw influent screw lift pumps replacement at the wastewater treatment plant; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

Ordinance 46-07: Introduced by Phillips: An Ordinance accepting the proposed Annual Consolidated Plan for the City of Alliance pursuant to the FY-2007 Community Development Block Grant Program in an amount not to exceed $707,476.00; and declaring an emergency. NO FORMAL ACTION.

Ordinance 47-07: Introduced by Rhome: An Ordinance authorizing and directing the Director of Public Safety and Service to enter into an agreement for Natural Gas in the City of Alliance with Volunteer Energy Serviced Inc.; and declaring an emergency. Ordinance 49-07: Introduced by Andreani: An Ordinance authorizing and directing the Director of Public Safety and Service to enter into a grant agreement for Homeland Security Funds in an amount not to exceed $430,000; and declaring an emergency. Resolution 51-07: Introduced by Price, Rhome, Andreani, Thompson, and Ryan: A Resolution honoring retired Fire Chief James A. Reese for his service to the City of Alliance. Motion and second to delay action and to Amend to include Councilman Okey and Councilperson Phillips as well as the Administration as sponsors and to include signature lines for all council members: Roll Call: Unanimous for amendment: AMENDED.
