MINUTES OF THE APRIL 2, 2007

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

The meeting was called to order by President Benincasa at 7:00 P.M. Councilperson Andreani gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.

MINUTES: Motion and second to approve the minutes of the March 19, 2006 regular meeting. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADMINISTRATIVE REPORTS:

Mayor Middleton: Reported on the Energy Conservation Seminar at Mount Union College and the Mayor’s Office efforts to work with the Green Task force for a Sustainable Community program for Alliance.

Outlined upcoming presentations with President Benincasa supporting Issue 14.

Announced a prayer breakfast at Feed My Sheep Ministries on April 7, 2007 with all City Officials invited and encouraged to attend.

Announced the Children’s Memorial Flag raising at Freedom Square on April 16, 2007 @ 11:30 A.M.

Safety Service Director Blaser: Explained the explosion at the Waste water treatment plant and its damages and progress repairing the damage.

Reviewed Ordinances 39-07; 40-07; 41-07; 42-07; and 43-07.

Announced that the Department heads have requested an executive session to discuss Ordinance 14-07.

Law Director Andrew Zumbar: No Formal Report.

Auditor Alexander Zumbar: Reported on the March 2007 Municipal Income Tax Recapitulation.

Announced that the State Audit is progressing and will soon be progressing out to the department heads.

City received certificate of achievement for excellence for reporting for the 2005 CAPFER Report.

STANDING COMMITTEE REPORTS:

Safety & Judiciary: Andreani: Reported on the March 19, 2007 committee.

Announced the Committee will meet to review the progress and status of the First Responder Program.

Motion and Second to waive hearing on the new liquor license application for Marc‘s of Alliance. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Finance: Okey: Reported that the committee will set a meeting to review Ordinance 14-07.

Community Development: Phillips: No Formal Report.

Planning, Zoning, & Housing: Price: Reported on the Committee meeting on April 2, 2007 @ 5:30 P.M. to consider Ordinance 103-06 and announced the Committee will meet again on April 16, 2007 @ 5:30 P.M. to continue work on Ordinance 103-06.

Announced that the committee is requesting no action on Ordinances 142-06 and 143-06 as there is still ongoing discussion to work out the problems involved.

Announced the committee recommends passage of Ordinances 12-07 and 13-07.

Utilities: Rhome: Reported on the Committee meeting on April 2, 2007. Only issue was the explosion at the Waste Water Treatment Plant.

Streets & Alley: Ryan: No Formal Report. Committee will meet to discuss issues with Summer street paving program.

Properties and Lands: Thompson: No Formal Report.

Ordinance 38-07: Introduced by Okey and Price: An Ordinance to promote the Downtown Business area of Alliance; and to amend Section 1134.07(d) of the Codified Ordinances of Alliance, Ohio.

NEW BUSINESS:

Ordinance 39-07: Introduced by Okey: An Ordinance amending Alliance Codified Ordinance Section 181.13 “Allocation of Funds”; and declaring an emergency. Motion and Second to Refer to Finance Committee: Roll Call: Unanimous for referral: REFERRED TO THE FINANCE COMMITTEE.

Ordinance 40-07: Introduced by Ryan: An Ordinance vacating parts of two 20 foot alleys East of North Park Avenue between Keystone Street and Wayne Street in the City of Alliance, County of Stark and State of Ohio. Motion and Second to set a Public Hearing for April 16, 2007 @ 7:30 P.M. Roll Call: Unanimous public hearing set for April 16, 2007 @ 7:30 P.M. Motion and Second to Refer to the Alliance City Planning Commission: Roll Call: Unanimous for referral: REFERRED TO THE ALLIANCE CITY PLANNING COMMISSION.

Ordinance 41-07: Introduced by Okey: An Ordinance repaying James Stout and M. Katherine Stout for overpayments made in the construction of West Main Street and the development of the Industrial Park. Motion and Second to Refer to Finance Committee: Roll Call: Unanimous for referral: REFERRED TO THE FINANCE COMMITTEE.

Ordinance 42-07: Introduced by Okey: An Ordinance making appropriations and transfers of funds in the 2007 appropriations to provide for necessary expenses and adjustments; and declaring an emergency. Ordinance 43-07: Introduced by Rhome: An Ordinance authorizing and directing the Director of Public Safety and Service to enter into a grant agreement with the Stark-Tuscarawas-Wayne joint solid waste management district; and declaring an emergency. OLD BUSINESS:

Ordinance 12-07: Introduced by Price: An Ordinance vacating part of a 20 foot Alley South of Keystone Street Between Walnut Avenue and North Park Avenue in the City of Alliance, County of Stark and State of Ohio. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

Ordinance 13-07: Introduced by Price: An Ordinance accepting and approving the replat of Lot 86, part of Lot 87, and part of a vacated 20 foot alley at the Southwest corner of Keystone Street and Walnut Avenue in the City of Alliance, County of Stark and State of Ohio. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.

 

 

Motion and second to conduct an executive session to discuss the labor contracts with council, council president, council clerk, mayor, safety service director, law director, auditor, and all department heads from the Alliance Wastewater Treatment, Water Treatment, Water Distribution and Street Department. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Council entered executive session at 7:45 P.M. with council, council president, council clerk, safety service director, law director, auditor, and all department heads from the Alliance Wastewater Treatment, Water Treatment, Water Distribution and Street Department to discuss discuss labor contract issues relevant to Ordinance 14-07.

Council returned from executive session to regular session at 8:00 P.M.

 

MISCELLANEOUS BUSINESS:

Discussion of proposed Amendment of Rule 6.10 of the Rules of Alliance City Council. Discussion conducted by Council Members, Council President, Council Clerk, Law Director, and Director of Public Safety and Service. Motion and second to adopt: Roll Call: Unanimous: ADOPTED.
