MINUTES OF THE SEPTEMBER 5, 2006
REGULAR MEETING OF THE ALLIANCE CITY COUNCIL
The meeting was called to order by President Benincasa at 7:00 p.m. Councilman
Ryan gave the invocation and led the meeting in the Pledge of Allegiance.ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.
MINUTES: Motion and second to approve Minutes of the August 7, 2006 and August 21, 2006 regular meetings of City Council. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
COMMUNICATIONS:
1. Memo from Auditor Alex Zumbar regarding August 2006 Alliance Municipal Income Tax Recapitulation.
2. Notice of Martin Luther King Jr. Viaduct Committee Meeting September 7, 2006 @ 6:30 p.m. at the Alliance Neighborhood Center.
3. Notice of Finance Committee Meeting September 1, 2006 @ 8:45 a.m. at the City Administration Building Second Floor Conference Room.
4. Notice of Claims Board Meeting September 1, 2006 @ 8:30a.m. at the City Administration Building Second Floor Conference Room.
5. Letter from Attorney Robert Tscholl RE: free representation in appeal of conciliator’s award.
6. Ohio Employment Relations Board request for Recognition.
7. Letter from Alliance YMCA announcing the City-wide health challenge.
8. National League of Cities notice of Congress of Cities and Exposition.
9. Center for Families and Children invitation to “Making the Grade: Helping our Kids Achieve.”
10. Memo from Mayor Middleton RE: Receipts collected through Mayor’s office for month of August.
Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
ADMINISTRATIVE REPORTS:
Mayor Middleton: No report
Safety Service Director Blaser:
No report.Law Director Andrew Zumbar: Reported on Ordinance No. 118-06 and the Park Commons annexation. Also reported on the Sherry’s Treasurers appeal and the anticipated settlement agreement which will include penalties for willful violation of the zoning ordinances.
Auditor Alexander Zumbar: No report noted the August 2006 Alliance Municipal Income Tax Recapitulation was included in the Council packets.
STANDING COMMITTEE REPORTS:
Safety & Judiciary: Andreani: No report.
Finance: Okey: Reported the Committee met as the Claims Board and voted to deny the claim for flood damage by Mr. Sandoval. Committee also met and discussed Ordinance 114-06. Committee decided there is a need to meet in executive session with Law Director and Attorney Tscholl to discuss potential litigation on this matter at a later date and requesting other members to give possible dates. Was advised by President Benincasa that it may be more efficient to hold that meeting with Council as a Committee as a whole.
Community Development: Phillips: Reported the Martin Luther King Viaduct advisory committee will meet on September 7, 2006 at 6:30 p.m.
Planning, Zoning, & Housing: Price: No report, committee needs to set a meeting and requesting other members to give possible dates.
Utilities: Rhome: Reported on September 5, 2006 meeting and that everything is in order and working fine.
Streets & Alley: Ryan: No report.
Properties and Lands: Thompson: No report
PUBLIC SPEAKS: William Shetler of 1075 Stratford Place spoke of partisan politics between Council and the Administration and the City’s financial situation.
SPECIAL COMMITTEE REPORTS:
Mr. Bellish spoke of the Natural Gas Aggregate rate being locked in and the procedures and reports.
Larry Pyers of the Alliance UDAG revolving loan committee advised Council of the committee’s recommendation in favor of Ordinance 117-06.
THIRD READINGS: None
SECOND READINGS:
Ordinance 114-06: introduced by Okey: An Ordinance Ratifying a contract with the Alliance Professional Fire Fighters Association IAFF Local #480 (the Union) based on the Conciliation award as modified by the attached August 4, 2006 letter from the Union.
NEW BUSINESS:
Ordinance 117-06: introduced by Council as a Whole: An Ordinance authorizing the execution of a loan agreement with respect to the proceeds derived from urban development action grants (UDAG) in the amount of $12,000.00 to CJL Enterprises Inc. dba C.J.’s Signs & Lighting Company; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED
Ordinance 118-06:
introduced by Thompson: An Ordinance accepting annexation of the park commons annexation area to the City of Alliance on application of owners of Real Estate; and declaring an emergency.OLD BUSINESS: None
