MINUTES OF THE MARCH 20, 2006

   REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

 

The meeting was called to order by President Benincasa at 7:00 p.m.  Councilman Price gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.

 

Election of Clerk: President Benincasa read letters of interest from three candidates- Angela Datz Blanco, Jerry Yost and Alex Zumbar. He noted that Mr. Zumbar has offered to do the job for no pay. President Benincasa passed out blank pieces of paper and asked all Council members to vote for one candidate. Kevin Ward and Mark Locke were asked to count the ballots. Mr. Zumbar was elected Clerk.

 

MINUTES: Motion & second to receive and file the minutes of the March 6, 2006 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

1.        Alliance City Health Department 2005 Annual Report.

2.        Minutes from the February 28, 2006 Streets and Alleys Committee.

3.        Ohio Municipal League Legislative Bulletin #6 dated March 3, 2006.

4.        Letter from John B. Blaser, Director of Public Safety and Service to all General Fund Department Heads and Elected Officials dated March 6, 2006. Re: Finance Committee meeting March 15, 2006.

5.        Letter from Alliance Area Habitat for Humanity to Alliance City Council Members dated March 8, 2006. Re: Thanking Council for waving the three readings of the replatting of the former Freedom School property.

6.        Ohio Municipal League Legislative Bulletin #7 dated March 10, 2006.

7.        Operational Budget Report by Department as of February 28, 2006.

8.        Letter from Mayor Toni Middleton to R. Mark Locke, Clerk dated March 20, 2006. Re: Asking Council to approve the appointment of Memphis Pittman to the Board of Park Commissioner for a three year term ending 12/31/08.

9.        Minutes from the Finance Committee meetings of February 14 and March 15, 2006.                 

 

Motion and second to receive and file all communications tendered to the Clerk.  MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

ADMINISTRATIVE REPORTS:

 

Mayor Middleton: absent-no report

 

Safety Service Director Blaser: reviewed Ordinances 45-06, 56-06 and 57-06.

 

Law Director Zumbar: updated Council on the lawsuit over a drowning at the Mahoning River several years ago; reviewed recommended changes to Ordinance 38-06.

 

Auditor Zumbar: reviewed the Operational Budget; reviewed Ordinance 54-06.

 

STANDING COMMITTEE REPORTS:

 

Safety & Judiciary: Andreani: reviewed the Safety and Judiciary Committee meeting where Ordinances 44-06, 51-06 and 58-06 were reviewed.

 

Finance: Okey: reviewed the minutes from the two Finance Committee meetings (included in communications).

 

PUBLIC HEARING: at this time Council proceeded with its 7:30 P.M. scheduled Public Hearing on Ordinance 47-06. President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Upon hearing no responses President Benincasa made three (3) calls for those wishing to speak in opposition to the Ordinance. Upon observing no responses President Benincasa declared the public hearing closed at 7:32 P.M.

 

Motion and second to have a Special Council Meeting to act on the City Budget for March 28, 2006 at 7:00 P.M. in Council Chambers: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

Community Development: Phillips: reviewed Ordinance 38-06.

 

Planning, Zoning, & Housing: Price: reviewed the P, Z & H Committee meeting from earlier this evening. The Committee recommends adoption of Ordinance 92-05.

 

Utilities:  Rhome: no report

 

Streets & Alley: Ryan: no report.

 

Properties and Lands: Thompson: no report

 

PUBLIC SPEAKS: Larry Dordea, Alliance Police Chief, 470 E. Market Street- spoke against the requested 2.5% reduction in proposed department budgets.

 

President Benincasa introduced Tom Bellish from Buckeye Energy Brokers. He explained the Natural Gas Aggregation.

Ordinance 31-06: introduced by Price: an Ordinance accepting and approving the replat of part of outlot 446 located on East State Street in the City of Alliance, County of Stark and State of Ohio. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

 

Ordinance 37-06: introduced by Okey: an Ordinance making appropriations for 2006 for the General Fund, Water Fund, Sewer Fund and other City Funds, and authorizing the Auditor to draw his warrants for payment of any appropriations upon receiving proper certificates and vouchers; and declaring an emergency.

 

Ordinance 38-06S: introduced by Rhome: an Ordinance authorizing amending Chapter 177 of the Alliance Codified Ordinances; and declaring an emergency. Motion and second to amend by by substituting with Ordinance 38-06S: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Motion and second to adopt as amended: Roll Call: Unanimous: ADOPTED

Ordinance 44-06: introduced by Andreani: an Ordinance authorizing and directing the Director of Public Safety and Service to advertise for proposals for a contract with the City for an exclusive provider to provide emergency medical and ambulance transport services within the City of Alliance and to submit those proposals to City Council; and declaring an emergency.

 

Ordinance 45-06: introduced by Ryan: an Ordinance vacating a 10 foot alley and a 15 foot alley north of Prospect Street between North Union Avenue and North Park Avenue in the City of Alliance, County of Stark and State of Ohio, and declaring an emergency. Motion and second to hold a Public Hearing on April 3, 2006 at 7:30 P.M.: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Councilman Okey announced that the May 1, 2006 City Council Meeting will be held at Alliance High School at a time to be announced.
