MINUTES OF THE JUNE 19, 2006

   REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

The meeting was called to order by President Benincasa at 7:00 p.m.  Councilman Andreani gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.

 

MINUTES: Motion & second to receive and file the minutes of the June 5, 2006 regular meeting of Alliance City Council as corrected: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. 

 

COMMUNICATIONS:

 

  1. Notice of Public Hearing for Monday June 19, 2006 @ 7:30 p.m. on Resolution 78-06.
  2. Agenda for the June 20, 2006 Board of Zoning Appeals meeting.
  3. Minutes of  the May 16, 2006 Board of Zoning Appeals meeting.
  4. Operational Budget Report by Department as of May  31, 2006.

ADMINISTRATIVE REPORTS:

 

Mayor Middleton: no report

 

Safety Service Director Blaser: reviewed Ordinances 89-06; 90-06;91-06; and 92-06; urged council to pass Ordinance 86-06.

 

Law Director Andrew Zumbar: reported on two new lawsuits filed against the City. First involves construction easement of Broadway Street West of Union Avenue from the 1950’s.  The Second is an appeal of the Board of Zoning Appeals denial of a four person occupancy variance.

 

Auditor Alexander Zumbar: reviewed the Operational Budget Report by Department and urged passage of  Resolution 78-06 in order to transmit to the Stark County Auditor in a timely manner.

 

STANDING COMMITTEE REPORTS:

 

Safety & Judiciary: Andreani: will set a committee meeting in near future to discuss compulsory education legislation with school personnel and review Ordinance 66-06 with department heads.

 

Finance: Okey: announced Finance committee recommends the adoption of  Resolution 78-06.

 

Community Development: Phillips: no report.

 

Planning, Zoning, & Housing: Price: Planning Commission will consider Ordinance 82-06; 83-06 and 84-06. Also reported that the Comprehensive Land use Ordinance is back from the consultants and will be reviewed by the Planning Director.

 

Utilities:  Rhome: no report.

 

Streets & Alley: Ryan: no report.  Announced citizen concern to be addressed in public speaks regarding traffic problems at Sawburg and Main Street.

 

Properties and Lands: Thompson: no report

 

PUBLIC SPEAKS: Debbie Goshorn of 125 East Cambridge Street , Alliance - spoke regarding the need for a Traffic Light of other traffic regulation at intersection of Sawburg and Main Street; concerns and questions were addressed by Councilman Okey and Director Blaser.

 

Dennis Clunk of 2040 South Union Avenue, Alliance – spoke in opposition to Ordinance 86-06 and 87-06; concerns and questions were addressed by Councilman price.

 

PUBLIC HEARINGS: The Public Hearing  was called by President Benincasa at 7:30 P.M. No one spoke in favor of or in opposition of Resolution 78-06. Public Hearing Closed at 7:31 P.M.

 

THIRD READINGS:

 

Resolution 78-06: introduced by Council as a Whole: a Resolution providing for the annual tax budget for 2007. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

 

SECOND READINGS:

 

Ordinance 81-06: introduced by Ryan: an Ordinance Vacating McKinley Avenue between West State Street and Hartshorn Street and parts of four 15 foot alleys North of West State Street, South of Hartshorn Street, West of Clark Avenue, and East of South Rockhill Avenue in the City of Alliance, County of Stark, and State of Ohio. Motion and second to set a Public Hearing for July 3, 2006 at 7:30 P.M. in Council Chambers. Roll Call: Unanimous PUBLIC HEARING SET JULY 3, 2006 @ 7:30 P.M. IN COUNCIL CHAMBERS.

 

Ordinance 82-06: introduced by Price: an Ordinance to amend the Zoning Map of the City of Alliance by changing part of the area located between West State Street and Hartshorn Street and Mckinley Avenue and South Rockhill Avenue from Neighborhood Business District (B-1) to College District (C) under the Alliance City Zoning Ordinance.

 

Ordinance 83-06: introduced by Price: an Ordinance accepting and approving the re-plat of McKinley Avenue and Hartshorn Street, Numerous lots, and parts of four 15 foot alleys North of West State Street, South of Hartshorn Street, West of Clark Avenue, and East of South Rockhill Avenue in the City of Alliance, County of Stark, and State of Ohio.

 

Ordinance 84-06: introduced by Price: an Ordinance accepting and approving the re-plat of parts of outlots 242 through 245 on South Union Avenue in the City of Alliance, County of Stark, and State of Ohio.

 

Ordinance 86-06: introduced by Phillips: an Ordinance authorizing and directing the Director of  Public Safety and Service to enter into an agreement with Vincent A. Marion Jr. as described in the employment agreement Exhibit “A”, for the purpose of providing various services described in the agreement as an employee of the City of Alliance; and declaring an emergency. Motion and second to suspend rules: Roll Call: Vote 5 to 2 against rules suspension. MOTION FAILED.

 

NEW BUSINESS:

               

Ordinance 89-06: introduced by Council as a Whole: a Resolution authorizing the Auditor of the City of Alliance, Ohio to establish the E-Cite fund and to establish revenue and expenditure codes; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

 

Ordinance 90-06: introduced by Okey: an Ordinance making appropriations and transfers of funds in the 2006 appropriations to provide for necessary expenses and adjustments; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

 

Ordinance 91-06: introduced by Okey: an Ordinance authorizing and directing expenditures for the Law Enforcement Trust Fund for the acquisition of computer software, printers and necessary computer ancillaries for the purpose of streamlining the citation process between the Alliance Police Department and the Clerk of Courts Office. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

 

Ordinance 92-06: introduced by Phillips and Okey: an Ordinance allocating Five Thousand Dollars ($5,000.00) per year to the Stark County Development Board, Inc. for a period of three years, commencing in 2006, for purposes of underwriting the cost of business development activities in the City of Alliance; and declaring an emergency.
