MINUTES OF THE JULY 17, 2006

   REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

The meeting was called to order by President Benincasa at 7:00 p.m.  Councilman Phillips gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.

 

MINUTES: Motion & second to receive and file the minutes of the July 3, 2006 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.  Motion & second to receive and file the minutes of the July 10, 2006 special meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. 

 

COMMUNICATIONS:

 

  1. Notice of Special Meeting for Alliance City Council for Monday July 10, 2006 @ 7:00 p.m.
  2. Letter from the Ohio EPA dated July 5, 2005. Re: National Pollutant Discharge Elimination System Permit No. 3PD00000*JD for the City of Alliance WWTP.
  3. Letter from William Hawley, Code Enforcement Official/Zoning Inspector RE: No regular meeting of the Board of Zoning Appeals for the Month of July 2006 due to lack of an agenda.
  4. Notice of Public Hearing for Monday August 7, 2006 @ 7:30 p.m. on Resolution 82-06.
  5. Water Department Payment/Collections for June 2006.
  6. Letter from Councilman Andreani to Alliance Board of Education Dated July 5, 2006 RE: Sale of Certain land to the Alliance City Parks Board
  7. Letter from Development Director Vincent Marion RE: Zoning Code, map and sub-division regulations.
  8. Contract with Daniel McGannon for services at the Water Treatment Plant pursuant to Ordinance 94-06.
  9. State of Ohio Employment Relations Board Conciliation Award Between City of Alliance and Alliance Professional Firefighters IAFF Local 480

ADMINISTRATIVE REPORTS:

 

Mayor Middleton: Absent no report

 

Safety Service Director Blaser: reviewed Ordinances 100-06; 101-06; and 102-06; reviewed the contract to attach to Ordinance 94-06.

 

Reviewed the conciliation award between City of Alliance and Alliance Professional Firefighters IAFF Local 480.  Labor Attorney Robert Tscholl reported opinion on issues of wages and options.  Debate and discussion occurred among Councilman Okey, Councilman Phillips, Councilman Ryan, Councilman Andreani and Director Blaser.

 

Law Director Andrew Zumbar: Reported on the annexation hearing with the Stark County Commissioners and Lexington Township; reported on Court Ruling in Dawson Liquor License revocation case and reported that the fact finding decision to revoke was upheld; reviewed Ordinance 104-06; and updated on 911 Task Force report.

 

Auditor Alexander Zumbar: reviewed the Operational Budget Report by Department.

 

STANDING COMMITTEE REPORTS:

 

Safety & Judiciary: Andreani: after review and revision the committee recommends the adoption of  Ordinance 66-06S and Ordinance 104-06.

 

Finance: Okey: announced Finance committee needs to meet to discuss and review the conciliation award between City of Alliance and Alliance Professional Firefighters IAFF Local 480 as well as the repayment status of the $500,000.00 loan.

 

Community Development: Phillips: no report.

 

Planning, Zoning, & Housing: Price: announced committee needs to meet to discuss and review Ordinance 82-06; 83-06 and 84-06 as well as the Comprehensive Land use Ordinance that has been reviewed by the Planning Director.

 

Utilities:  Rhome: no report.

 

Streets & Alley: Ryan: reported on committee meeting that reviewed funding options for the Viaduct revitalization and committee will schedule another meeting.

 

Properties and Lands: Thompson: no report

 

SPECIAL COMMITTEES:  Tom Bellish of Buckeye Energy Brokers discussed and reviewed the Natural Gas Aggregate plan; discussion and questions from Councilman Rhome and Councilman Price.

 

Bill Hahn from America in Bloom reported on possible programs for keep Alliance Beautiful.

THIRD READINGS:

 

Ordinance 93-06: introduced by Thompson: an Ordinance determining that the City of Alliance has items of personal property which are not needed for municipal purposes which exceed $1,000.00 in estimated value, authorizing the sale of such personal property by written contract to the highest and best bidder at public sale by the director of public safety and service and including in said public sale, personal property as designated by the Alliance Board of Park Commissioners and Alliance City Board of Health; and declaring an emergency.

 

Ordinance 96-06: introduced by Price: an Ordinance accepting and approving the replat of lots 12003, 12004, and 12006 located  on Norman Avenue in the City of Alliance County of Mahoning and State of Ohio.

 

Ordinance 97-06: introduced by Price: an Ordinance accepting and approving the replat of part of outlots 12599 thru 12605 located  on Marwood Circle  in the City of Alliance County of Stark and State of Ohio.

 

Resolution 98-06: introduced by Price: a Resolution  of Alliance City Council providing that the planning, zoning & housing committee shall assess and make recommendations as to the feasibility of designation of the City of Alliance as a “Certified Local Government” by the Ohio Historical Society.

Ordinance 101-06: introduced by Rhome and Okey: an Ordinance amending Ordinance 109-05 to increase the amount to be expended in 2006 with the City’s contractor for sludge removal at the Wastewater Treatment Plant by $50,000; and declaring an emergency. Ordinance 102-06: introduced by Okey: an Ordinance making appropriations and transfers of funds in the 2006 appropriations to provide for necessary expenses and adjustments; and declaring an emergency. Ordinance 103-06: introduced by Okey, Price and Ryan: an Ordinance to amend Chapter 771 of the Codified Ordinances of Alliance Ohio; to create the Department of Safe Housing in the City of Alliance; to establish the safe housing fund; to allocate a portion of safe housing revenue to the director of law for purposes of enforcement; and to establish initial funding for the Department of Safe Housing.
