MINUTES OF THE JULY 3, 2006

   REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

The meeting was called to order by President Benincasa at 7:00 p.m.  Councilman Okey gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.

 

MINUTES: Motion & second to receive and file the minutes of the June 19, 2006 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Motion and second to approve the appointment of Blair Young to the Board of Park CommissionersMOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADMINISTRATIVE REPORTS:

 

Mayor Middleton: no report

 

Safety Service Director Blaser: reviewed letter from Superintendent Amabeli on funding and sludge removal and reported an ordinance would be forthcoming also reported Ordinances 81-06; 82-06; 83-06; and 84-06; got favorable recommendation from the planning commission.  urged council to pass Ordinance 86-06 and explained ordinances 93-06; 94-06; and 95-06.

 

Law Director Andrew Zumbar: reported on Mahoning River drowning lawsuit filed against the City. Summary Judgment motions have been filed and depositions are continuing.  Also reported on 9-1-1 committee.

 

Auditor Alexander Zumbar: reviewed the June 2006 Alliance Municipal Income Tax Recapitulation and updated status on the Audit.

 

STANDING COMMITTEE REPORTS:

 

Safety & Judiciary: Andreani: will meet July 7, 2006 @ 8:30 A.M. in Administration Building 2nd floor conference room to discuss compulsory education legislation with school personnel and review Ordinance 66-06 with department heads.

 

Finance: Okey: no report .

 

Community Development: Phillips: no report.

 

Planning, Zoning, & Housing: Price: Request referral of Ordinance 82-06; 83-06 and 84-06 to committee and explain Ordinance 98-06.

 

Utilities:  Rhome: Recommend passage of Ordinance 94-06 and 95-06 and publicly thanked Mr. McGannon for service to City.

 

Streets & Alley: Ryan: will meet July 6, 2006 @ 6:00 P.M. in Administration Building 2nd floor conference room to discuss grant options for repair to Martin Luther King viaduct.

 

Properties and Lands: Thompson: no report

 

PUBLIC SPEAKS: Debbie Okey of 2700 Fairway Lane discussed the Keep Alliance Beautiful fundraiser at her home and thanked all that supported as well as Mona Henderson.

Ordinance 81-06: introduced by Ryan: an Ordinance Vacating McKinley Avenue between West State Street and Hartshorn Street and parts of four 15 foot alleys North of West State Street, South of Hartshorn Street, West of Clark Avenue, and East of South Rockhill Avenue in the City of Alliance, County of Stark, and State of Ohio.  Motion and second to adopt: Roll Call: Unanimous: ADOPTED

 

Ordinance 82-06: introduced by Price: an Ordinance to amend the Zoning Map of the City of Alliance by changing part of the area located between West State Street and Hartshorn Street and Mckinley Avenue and South Rockhill Avenue from Neighborhood Business District (B-1) to College District (C) under the Alliance City Zoning Ordinance. Ordinance 86-06: introduced by Phillips: an Ordinance authorizing and directing the Director of  Public Safety and Service to enter into an agreement with Vincent A. Marion Jr. as described in the employment agreement Exhibit “A”, for the purpose of providing various services described in the agreement as an employee of the City of Alliance; and declaring an emergency. Motion and second to adopt: Roll Call: 5 to 2 against (Andreani – Rhome). ORDINANCE DEFEATED.

Ordinance 93-06: introduced by Thompson: an Ordinance determining that the City of Alliance has items of personal property which are not needed for municipal purposes which exceed $1,000.00 in estimated value, authorizing the sale of such personal property by written contract to the highest and best bidder at public sale by the director of public safety and service and including in said public sale, personal property as designated by the Alliance Board of Park Commissioners and Alliance City Board of Health; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension.

 

Ordinance 94-06: introduced by Okey and Rhome: an Ordinance authorizing and directing the director of public safety and service to enter into a professional service contract for interim supervision of operations at the Alliance Water Treatment Plant; and declaring an emergency. Motion and second to amend Section 1: Roll Call: Unanimous for amendment. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt as amended: Roll Call: Unanimous: ADOPTED

 

Ordinance 95-06: introduced by Okey and Rhome: an Ordinance authorizing and directing the director of public safety and service to enter into a contract for the replacement of two utility bodies for the water and sewer distribution departments utility trucks at a cost not to exceed $36,000.00; and declaring an emergency. Ordinance 98-06: introduced by Price: an Resolution  of Alliance City Council providing that the planning, zoning & housing committee shall assess and make recommendations as to the feasibility of designation of the City of Alliance as a “Certified Local Government” by the Ohio Historical Society. Resolution 99-06: introduced by Price: a Resolution authorizing the Director of Public Safety and Service to negotiate employment contracts regarding certain designated city employment positions. Motion and Second to set Special Council Meeting for July 10, 2006 @ 7:00 P.M. in council chambers to consider Resolution 99-06 and to postpone action on Resolution 99-06 until that time.
