MINUTES OF THE JANUARY 3, 2006

   REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

 

The meeting was called to order by President Benincasa at 7:00p.m.  President Benincasa gave the invocation and led the meeting in the Pledge of Allegiance.

 

Appointment of Temporary Clerk: President Benincasa appointed Alex Zumbar temporary Clerk.

 

ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan and Larry Thompson present.

 

Appointment of Clerk: President Benincasa read a letters from Jerry Yost and Mark Locke expressing interest in being Council Clerk. Mr. Yost was not present at the meeting. He then asked for additional nominations for Clerk. Receiving none there was a motion and second to appoint Mark Locke Clerk of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. 

 

Election of President Pro-Tem: President Benincasa asked for nominations for President Pro-Tem of City Council. Councilman Price was nominated. With no other nominations there was a motion and second to elect Warren Price President Pro-Tem of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS

 

Adoption of Rules: There was a motion and second to amend the current Rules for Alliance City Council by adding Rule 6.11 SEATING: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.  Motion and second to adopt Rules of Council as amended: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

Council Committee Appointments: The following committee assignments were approved: Community Development- Phillips, Okey and Price; Finance- Andreani, Okey and Price; Planning, Zoning and Housing- Phillips, Price and Ryan; Properties and Lands- Thompson, Rhome and Phillips; Safety and Judiciary- Andreani, Thompson and Okey; Streets and Alleys- Thompson, Rhome and Ryan; Utilities- Rhome, Andreani and Ryan.

 

MINUTES:  Motion & second to receive and file the minutes of the December 19, 2005 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.  Motion & second to receive and file the minutes of the December 29, 2005 special meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. 

 

COMMUNICATIONS:

 

1.        Alliance Municipal Income Tax Recapitulation for December 2005.

2.        Water and Sewer Department Financial Report for December 2005.

3.        Letter from Mayor Middleton regarding the receipts collected through the Mayor’s office during the month of December 2006 totaling $551,580.41.

 

Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

 ADMINISTRATIVE REPORTS:

 

Mayor Middleton: absent, no report

 

Safety Service Director Blaser: commended Alex Zumbar and the other City employees who are networking the City offices; reviewed Ordinance 01-06; announced that the firefighter conciliation is on January 27, 2006, he asked if the new Council wanted to review the fact finders report prior to the conciliation, .after much discussion there was a motion and second to have a Work Session to review the report at 6:00 P.M. on January 17, 2006 in Council Chambers: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

Law Director Zumbar: gave his annual report (Copy in communications); reported on the Schopp/ Tanner annexation.

 

Auditor Zumbar: reviewed Ordinance 01-06; reviewed the Alliance Municipal Income Tax Recapitulation for December 2005

 

STANDING COMMITTEE REPORTS:

 

Safety & Judiciary: Andreani: announced he will be scheduling a committee meeting soon to discuss the Assistant Police Chief position.

 

Finance: Okey: no report

 

Community Development: Phillips: no report

 

Planning, Zoning, & Housing: Price: no report

Utilities:  Rhome: reported on the Water Sewer Advisory meeting from this morning.

 

Streets & Alley:- Ryan: no report

 

Properties and Lands: Thompson: invited everyone to attend the Shade Tree Commission meetings on the last Thursday of each month

 

 PUBLIC SPEAKS: Jesus Hernandez Rodriguez, 2012 Tanglewood, Alliance: reported he is opening the La Pinata Mexican Restaurant in the Dawson facility the end of January.

 

THIRD READINGS:

 

Ordinance 125-05: introduced by Schwarz: an Ordinance creating new Chapter 117-Fees of the Codified Ordinances of the City of Alliance and amending sections of the codified Ordinances for the purpose of giving the Director of Public Safety and Service the authority to review, update and establish permit, plan review, and inspection fees for Engineering, Planning and Zoning and to make them compatible to other local communities with the approval of Council, approving new fees; and declaring an emergency.

 

Ordinance 130-05: introduced by Schwarz: an ordinance to adopt a new City of Alliance Planning and Zoning Code and sub-Division/ Development Regulations to completely replace the existing Planning and Zoning Code, Map and Sub-Division Regulations in the Codified Ordinances of the City of Alliance, Counties of Stark and Mahoning and State of Ohio.

Ordinance 01-06: introduced by Okey: an Ordinance amending Exhibit “A” of Ordinance 133-05 making final appropriations and transfers of funds in the 2005 Appropriations to provide for necessary end of the year expenses and adjustments; and declaring an emergency. Resolution 02-06: introduced by Council as a Whole: a Resolution expressing to Cody Combs the sincere appreciation of this Council, the Administration, and the citizens of the City of Alliance for his dedicated two years of service as a member of the Alliance City Council. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

 

Resolution 03-06: introduced by Council as a Whole: a Resolution expressing to Randy Pope the sincere appreciation of this Council, the Administration, and the citizens of the City of Alliance for his dedicated two years of service as a member of the Alliance City Council. Resolution 04-06: introduced by Council as a Whole: a Resolution expressing to Douglas Schwarz the sincere appreciation of this Council, the Administration, and the citizens of the City of Alliance for his dedicated four years of service as a member of the Alliance City Council. Ordinance 07-06: introduced by Okey/ Price/ Phillips/ Thompson/ Ryan: an Ordinance to promote the downtown business area of Alliance by permitting certain pole signs along State Street and Union Avenue.

Resolution 10-06: introduced by Okey/ Price/ Phillips/ Thompson/ Ryan: a Resolution of the Council of the City of Alliance, Ohio, creating a Dr. Martin Luther King, Jr. Viaduct Improvement Advisory Commission for the purpose of making recommendations to the City Council regarding the potential beautification and improvement of the Martin Luther King, Jr. viaduct. Resolution 11-06: introduced by Okey/ Price/ Phillips/ Thompson/ Ryan:  a Resolution of the Council of the City of Alliance, Ohio, creating a City Council Skateboard Park Advisory Commission for the purpose of making recommendations to the City Council regarding the potential construction, management and operation of a skateboard facility in the City of Alliance, Ohio.
