MINUTES OF THE DECEMBER 18, 2006

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

The meeting was called to order by President Benincasa at 7:00 p.m. Councilman Thompson gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Steve Okey, Phyllis Phillips, Warren Price, Roger Rhome, Sue Ryan, and Larry Thompson present.

Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Motion and second to approve the Mayor‘s appointments of individuals to the various commissions and boards as outlined in the Mayor‘s letter. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADMINISTRATIVE REPORTS:

Mayor Middleton: Absent - no report.

Safety Service Director Blaser: Noted the paving program is complete and complimented City Engineer on comprehensive report on paving program.

Reviewed Ordinance 150-06.

Councilman Price complimented City Engineer on the comprehensive street improvement and paving report.

Law Director Andrew Zumbar: Reported that his review with the police chief revealed no major problem establishments to look at for objection of the annual liquor permit renewal. Asked that if council members have any, please submit as soon as possible as they must be submitted to the State of Ohio by December 31, 2006.

Explained Ordinance 151-06 and noted the correction of a typographical error.

Reviewed Ordinance 152-06 and reported that the change in zoning is necessary for the developer to proceed with plans

Auditor Alexander Zumbar: Reviewed Operational Budget by Department as of November 30, 2006.

Reported the Temporary Budget was reviewed by the finance committee and resulted in an amended Exhibit “A” for Ordinance 133-06.

Reported that the City Web page is being revised with a new look and more user friendly.

Requested that council set a special session to finalize 2006 year end budget transfers and appropriations.

Reviewed Resolution 153-06.

STANDING COMMITTEE REPORTS:

Safety & Judiciary: Andreani: No formal report.

Finance: Okey: Reported on the December 11, 2006 committee meeting the reviewed the temporary budget and developed a revised Exhibit “A“ for Ordinance 133-06 with assistance of Safety Service Director and Auditor. The Committee recommends passage as revised.

The Committee also reviewed and recommended differing repayment of the General Fund Loan. A $50,000 payment was budgeted but given the financial situation, the committee recommends waiting to make a payment

Motion and Second to set Special Meeting of City Council for December 28, 2006 @ 8:30 A.M. in City Administration Building to finalize year end appropriations and transfers. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Community Development: Phillips: No formal report.

Planning, Zoning, & Housing: Price: Reported the meeting for December 19, 2006 @ 8:30 A.M. in the administration building 2nd floor conference room to review the testimony related to the Safe Housing Ordinance will need to be re-scheduled for a later date.

Committee will set a limit of thirty days for proposed changes to the Zoning Ordinance and then will re-convene the steering committee to consider the options.

Utilities: Rhome: No formal Report.

Streets & Alley: Ryan: No formal Report.

Properties and Lands: Thompson: No formal report.

PUBLIC SPEAKS: Danille Kemp of 11836 Sioux Avenue NE, Alliance discussed plans to utilize the Rush Street Rail Spur with improvement to transfer out-of-state trash to the Smith Township landfill on Oyster Road. Discussed and questioned the placement of a possible truck transfer station in the City of Alliance.

THIRD READINGS:

Ordinance 135-06: Introduced by Phillips: An Ordinance authorizing and directing the Director of Public Safety and Service of the City of Alliance to enter into a contract with the Stark County Regional Planning Commission to provide Fair Housing Services to the City of Alliance. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

SECOND READINGS

Ordinance 141-06: Introduced by Price: An Ordinance accepting and approving the replat of part of lot 1438 and part of lot 1439 located on East Oxford Street in the City of Alliance, County of Stark and State of Ohio. NO FORMAL ACTION.

Ordinance 142-06: Introduced by Price: An Ordinance vacating a 15 foot North South alley West of Penn Avenue, South of West State Street for a distance of 120 feet, and a 15 foot East West Alley South of West State Street, West of Penn Avenue for a distance of 120 feet in the City of Alliance, County of Stark and State of Ohio. NO FORMAL ACTION.

Ordinance 143-06: Introduced by Price: An Ordinance accepting and approving the replat of lots 31 and 32 and parts of two vacated 15 foot alleys South of West State Street and West of Penn Avenue in the City of Alliance, County of Stark and State of Ohio; and declaring an emergency. NO FORMAL ACTION.

NEW BUSINESS:

Ordinance 150-06: Introduced by Okey and Rhome: An Ordinance ratifying a contract between the City of Alliance and the Alliance Water Pollution Control Employees Association; and declaring an emergency. Resolution 151-06: Introduced by Rhome and Thompson: A Resolution declaring the necessity of an election on the question of approving the passage of a decrease of the existing city of Alliance income tax credit for income tax paid by residents to another municipality. Resolution 154-06: Introduced by Okey and Price: A Resolution urging Ohio Governor Bob Taft to protect Ohio Consumers by Vetoing Substitute Senate Bill 117. Motion and second to adopt: Roll Call:Unanimous: ADOPTED
