MINUTES OF THE SEPTEMBER 19, 2005

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

 

The meeting was called to order by President Benincasa at 7:00 p.m. Councilman Pope gave the invocation and led the meeting in the Pledge of Allegiance.

 

ROLL CALL: Alan Andreani, Cody Combs, Phyllis Phillips, Randy Pope, Roger Rhome, Doug Schwarz and Jack Weaver present.

 

MINUTES: Motion & second to receive and file the minutes of the September 6, 2005 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

COMMUNICATIONS:

 

1.         Letter from the Ohio EPA to Mayor and Council, City of Alliance dated August 30, 2005. Re: Permit to install for the

            Alliance Wastewater Treatment Plant modification.

2.         News Release from Mayor Middleton announcing Trick or Treat for Monday    October 31, 2005 in the City of Alliance.

3.         Letter from the Ohio EPA to Mayor and Council, City of Alliance dated  September 7, 2005. Re: Approved plans for the

            waterline extension for Wade Avenue.

4.         Letter from the Ohio EPA to Mayor and Council, City of Alliance dated  September 7, 2005. Re: Approved plans for the

            waterline extension for Woodland Avenue.

5.         Letter from William Hawley to all members of the Board of Zoning Appeals dated September 13, 2005. Re: no regular

            meeting for the month of September 2005 for the Board of Zoning Appeals.

6.         Operational Budget Report by Department as of August 31, 2005.

7.         Letter from Mayor Middleton regarding the receipts collected through the Mayor’s Office during the month of August

            2005 totaling $770,063.10.

8.         State Issue 1- Certified Ballot Language

 

Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

ADMINISTRATIVE REPORTS:

 

Mayor Middleton: No report

 

Safety Service Director Blaser: No report. Police Chief Dordea was introduced and informed Council of a competition that the Alliance Police Department K-9 took first place. Also announced that the City was donated another police dog and miscellaneous equipment with a value of over $10,000.

 

Law Director Zumbar: reviewed Ordinance 98-05 and Resolution 97-05; gave an update on the Tim Hirst, Hartland Products case.

 

Auditor Zumbar: reviewed the Operational Report and gave an update on the Robertson Community Center.

 

STANDING COMMITTEE REPORTS:

 

Safety and Judiciary: Andreani: Motion and second to not request a hearing on the transfer of liquor license from Speedway Superamerica, LLC, DBA Rich Oil #3 769, 642 E. State Street, Alliance to ADD Petroleum Inc., 642 E. State Street, Alliance. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

Properties and Lands: Combs: no report

 

Community Development: Phillips: no report

 

Streets and Alleys: Pope: reviewed Ordinance 99-05.

 

Utilities:Rhome: no report

 

Planning, Zoning & Housing: Schwarz: reminded everyone of the AADF Annual meeting Tuesday evening at the Senior Center.

 

Finance: Weaver: no report.

 

PUBLIC SPEAKS: Reijo Saari, 742 S. Arch Ave., Alliance. Re: expressed the need to speed up the system on handling of a safety complaint in the City. He is dealing with a problem of bricks falling from a neighbor’s chimney.

Ordinance 90-05: introduced by Schwarz: an Ordinance accepting and approving the replat of outlots 672 located on South Union Avenue in the City of Alliance, County of Stark and State of Ohio.

 

Ordinance 91-05: introduced by Schwarz: an Ordinance accepting and approving the replat of all of lot 6880 and parts of lots 6879 and 6881 located on Shunk Avenue in the City of Alliance, County of Stark and State of Ohio.

 

Ordinance 92-05: introduced by Schwarz: an Ordinance accepting and approving the replat of all of lot 6612 located on East Milton Street in the City of Alliance, County of Stark and State of Ohio.

 

Ordinance 93-05: introduced by Schwarz: an Ordinance accepting and approving the replat of all of lots 6210 and 10343 and part of lot 9265 located on Fernwood Blvd. in the City of Alliance, County of Stark and State of Ohio.

 

Ordinance 95-05: introduced by Schwarz: an Ordinance to amend the Zoning Map of the City of Alliance by changing outlot 666 located on Schubert Avenue south of West State Street from two-family residential district (R-2) to multi-family residence district (R-3) under the Alliance City Zoning Ordinance.

 

Ordinance 96-05: introduced by Schwarz: an Ordinance amending Alliance Codified Ordinances Section 181.14 “Credit for Tax Paid to Another Municipality”; and declaring an emergency.

 

NEW BUSINESS:

 

Resolution 97-05: introduced by Council as a Whole: a Resolution proclaiming support of State Issue I amending the Ohio Constitution to authorize the issuance of General Obligations of the State to finance local government public infrastructure capital improvement, research and development and the development of certain sites and facilities in Ohio, and to expand State and local government authority regarding economic development. Amending the Ohio Constitution to authorize the issuance. Motion and second to adopt: Roll Call: 5-2 (Phillips, Pope): ADOPTED

 

Ordinance 98-05: introduced by Weaver: an Ordinance authorizing and directing the Director of Public Safety and Service to enter into a contract to provide legal counsel to indigent persons charged with loss of liberty offenses in the Alliance Municipal Court; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

Ordinance 99-05: introduced by Pope: an Ordinance amending establish Section 505.24 “Responsible Animal Ownership.”
