MINUTES OF THE OCTOBER 17, 2005

REGULAR MEETING OF TIlE ALLIANCE CITY COUNCIL

 

 

The meeting was called to order by President Benincasa at 7:00 p.m. Councilman Schwarz gave the invocation and led the meeting in the Pledge of Allegiance.

 

ROLL CALL: Alan Andreani, Cody Combs, Phyllis Phillips, Randy Pope, Roger Rhome, Doug Schwarz and Jack Weaver present.

 

MINUTES: Motion & second to receive and file the minutes of the October 3, 2005 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

COMMUNICATIONS:

 

1.         Minutes from the August 16, 2005 Board of Zoning Appeals meeting and agenda for their October 18, 2005 meeting.

2.         Operational Budget Report by department as of September 30, 2005.

3.         Water and Sewer Department Financial Report for September 2005.

 

Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

ADMINISTRATIVE REPORTS:

 

Mayor Middleton: No report

 

Safety Service Director Blaser: reviewed Ordinances 103-05, 104-05, 105-05, 106-05, 107-05 and 108-05.

 

Law Director Zumbar: mediation on the Central Allied case took place but can not be discussed yet; reviewed Ordinance 104-05.

 

Auditor Zumbar: reviewed the Operational Budget Report by department as of September 30, 2005; reviewed Ordinance 103-05; gave update on the computer upgrade project.

THIRD READINGS:

 

Ordinance 99-05: introduced by Pope: an Ordinance amending Alliance Codified Ordinances to establish Section 505.24 “Responsible Animal Ownership.” Motion and second to amend by adding section c) Whoever violates this section shall receive a verbal warning upon a first offense. Whoever violates this section after receiving a verbal warning shall be guilty of a minor misdemeanor.

MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Motion and second to adopt: Roll Call:            Unanimous: ADOPTED

Ordinance 103-05: introduced by Weaver: an Ordinance making appropriations and transfers of funds in the 2005 Appropriations to provide for the necessary expenses and adjustments; and declaring an emergency.  Motion and second to suspend rules:  Roll Call: Unanimous for rules suspension.  Motion and second to adopt:  Roll Call: Unanimous.  ADOPTED

Ordinance 104-05: introduced by Combs & Phillips: an Ordinance designating the Greater Alliance Development Corporation (GADC) as a Civic Improvement Corporation pursuant to Ohio Revised Code Section 1724.10 and authorizing and directing the Director of Public Safety and Service to enter into an agreement for the sale of certain real estate; and declaring an emergency. Ordinance 105-05: introduced by Weaver: an Ordinance authorizing and directing the Director of Public Safety and Service to file an application and enter into an agreement with the Stark-TuscarawasWayne Joint Solid Waste District for the purpose of acquiring grant funds through the Solid Waste Management and Recycling Program; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call:Unanimous: ADOPTED

 

PUBLIC HEARING: 7:30 p.m. Ordinance 80-05: President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Upon observing no response by any to speak in favor of the Ordinance President Benincasa made three (3) calls for all those wishing to speak in opposition to the Ordinance. Upon observing no response by any to speak in opposition to the Ordinance, President Benincasa declared the public hearing closed at 7:32 P.M.

 

Resolution 106-05: introduced by Andreani: a Resolution rejecting the recommendations of the Fact- Finding Report concerning settlement of contractual disputes between the City of Alliance and Local 480 of the International Association of Firefighters AFL-CIO aka Alliance Professional Firefighters Association, Local 480, AFL-CIO. Motion and second to go into executive session at the conclusion of regular business to discuss with Council members, President of Council, Mayor , Safety Service Director, Law Director, Auditor, Clerk, Attorney Nick Codrea, Assistant Fire Chief: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

Ordinance 107-05: introduced by Weaver & Combs: an Ordinance amending Ordinance 85-05 for the purpose of adding Exhibit ‘~A” listing items of personal property which are not needed for municipal purposes which exceed $1,000 in estimated value; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call:

Ordinance 108-05: introduced by Andreani & Weaver: an Ordinance authorizing and directing the Director of Public Safety and Service to accept two $1,250 grants from Wal-Mart Foundation; and declaring an emergency. OLD BUSINESS:

 

Ordinance 80-05: introduced by Rhome: an Ordinance vacating part of a 10 foot alley west of South Lincoln Avenue and south of Wilcox Street in the City of Alliance, County of Stark and State of Ohio. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

 

Ordinance 81-05: introduced by Schwarz: an Ordinance accepting and approving the replat of lots 4767 through 4771 and part of a vacated 10 foot alley located on South Lincoln Avenue in the City of Alliance, County of Stark and State of Ohio. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

 

President Benincasa adjourned the meeting into executive session at 7:38 P.M. President Benincasa called the meeting back into regular session at 8:50 P.M.
