MINUTES OF THE NOVEMBER 7, 2005
REGULAR MEETING OF THE ALLIANCE CITY COUNCIL
The meeting was called to order by President Benincasa at 7:00 p.m. Councilman Weaver gave the invocation and led the meeting in the Pledge of Allegiance.
ROLL CALL: Alan Andreani, Cody Combs, Phyllis Phillips, Randy Pope, Roger Rhome, Doug Schwarz and Jack Weaver present.
MINUTES: Motion & second to receive and file the minutes of the October 17, 2005 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
COMMUNICATIONS:
1. Ohio Municipal League Legislative Bulletin #17 dated October 14, 2005.
2. Ohio Municipal League Legislative Bulletin #18 dated October 21, 2005.
3. Letter from Time Warner to Mayor Toni Middleton dated October 20, 2005. Re: service increase
4. Water and Sewer Department Financial Report for October 2005.
5. Letter from the Ohio Department of Liquor Control dated October 28, 2005 requesting whether or not City Council request a hearing on the Liquor Permit transfer from Ports Petroleum Co. Inc., DBA Gas Mart 766 S. Union Avenue, Alliance to Tamarkin Company, DBA Getgo 3605, 766 S. Union Avenue, Alliance no later than 11/28/05.
6. 2005 Alliance Municipal Income Tax Recapitulation for October 2005.
7. Minutes from the October 3, 2005 Water and Sewer Advisory Board meeting and notice of their November 7, 2005 meeting.
8. Letter from Mayor Middleton regarding the receipts collected through the Mayor’s office during the month of October 2005 totaling $741,752.85.
Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
ADMINISTRATIVE REPORTS:
Mayor Middleton: no report
Safety Service Director Blaser: reported that the paving project will be completed this week; reviewed Ordinance 109-05.
Law Director Zumbar: absent- no report
Auditor Zumbar: no report
STANDING COMMITTEE REPORTS:
Safety and Judiciary: Andreani: no report
Properties and Lands: Combs: no report
Community Development: Phillips: no report
Streets and Alleys: Pope: announced that leaf pickup will begin Monday.
Utilities: Rhome: reported on the Water and Sewer Advisory Board meeting from this morning.
Planning, Zoning & Housing: Schwarz: reported that the Land Use Committee will meet November 21, 2005 at 3:30 P.M.
Finance: Weaver: no report
PUBLIC SPEAKS: Paul Ray, 2832 Blenheim Avenue, Alliance- Thanked City Council for repealing the income tax exemption.

SECOND READINGS: none
NEW BUSINESS:
Ordinance 109-05: introduced by Weaver/ Rhome: an Ordinance authorizing and directing the Director of Public Safety and Service to advertise for bids and enter into a contract for the dewatering and removal of sludge from the Wastewater Treatment Plant for a period of up to three(3) years in an amount not to exceed $80,000 per year; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED
OLD BUSINESS: none
With no further business and a Public Hearing at 7:30 the President Benincasa recessed the meeting at 7:12 P.M. till 7:30 P.M.
President Benincasa called the meeting back into session at 7:30 P.M.
PUBLIC HEARING: at this time Council proceeded with it’s scheduled Public Hearing on Ordinance 95-05.
President Benincasa made three(3) calls for all those wishing to speak in favor of the Ordinance. David Smith, 445 W. Main Street, Canfield, Ohio 44406, representing the developer, spoke in favor of the Ordinance and reviewed the proposed development. Upon observing no further responses by anyone to speak in favor of the Ordinance, President Benincasa made three(3) calls for all those wishing to speak in opposition of the Ordinance. The following people spoke in opposition to the Ordinance and expressed their concerns: Clyde Howell, 8737 Schubert Avenue; Sammi Bolin, 8700 Byrd Avenue; Rick Carli, 8799 Schubert Avenue.
Upon observing no further responses President Benincasa declared the public hearing closed at 7:50 P.M.
ADJOURNMENT: Noting no further business to come before this Council, President Benincasa adjourned the meeting at 7:52 p.m.
With the need for further action the motion and second to adjourn was withdrawn.
