MINUTES OF THE NOVEMBER 21, 2005

   REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

 

The meeting was called to order by President Benincasa at 7:00 p.m.  Councilman Andreani gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Alan Andreani, Cody Combs, Phyllis Phillips, Randy Pope, Roger Rhome, Doug Schwarz and Jack Weaver present.

 

MINUTES: Motion & second to receive and file the minutes of the November 7, 2005 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

 

COMMUNICATIONS:

 

1.        Minutes from the October 18, 2005 Board of Zoning appeals meeting and agenda for their November 15, 2005 meeting.

2.        Memo from Vincent Marion, Director of Planning and Development Department to Alliance City Council Members and members elect dated November 8, 2005. Re: Attendance at City Council meetings.

3.        Letter from Time Warner Cable to Mayor Toni Middleton dated November 9, 2005. Re: Time Warner Inc. agreement with Comcast.

4.        Letter from the Ohio Department of Liquor Control dated November 15, 2005 requesting whether or not City Council request a hearing on the Liquor Permit transfer from Mohammed Alihassan, DBA Meadowbrook Delicatessen, 623 W. State Street, Alliance to Briar Hill Foods Inc., DBA Thorne’s IGA Super Center, 653 S. Union Avenue, Alliance, no later than 12/12/05.

5.         Letter from Alexander A. Zumbar, City Auditor to Alliance City Council and Administration dated November 15, 2005. Re: GFOA Certificate of Achievement for Excellence Award.

6.        Operational Budget Report by Department as of October 31, 2005.

7.        Letter from the Ohio Department of Liquor Control dated November 18, 2005 asking Council if they have any Liquor Permit abjections. All permits to sell liquor in the City of Alliance expire on February 1, 2006. All objections must be filed by January 3, 2006.

8.        Minutes from the November 7, 2005 Water and Sewer Advisory Board meeting and notice of their December 5, 2005 meeting.                      

 

Motion and second to receive and file all communications tendered to the Clerk.  MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Safety Service Director Blaser: reviewed Ordinances 92-05, 111-05 and 114-05..

 

Law Director Zumbar: reviewed the Dawson’s Restaurant situation, discussed the annual review of all liquor licenses.

 

Auditor Zumbar: reviewed Operational Budget, General Fund Revenue, Ordinances 113-05 and 115-05.

Resolution 111-05: introduced by Andreani: a Resolution authorizing the Safety Service Director to enter into a contract and agreement for OVI Countywide Task Force assistance and enforcement. Motion and second to adopt: Roll Call: 6-1(Pope): ADOPTED

 

Ordinance 112-05: introduced by Schwarz: an Ordinance accepting and approving the replat of lots 7413 and 7414 located on South Rockhill Avenue in the City of Alliance, County of Stark and State of Ohio. Ordinance 113-05: introduced by Weaver: an ordinance making temporary appropriations for 2006 for the General Fund, Water Fund, Sewer Fund and other City funds, and authorizing the Auditor to draw payments from those appropriations upon receiving proper certificates and vouchers; and declaring an emergency.

 

Ordinance 114-05: introduced by Weaver/ Andreani: an Ordinance authorizing and directing the Director of Public Safety and Service to retain the services of Attorney Robert J. Tscholl for labor relations and employment matters; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension.
