MINUTES OF THE DECEMBER 29, 2005

SPECIAL MEETING OF THE ALLIANCE CITY COUNCIL

The meeting was called to order by President John Benincasa at 4:00 p.m. in the City Administration Building, 2nd Floor Conference Room, 504 E. Main Street, Alliance, Ohio.

ROLL CALL: Alan Andreani, Cody Combs, Phillip Phillips, Randy Pope, Roger Rhome, Doug Schwarz and Jack Weaver present.

Notice: Acting Clerk Alex Zumbar read the Notice of the Special Meeting of Alliance City Council.

Third Readings:

Ordinance 116-05: introduced by Andreani: An Ordinance to amend the Zoning Map of the City of Alliance by changing all of lot 9967 and part of Lot 9966 located on Western Avenue south of West State Street from One Family Residence District (R-1) to neighborhood Business District (B-i) under the Alliance City Zoning Ordinance. Motioned by Andreani to hold Public Hearing on February 6, 2006 at 7:30 p.m. in Council Chambers, seconded by Rhome. MOTIONED PASSED BY ACCLAMATON OF ALL MEMBERS.

Ordinance 117-05: introduced by Andreani: An Ordinance accepting and approving the replat of all of Lot 9967 and part of Lots 9967 and 9968 through 9970 and part of Outlot 630 loOcated on West State Street in the City of Alliance, County of Stark and State of Ohio. Motion to adopt by Andreani, seconded by Weaver. Roll Call: Unanimous: ADOPTED.

Second Readings:

Ordinance 125-05: Introduced by Schwarz: An Ordinance creating new Chapter 117 — Fees of’ the Codified Ordinances of the City of Alliance and amending sections of the Codified Ordinances for the purpose of giving the Director of Public Safety and Service the authority to review, update and establish permit, plan review, and inspection fees for Engineering, Planning and Zoning and to make them compatible to other local communities with the approval of Council, approving new fees; and declaring an emergency.

Ordinance 130-05: Introduced by Schwarz: An Ordinance to adopt a new City of Alliance Planning and Zoning Code and Sub-division/Development Regulation to completely replace the existing Planning and Zoning Code, Map and Sub-division Regulations in the Codified Ordinances of the City of Alliance, Counties of Stark and Mahoning and State of Ohio. Public Hearing scheduled on January 31, 2006 at 7:00 P.M. in Council Chambers.

New Business:

Ordinance 133-05: Introduced by Weaver: An Ordinance making appropriations and transfers of funds in the 2005 Appropriations to provide for necessary expenses and adjustments; and declaring an emergency. Weaver Motion to suspend rules, seconded by Phillips; Roll Call: Unanimous; Weaver Motion to adopt, seconded by Phillips; Roll Call: Unanimous: ADOPTED.

Adjournment: Noting no further business to come before this Council, President Benincasa adjourned the meeting at 4:09 p.m.
