MINUTES OF THE NOVEMBER 3, 2003
REGULAR MEETING OF THE ALLIANCE CITY COUNCIL
The meeting was called to order by President Benincasa at 7:00p.m. Councilman Luther gave the invocation and led the meeting in the Pledge of Allegiance.
ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Phyllis Phillips, Mark Roller, Doug Schwarz and Alex Zumbar present.
MINUTES: Motion & second to receive and file the minutes of the October 20, 2003 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
COMMUNICATIONS:
Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
ADMINISTRATIVE REPORTS:
Mayor Middleton: introduced Larry Pyers, Chairman of the Revolving Loan Committee. Larry reviewed Ordinance 148-03 reporting that the committee recommends approval.
Safety Service Director Blaser: reviewed Ordinances 149-03, 150-03, 151-03, 152-03 and 154-03.
Law Director Zumbar: reviewed Ordinance 148-03 and said the term of the loan should be changed to 15 years instead of 10; reviewed Ordinance 153-03.
Auditor Carr: absent, submitted written report (included in communications); Deputy Auditor Robert Kittoe was there to answer questions.
STANDING COMMITTEE REPORTS:
Properties and Land: Alihassan: no report; asked Law Director Zumbar to explain the letter from Ashpk Singh from the last meeting- Zumbar reviewed the letter and circumstances leading up to it.
Streets and Alleys: Luther: reported that leaf pick-up has begun; he will be setting a public hearing on Ordinance 147-03 later in the meeting.
Planning, Zoning & Housing Ogline: will be asking for action on Ordinance 146-03.
Utilities: Phillips: reviewed the Water Sewer Advisory Board meeting from earlier today.
Safety and Judiciary: Roller: spoke in favor and asked for action on Ordinances 149-03 and 150-03.
Community Development: Schwarz: asked that he be allowed to abstain on Ordinance 148-03 due to a conflict of interest. Motion and second to allow Schwarz to abstain on Ordinance 148-03: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
Finance: Zumbar: spoke in favor 148-03, 151-03 and 154-03.

Ordinance 143-03: introduced by Luther: an Ordinance vacating part of Rice Street west of South Arch Avenue in the City of Alliance. Motion and second to schedule a Public Hearing for December 15, 2003 at 7:30 p.m. in Council Chamber: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
Ordinance 144-03: introduced by Ogline: an Ordinance accepting and approving the replat of lots 7261, 12296, 12863 and 12864 located at the intersection of 24th Street and South Rockhill Avenue in the City of Alliance, County of Stark and State of Ohio. Motion and second to refer to Planning Commission: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
Ordinance 145-03: introduced by Ogline: an Ordinance to amend the Zoning Map of the City of Alliance by changing part of outlot 218, lots 3925, and part of an alley proposed to be vacated, located between South Union Avenue and Scranton Avenue and between West Cambridge Street and West Summit Street from Two-Family Residence District (R-2) to Neighborhood Business District (B-1) under the Alliance City Zoning Ordinance. Ordinance 146-03: introduced by Ogline: an Ordinance accepting the final plat of Oaktree Commons plat 1 located in part of outlots 595 and 596 in the City of Alliance, County of Stark and State of Ohio. Ordinance 147-03: introduced by Luther: an Ordinance amending Ordinance 76-03 and vacating parts of a north south alley north of Summit Street foe a distance of approximately two hundred seventy four feet and an east west alley west of lot 1964 for a distance of approximately one hundred ten feet and declaring an emergency. Motion and second to refer to Planning Commission: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Ordinance 148-03: introduced by Zumbar: an Ordinance authorizing the execution of a loan agreement with respect to the proceeds derived from Urban Development Action Grants (UDAG) in the amount of $25,000 to Winkle Industries, Inc. and Winkle Magnetics, Inc., and declaring an emergency. Ordinance 149-03: introduced by Roller/ Zumbar: an Ordinance authorizing and directing the Director of Public Safety and Service to apply for and enter into a grant agreement with the Ohio Department of Youth Services for funds to support the Kick Drugs Out of Alliance Program in an amount not to exceed $30,000; and declaring an emergency. Ordinance 150-03: introduced by Zumbar/ Roller: an Ordinance authorizing and directing the Director of Public Safety and Service to enter into a contract for the purpose of purchasing a digital logging recorder system for use by the Alliance Police Department through the Cooperative Purchasing Programs of the Ohio Department of Transportation and the Ohio Department of Administrative Services or to advertise for bids and enter into a contract with another vendor at the lowest and best price, but for a cost not to exceed $30,000 in any case and declaring an emergency. Ordinance 151-03: introduced by Zumbar/ Alihassan: an Ordinance authorizing and directing the Director of Public Safety and Service to execute a No Surface Rights Oil and Gas Lease for the Tanner Unit Well and declaring an emergency. Ordinance 152-03: introduced by Council as a Whole: an Ordinance authorizing and directing the Director of Public Safety and Service to file an application and enter into an agreement with the Stark- Tuscarawas- Wayne Joint Solid Waste District for the purpose of acquiring grant funds through the Solid Waste Management and Recycling Program; and declaring an emergency. Zumbar asked that a second round of leaf pick-up be made in the 4th Ward since all the leaves are not down yet.
