MINUTES OF THE NOVEMBER 17, 2003

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

The meeting was called to order by President Benincasa at 7:00p.m. Councilman Ogline gave the invocation and led the meeting in the Pledge of Allegiance.

ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Phyllis Phillips, Mark Roller, Doug Schwarz and Alex Zumbar present.

MINUTES: Motion & second to receive and file the minutes of the November 3, 2003 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

COMMUNICATIONS:

    1. Corrected minutes of the October 6, 2003 Water and Sewer Advisory Board meeting.
    2. Minutes of the November 3, 2003 Water and Sewer Advisory Board meeting & notice of their December 1, 2003 meeting.
    3. Minutes of the October 21, 2003 Board of Zoning Appeals meeting.
    4. Agenda for the November 18, 2003 Board of Zoning Appeals meeting.
    5. Notice from Ohio Division of Liquor Control to Police Chief Dordea, et al. concerning expiration of all liquor licenses in Alliance on February 1, 2004, indicating the necessity for Council to respond to indicate whether or not they request a hearing on or before 01/02/04.
    6. Letter from Mayor Toni Middleton requesting Council to approve the following appointments to the Board of Zoning Appeals: Tom Moushey- re-appointment for 5 years expiring 12/31/08; Todd Mastrioanni filling the term of Bruce Bowman expiring 12/31/04 and David Lundgren filling the term of Jim Mauldin expiring on 12/31/06.
    7. Reports from the City Auditor including Alliance Municipal Income Tax Report, General Fund Revenue Report and Operational Budget.
    8. Letter from Alliance Homes II, LLC to Mr. John Benincasa dated November 12, 2003. Re: Description of housing project and related funding programs.

Motion and second to approve the appointments of the Mayor to the Alliance Board of Zoning Appeals. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Motion and second to receive and file all communications tendered to the Clerk. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADMINISTRATIVE REPORTS:

Mayor Middleton: no report

Safety Service Director Blaser: reviewed Exhibit "A" for Ordinance 158-03 and asked for action tonight.

Law Director Zumbar: attended the hearing on the Dawson liquor permit renewal- waiting for decision; filed the City’s answer on the EPA lawsuit today.

Auditor Carr: absent, submitted written report (included in communications); Deputy Auditor Robert Kittoe reviewed the reports and thanked all department heads for holding expenses down.

STANDING COMMITTEE REPORTS:

Properties and Land: Alihassan: no report.

Streets and Alleys: Luther: no action on Ordinances 143-03 and 147-03; asked for action on Ordinance 155-03.

Planning, Zoning & Housing Ogline: no report

Utilities: Phillips: no report

Safety and Judiciary: Roller: reviewed the notice from the Ohio Division of Liquor Control and said the City did not plan to contests any of the permits at this time.

Community Development: Schwarz: no report

Finance: Zumbar: spoke in favor 158-03 and asked for action tonight.

SECOND READINGS:

Ordinance 143-03: introduced by Luther: an Ordinance vacating part of Rice Street west of South Arch Avenue in the City of Alliance.

Ordinance 144-03: introduced by Ogline: an Ordinance accepting and approving the replat of lots 7261, 12296, 12863 and 12864 located at the intersection of 24th Street and South Rockhill Avenue in the City of Alliance, County of Stark and State of Ohio.

Ordinance 145-03: introduced by Ogline: an Ordinance to amend the Zoning Map of the City of Alliance by changing part of outlot 218, lots 3925, and part of an alley proposed to be vacated, located between South Union Avenue and Scranton Avenue and between West Cambridge Street and West Summit Street from Two-Family Residence District (R-2) to Neighborhood Business District (B-1) under the Alliance City Zoning Ordinance.

Ordinance 147-03: introduced by Luther: an Ordinance amending Ordinance 76-03 and vacating parts of a north south alley north of Summit Street foe a distance of approximately two hundred seventy four feet and an east west alley west of lot 1964 for a distance of approximately one hundred ten feet and declaring an emergency.

Ordinance 155-03: introduced by Luther: an Ordinance accepting and approving the road dedication plat of West Main Street at the northeast corner of the intersection of West Main Street and Keiters Crossing in the City of Alliance, Stark County, Ohio. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

Ordinance 156-03: introduced by Ogline: an Ordinance accepting and approving the replat of part of outlot 325 located at the northeast corner of West Main Street and Keiters Crossing in the City of Alliance, County of Stark and State of Ohio. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED

Ordinance 157-03: introduced by Ogline: an ordinance accepting and approving the replat of lots 7660 through 7662 located on Ashland Avenue in the City of Alliance, County of Stark and State of Ohio.

Ordinance 158-03: introduced by Zumbar: an Ordinance waiving accrued assessments of sewer, weed control and demolition costs for certain properties in the City of Alliance, Stark County, Ohio and; declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: Unanimous: ADOPTED
