 MINUTES OF THE JULY 7, 2003

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

The meeting was called to order by President Benincasa at 7:00PM. Alihassan gave the invocation and led the meeting in the Pledge of Allegiance

ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Phyllis Phillips, Mark Roller and Alex Zumbar present. Motion and second to excuse Doug Schwarz due to a prior commitment: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

MINUTES: Motion & second to receive and file the minutes of the June 16, 2003 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

COMMUNICATIONS:

Water and Sewer Department Financial Report for June 2003.

Ohio Municipal League Legislative Bulletin #20 dated June 13, 2003.

Minutes from the June 18, 2003 Alliance City Planning Commission.

Municipal Income Tax Reports for May and June 2003.

Letter from Mayor Middleton regarding the receipts collected through the Mayor’s Office during the month of June 2003 totaling $571,482.43.

Motion and second to receive and file all communications tendered to Clerk Locke. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADMINISTRATIVE REPORTS:

Mayor Middleton: absent

Safety Service Director Blaser: Reviewed Ordinances 100-03, 103-03, 104-03 and 105-03.

PUBLIC HEARING: at this time Council proceeded on with it’s scheduled Public Hearing on Ordinance 101-03 scheduled for 7:15 P.M.07/07/03.

President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Upon observing no response by any to speak in favor of the Ordinance Benincasa made three (3) calls for all those wishing to speak in opposition of the Ordinance. Upon observing no response by any to speak in opposition to the Ordinance, Benincasa declared the public hearing closed at 7:18 P.M.

Law Director Zumbar: no report

Auditor Carr: asked for action on Ordinance 101-03.

PUBLIC HEARING: at this time Council proceeded on with it’s scheduled Public Hearing on Ordinance 76-03 scheduled for 7:30 P.M.07/07/03.

President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Michael Benya, representing Thornes, explained and spoke in favor of the project. Benincasa made three (3) calls for all those wishing to speak in opposition of the Ordinance. Upon observing no response by any to speak in opposition to the Ordinance, Benincasa declared the public hearing closed at 7:34 P.M.

Ordinance 91-03: introduced by Ogline: an Ordinance to amend the Zoning Map of the City of Alliance by changing parts of outlots 195, 196, 197, 225, 234, 242, 243, 244 and 245 and part of lot 6736 located in the 1300 to 1500 blocks of South Union Avenue from one family residence district (R-1) and two family residence district (R2) to college district (C) under the Alliance City Zoning Ordinance, and declaring an emergency.

Ordinance 97-03: introduced by Schwarz: an Ordinance repealing Ordinance 69-03 and amending Ordinance 68-01 authorizing and directing the Mayor and Safety Service Director to enter into an Enterprise Zone Agreement with Stark County Board of Commissioners and Robertson Family Ventures LLC and Robertson Heating Supply Co., and declaring an emergency.

Ordinance 102-03: introduced by Zumbar: an Ordinance approving the modification of funding for the Stark County Council of Governments (SCOG) for the balance of calendar year 2003 and declaring an emergency.
