MINUTES OF THE OCTOBER 7, 2002 REGULAR MEETING OF THE ALLIANCE CITY COUNCIL The meeting was called to order by President Benincasa at 7:00PM. Phillips gave the invocation and led the meeting in the Pledge of Allegiance ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Phyllis Phillips, Mark Roller, Doug Schwarz and Alex Zumbar present. MINUTES: Motion & second to receive and file the minutes of the September 16, 2002 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Motion & second to receive and file the minutes of the September 18, 2002 special meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Motion & second to receive and file the minutes of the September 19, 2002 special meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. COMMUNICATIONS: Minutes of the September 18, 2002 Alliance City Planning Commission meeting. Ohio Municipal League Legislative Bulletin #19 dated September 20, 2002. Letter from Mayor Toni Middleton to Mark Locke, Clerk, Alliance City Council dated October 1, 2002 requesting Councils approval of his appointments to the Licensing Advisory Council. Notice from Ohio Division of Liquor Control to Police Chief Dordea, et al. Concerning liquor license application for Mangos Club Inc., dba Mangos Club, 2500 W. State Street., Alliance indicating the necessity for Council to respond to indicate whether or not they request a hearing on or before 10/31/02. Memorandum from Andrea Dordea to Alliance City Council and City Administration dated October 4, 2002. Re: financial information. Letter from Mayor Middleton regarding the receipts collected through the Mayor’s Office during the month of September 2002 totaling $672,155.95. Motion and second to approve the Mayor’s appointments to the Licensing Advisory Council. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. ADMINISTRATIVE REPORTS: Mayor Middleton: No report Safety Service Director Blaser: Reviewed Ordinances 132-02, 133-02, 134-02, 137-02, 138-02,and 141-02. Complemented all department heads for doing a good job of staying within budgets. Law Director Zumbar: stated that the City has been sued over the Sexually Oriented Business Ordinance. The Ordinance complies with all the most recent laws. Auditor Dordea: Asked that Ordinance 139-02 be withdrawn. Stated that the fire truck bonds will come due next month. He will be bringing a fund transfer ordinance to the next meeting. STANDING COMMITTEE REPORTS: Properties and Land: Alihassan: reviewed the September Property and Lands Committee meeting concerning rental housing. Streets and Alleys: Luther: stated that the North Union Avenue railroad overpass study is nearing completion and we should be receiving long and short range recommended solutions. Explained Ordinance 140-02. Planning, Zoning & Housing: Ogline: asked for action tonight on Ordinances 123-02 and 128-02. Motion and second to set a Public Hearing on Ordinance 121-02 for November 18, 2002 at 7:30 P.M. in Council Chambers. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Utilities: Phillips: asked for action tonight on Ordinances 133-02 and 134-02. Safety and Judiciary: Roller: It was moved and seconded to not request a hearing on the liquor license application for Mangos Club Inc., dba Mangos Club, 2500 W. State Street, Alliance: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Community Development: Schwarz: no report Finance: Zumbar: asked that Ordinance 141-02 be renumbered to 139-02. Spoke in favor of Ordinances 126-02, 129-02, 132-02, 133-02, 134-02, 137-02, 138-02 and 139-02. PUBLIC SPEAKS: none THIRD READINGS: Ordinance 121-02: an Ordinance to amend the zoning map of the City of Alliance by changing part of outlots 488, 489, 490 and 491 and outlots 595 and 596 located on Schubert Avenue from General Business District (B-2) to Two Family Residential District (R-2) under the Alliance City Zoning Ordinance. Ordinance 123-02: introduced by Ogline: an Ordinance accepting and approving the replat of part of lot 919 and lot 918 located on East Columbia Street in the City of Alliance, County of Stark and state of Ohio and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED SECOND READINGS: Ordinance 126-02: introduced by Zumbar: an Ordinance authorizing and directing the Director of Public Safety and Service to accept a $10,026 grant from the Stark- Tuscarawas- Wayne Joint Solid Waste Management District for the removal of tires in the City of Alliance; and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 140-02: introduced by Luther: an Ordinance authorized by Section 302a(f) of the Federal Communications Act of 1934, as amended November 22, 2000, enabling the City of Alliance to enforce certain regulations promulgated by the Federal Communications Commission pertaining to the unauthorized use of citizens band radios operating between 24MHz and 35 MHz, and illegal citizens band radio equipment which causes radio interference, amending Chapter 537 of the Codified Ordinances of the City of Alliance by adding Section 537.20 Citizens Band Harassment, and declaring an emergency.
