MINUTES OF THE NOVEMBER 18, 2002 REGULAR MEETING OF THE ALLIANCE CITY COUNCIL The meeting was called to order by President Benincasa at 7:00PM. Zumbar gave the invocation and led the meeting in the Pledge of Allegiance ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Mark Roller, Doug Schwarz and Alex Zumbar present. Motion & second to excuse Phillips: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. MINUTES: Motion & second to receive and file the minutes of the November 4, 2002 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. COMMUNICATIONS: Invitation from Alliance Fire Fighters to Alliance City Council Members to attend the Second Annual Gospel Concert on November 23, 2002 at Second Baptist Church to benefit the Alliance Fire Fighters 30th annual Toys for Tots drive. Minutes from the November 4, 2002 Water and Sewer Advisory Board meeting and agenda for their December 2, 2002 meeting. Minutes from the October 15, 2002 Board of Zoning Appeals meeting and agenda for their November 19, 2002 meeting. Notice from the Ohio Department of Commerce, Division of Liquor Control to Clerk of City Council notifying Council that all permits to sell alcoholic beverages will expire on February 1, 2003. In order to register a valid objection with the Division a Resolution, which specifies the reason for objecting, must be addressed to the Division postmarked no later than January 2, 2003. Motion and second to receive and file all communications tendered to Clerk Locke. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. ADMINISTRATIVE REPORTS: Mayor Middleton: spoke in favor of Ordinances 154-02, 155-02, 156-02, 157-02 and 158-02. Safety Service Director Blaser: He talked to the Mahoning County Board of Health about Ordinance 151-02 and they confirmed that if sanitary sewer is installed on Norman Avenue residences will have 180 days to tie into it; reviewed Ordinance 153-02. Law Director Zumbar: stated that oral arguments will begin on the SOB lawsuit on November 20, 2002; reviewed Ordinance 158-02. Auditor Dordea: reviewed Ordinance 158-02. STANDING COMMITTEE REPORTS: Properties and Land: Alihassan: no report Streets and Alleys: Luther: no report Planning, Zoning & Housing: Ogline: asked for action on Ordinance 121-02 after tonight’s public hearing. Utilities: Phillips: absent Safety and Judiciary: Roller: no report Community Development: Schwarz: asked that he be allowed to abstain on Ordinances 154-02, 155-02 and 157-02 due to a conflict of interest, motion & second to allow Schwarz to abstain: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Finance: Zumbar: spoke in favor of Ordinances 151-02, 153-02, 156-02 and 158-02; motion and second to hold special City Council meetings on November 20 & 21 at 5:30 P.M. on the second floor of the City Administration Building for consideration and/or acting on Ordinances 154-02, 155-02 and 157-02: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. PUBLIC SPEAKS: Lenzeller Stoval, 448S. Freedom Avenue, Alliance, asked the City to review how the curbs are painted on Freedom Avenue- residences no longer have space to park; drains need addressed at the intersection of Freedom and Oxford as there is standing water after every rain. THIRD READINGS: None SECOND READINGS: Ordinance 151-02: introduced by Phillips: an Ordinance authorizing and directing the Director of Public Safety and Service to extend sanitary sewer services to an area outside the city limits and currently without sewer service; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED. NEW BUSINESS: Ordinance 153-02: introduced by Zumbar: an Ordinance authorizing and directing the Director of Public Safety and Service to file an application and enter into an agreement with the Stark-Tuscarawas-Wayne Joint Solid Waste District for the purpose of acquiring grant funds through the Solid Waste Management and Recycling Program; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED. PUBLIC HEARING: at this time Council proceeded on with it’s scheduled Public Hearing on Ordinance 121-02 scheduled for 7:30 P.M.11/18/02. President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Upon observing no response by any to speak in favor of the Ordinance, Benincasa made three (3) calls for all those wishing to speak in opposition of the Ordinance. Upon observing no response by any to speak in opposition to the Ordinance, Benincasa declared the public hearing closed at 7:32 P.M. Ordinance 154-02: introduced by Ogline/Zumbar: an Ordinance authorizing the directing the Mayor and Safety Service Director to enter into an Enterprise Zone Agreement with the stark County Board of Commissioners and Winkle Industries, Inc.; and declaring an emergency. Ordinance 155-02: introduced by Ogline/Zumbar: an Ordinance authorizing the directing the Mayor and Safety Service Director to enter into an Alliance Community Reinvestment Area Agreement with Alliance Ventures, Inc.; and declaring an emergency. Resolution 156-02: introduced by Zumbar: a Resolution authorizing the Auditor of the City of Alliance, Ohio to establish Mayor’s Commission on Aging Fund and establish revenue and expenditure codes. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED. Ordinance 157-02: introduced by Zumbar/Schwarz: an Ordinance authorizing the execution of a loan agreement with respect to the proceeds derived from Urban Development Action Grants (UDAG) in the amount of $200,000 to Winkle Magnetics, Inc.; and declaring an emergency. Ordinance 158-02: introduced by Zumbar: an Ordinance authorizing the Auditor of the City to identify any interest rate swap transaction in the City’s records entered into by Alliance Community Hospital in connection with the potential issuance by the City of its revenue bonds for the benefit of Alliance Community Hospital; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED. Ordinance 121-02: an Ordinance to amend the zoning map of the City of Alliance by changing part of outlots 488, 489, 490 and 491 and outlots 595 and 596 located on Schubert Avenue from General Business District (B-2) to Two Family Residential District (R-2) under the Alliance City Zoning Ordinance. . Motion and second to adopt: Roll Call: unanimous: ADOPTED. Mayor Middleton introduced Joe Schatz of Winkle Industries, Gerard Mastroianni of Alliance Ventures and Larry Pyers Chairman of the Revolving Loan Fund Committee to discuss the Winkle Industries project. Joe gave an overview of the company, Gerard explained that Alliance Ventures will own the land and lease it to Winkle Industries and Larry reviewed the report from the Revolving Loan Fund Committee which met on October 29, 2002 to approve a $200,000 loan to Winkle.
