MINUTES OF THE MAY 6, 2002 REGULAR MEETING OF THE ALLIANCE CITY COUNCIL The meeting was called to order by President Benincasa at 7:00PM. Alihassan gave the invocation and led the meeting in the Pledge of Allegiance ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Phyllis Phillips, Mark Roller, Doug Schwarz and Alex Zumbar present. MINUTES: Motion & second to receive and file the minutes of the April 15, 2002 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Motion & second to receive and file the minutes of the April 24, 2002 special meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS COMMUNICATIONS: Water and Sewer Department Financial Report for April 2002. Ohio Municipal League Legislative Bulletin #12 dated April 12, 2002. Minutes of the Treasury Investment Board meeting of April 18, 2002. Minutes from the Alliance City Planning Commission meeting of April 17, 2002 Ohio Municipal League Legislative Bulletin #12 dated April 19, 2002. Transcript of Councilman Sammeh Alihassan’s statement from the April 15, 2002 City Council meeting. Ohio Municipal League Legislative Bulletin #14 dated April 29, 2002. Letter from James McClarren to Mayor Middleton, Safety Service Director Blaser, Water & Sewer Advisory Board and members of City Council dated April 30, 2002. Re: Delinquency Report as of April 30, 2002. Letter from Mayor Middleton regarding the receipts collected through the Mayor’s Office during the month of April 2002 totaling $559,413.12. Motion and second to receive and file all communications tendered to Clerk Locke MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. ADMINISTRATIVE REPORTS: Mayor Middleton: presented Resolution 58-02 to Alliance Police Reserve Officer Benjamin McGaffick commending him for his years of service. Presented Resolution 56-02 to retiring Fire Chief Jack Weaver commending him for his years of service. Motion and second to adopt Resolution 56-02: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Safety Service Director Blaser: reviewed and asked for action on the following Ordinances: 59-02, 60-02, 62-02, 63-02, 65-02, 66-02, 67-02 and 68-02. Law Director Zumbar: told Council of a lawsuit filed in Alliance Municipal Court for damages NTE $15,000 for injuries received in a City Park, no details are known at this time; explained and asked for action on Ordinance 59-02. Auditor Dordea: reviewed Ordinance 59-02 and submitted the letter of transmittal accepting the annexation. STANDING COMMITTEE REPORTS: Properties and Land: Alihassan: no report Streets and Alleys: Luther: asked for action on Ordinance 24-02 and that Ordinance 64-02 be referred to Planning Commission. Planning, Zoning & Housing: Ogline: Spoke in favor of Ordinance 59-02. Utilities: Phillips: Spoke of the electrical savings at the Wastewater Treatment Plant do to new operating procedures. Safety and Judiciary: Roller: discussed the April 30, 2002 Safety and Judiciary meeting, they recommend approval on Ordinance 50-02. Community Development: Schwarz: spoke in favor of Ordinances 46-02, 59-02, 62-02, 63-02 and 67-02. Finance: Zumbar: spoke in favor of Ordinances 24-02, 59-02, 60-02, 62-02, 63-02, 65-02, 66-02, 67-02 and 68-02. PUBLIC SPEAKS: David Lundgren, 526 E. Main Street, Alliance: spoke in favor of Ordinance 62-02. Special Report: President introduced Larry Pyers, Chairman of the UDAG Revolving Loan Committee, reviewed Ordinance 63-02 and stated the Committee recommends adoption. THIRD READINGS: None SECOND READINGS Ordinance 46-02: introduced by Schwarz: an Ordinance allocating five thousand dollars ($5,000.00) per year to the Alliance Area Development Foundation for a period of three years, commencing in 2002, for purposes of underwriting the cost of business development activities in the City of Alliance; and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 50-02: introduced by Roller: an Ordinance amending Chapter 303.99(e) "Fines and Penalties for Parking Violations", of the Codified Ordinances of the City of Alliance, Ohio. Motion and second to amend Section 1 to read if full payment is received in five (5) business days: Rule Call; unanimous for amendment. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 53-02: introduced by Council as a Whole: an Ordinance authorizing and directing the Mayor to enter into a Cooperative Economic Development Agreement with Washington Township in accordance with the terms and provisions on attached exhibit "A"; and declaring an emergency.
