MINUTES OF THE MAY 20, 2002 REGULAR MEETING OF THE ALLIANCE CITY COUNCIL The meeting was called to order by President Benincasa at 7:00PM. Luther gave the invocation and led the meeting in the Pledge of Allegiance ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Phyllis Phillips, Mark Roller, Doug Schwarz and Alex Zumbar present. MINUTES: Motion & second to receive and file the minutes of the May 6, 2002 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. COMMUNICATIONS: Minutes from the May 6, 2002 Water and Sewer Advisory Board meeting and notice of their June 3, 2002 meeting. Notice of Final Appealable Order in the Mary Beth Hunter case dated May 8, 2002. Minutes from the April 16, 2002 Board of Zoning Appeals meeting and the agenda for their May 21, 2002 meeting. Notice from Ohio Division of Liquor Control to Police Chief Dordea, et al. Concerning transfer of liquor license from J&S Vitale Inc. dba Village Corner Shopper, 2100 Parkway Blvd. to Fred Shonk Jr. dba Carnation Drive Thru, 72 E. Rosenberry indicating the necessity for Council to respond to indicate whether or not they request a hearing on or before 02/04/02. Letter from Ohio EPA dated May 13, 2002 to Mr. Mike Dreger, Superintendent, City of Alliance Water Utilities. Re: results of Sanitary Survey of the Westville Lake Campground public water system. Minutes from the May 15, 2002 Alliance City Planning Commission meeting. Motion and second to receive and file all communications tendered to Clerk Locke MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. ADMINISTRATIVE REPORTS: Mayor Middleton: No Report Safety Service Director Blaser: Announced that the bids for the garbage contract are out and bid opening is May 31, 2002. Passed out an attachment for Ordinance 69-02 and asked that Council take action tonight. Explained Ordinance 70-02 and passed out a new Ordinance 71-02. Law Director Zumbar: announced that there may be an amendment required on the original Ordinance for the Industrial Revenue Agreement for Carnation Mall. Auditor Dordea: Reviewed the Auditor’s Report for the month ended April 30, 2002, the Operational Budget Report by Department through April 30, 2002, the General Fund Revenue Report by Major Category through April 30, 2002 and the Cumulative Income Tax Comparison. STANDING COMMITTEE REPORTS: Properties and Land: Alihassan: asked for action on Ordinance 69-02. Streets and Alleys: Luther: asked that no action be taken on Ordinance 64-02 tonight. Planning, Zoning & Housing: Ogline: asked for action tonight on Ordinance 61-02 and explained Ordinance 71-02. Utilities: Phillips: No report. Safety and Judiciary: Roller: Roller moved to have Clerk notify Ohio Division of Liquor Control that no hearing is requested on the transfer of liquor license from J&S Vitale Inc. dba Village Corner Shopper, 2100 Parkway Blvd. to Fred Shonk Jr. dba Carnation Drive Thru, 72 E. Rosenberry. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Community Development: Schwarz: No report Finance: Zumbar: spoke in favor of Ordinances 69-02 and 70-02. PUBLIC SPEAKS: Lydia Hart, 221 Florence Ave., Alliance – thanked the Administration and Council for the Citizen’s Police Academy. She felt it was an excellent program. Lenzeller Stovall, 448 S. Freedom Ave., Alliance – had a complaint on how the low-income housing was being administered. Frank Perrine, 1530 W. Alden, Alliance- was concerned with the zoning outlined in Ordinance 71-02. Larry Close, 540 N. Union Ave., Alliance- was concerned that Union Avenue would have to be closed when changes are made to the railroad overpass. THIRD READINGS: None SECOND READINGS Ordinance 61-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 6581 and 6582 located on West Main Street in the City of Alliance, County of Stark and State of Ohio and declaring an emergency. Motion and second to suspend rules: Rule Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 64-02: introduced by Luther: an Ordinance vacating the east west alley between Clark Avenue and Miller Avenue and the north south alley between West State Street and Chestnut Street in the City of Alliance. NEW BUSINESS Ordinance 69-02: introduced by Zumbar/Alihassan: an Ordinance determining that the City of Alliance has items of personal property which are not needed for municipal purposes which exceed $1,000 in estimated value, authorizing the sale of such personal property by written contract to the highest and best bidder at public sale by the Director of Public Safety and Service and including in said public sale, personal property as designated by the Alliance Board of Park Commissioners and Alliance City Board of Health; and declaring an emergency. Motion and second to suspend rules: Rule Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 70-02: introduced by Zumbar/Phillips: an Ordinance amending Ordinance 38-02 authorizing and directing the Director of Public Safety and Service to enter into a contract for the purpose of purchasing a new bucket truck for the Distribution Department through the Cooperative Purchasing Programs of the Ohio Department of Transportation or the Ohio Department of Administrative Services or to advertise for bids and enter into a contract with another vendor at the lowest and best price, but for a cost not to exceed $115,000 in any case and declaring an emergency. Motion and second to suspend rules: Rule Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 71-02: introduced by Ogline: an Ordinance to amend the Zoning Map of the City of Alliance by zoning property located on the east side of South Mahoning Avenue between East State Street and Lake Park Boulevard that was annexed to the City of Alliance from Smith Township of Mahoning County without zoning from unzoned to two family residence district (B2), and light industrial district (I1) under the Alliance City Zoning Ordinance. Motion and second to refer to Planning, Zoning and Housing Committee and the Planning Commission. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Ordinance 72-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 143 through 146, 3588, 3589, 4800, and 4801 and vacated alleys located between Clark Avenue and Miller Avenue and between West State Street and Chestnut Street in the City of Alliance, County of Stark and State of Ohio, and declaring an emergency. Motion and second to refer to the Planning Commission. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.
