MINUTES OF THE MARCH 18, 2002

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

The meeting was called to order by President Benincasa at 7:00PM. Roller gave the invocation and led the meeting in the Pledge of Allegiance

ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Phyllis Phillips, Mark Roller, Doug Schwarz and Alex Zumbar present.

MINUTES: Motion & second to receive and file the minutes of the March 4, 2002 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

COMMUNICATIONS:

    1. Water and Sewer Department Financial Report for February 2002.
    2. Minutes from the March 4, 2002 Water and Sewer Advisory Board meeting and the agenda for their April 1, 2002 meeting.
    3. Ohio Municipal League Legislative Bulletin #8 dated March 1, 2002.
    4. Letter from the U.S. Department of Housing and Development, Ohio State Office dated March 1, 2002. Re: 2000 Consolidated Plan. Alliance met all program thresholds for the 2000 program year.
    5. Ohio Municipal League Legislative Bulletin #9 dated March 8, 2002.

Motion and second to receive and file all communications tendered to Clerk Locke MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADMINISTRATIVE REPORTS:

Mayor Middleton: No report

Safety Service Director Blaser: reported that the budget is prepared and asked that Council adjourn into executive session after the regular meeting; asked for action tonight on Ordinance 34-02, no action on Ordinances 17-02 and 35-02.

Law Director Zumbar: Asked to discuss the City vs. Hunter case in executive session.

Motion and second to adjourn into executive session after the regular meeting to discuss personnel and pending litigation. Council members, Council President, Council Clerk, Mayor, Safety Service Director, Law Director and Auditor to be present. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Ordinance 27-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 11918, 11919 and part of lot 8161 located on West Main Street in the City of Alliance, County of Stark and State of Ohio. Motion and second to refer to Planning Commission. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Ordinance 28-02: introduced by Zumbar: an Ordinance authorizing and directing the Safety Service Director and Auditor to pay the sum of #9,385.53 to Norman L. Retterer; and declaring an emergency. Motion and second to refer to Finance and Safety/Judiciary Committees. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Ordinance 29-02: introduced by Alihassan: an Ordinance authorizing issuance of Oil and Gas Drilling and Operating Permits to D. Anderson Corp. for the Alliance High School unit #4D well; and declaring an emergency. Motion and second to allow Councilman Ogline to abstain from voting on Ordinances 29-02 and 31-02. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Motion and second to suspend rules: Rule Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: 5-1(Phillips). ADOPTED

Ordinance 30-02: introduced by Zumbar/ Alihassan: an Ordinance authorizing and directing the Director of Public Safety and Service to execute a non-development oil and gas lease for Alliance High School unit well 4D; and declaring an emergency. Motion and second to suspend rules: Rule Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED

Ordinance 31-02: introduced by Alihassan: an Ordinance authorizing issuance of Oil and Gas Drilling and Operating Permits to D. Public Hearing: at this time Council proceeded on with it’s scheduled Public Hearing on Ordinance 13-02 scheduled for 7:30 P.M.03/18/02.

President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Bayan Alihassan, 623 W. State Street spoke in favor of the Ordinance; Benincasa made three (3) calls for all those wishing to speak in opposition of the Ordinance. Upon observing no response by any to speak in opposition to the Ordinance, Benincasa declared the public hearing closed at 7:33 P.M.

Ordinance 32-02: introduced by Zumbar/ Alihassan: an Ordinance authorizing and directing the Director of Public Safety and Service to execute a non-development oil and gas lease for Alliance High School unit well 5D; and declaring an emergency. Motion and second to suspend rules: Rule Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: 6-1 (Phillips). ADOPTED

Ordinance 33-02: introduced by Zumbar: an Ordinance making appropriations for 2002 for the General Fund, Water Fund, Sewer Fund, and other City funds and authorizing the Auditor to draw his warrants for payment of any appropriations upon receiving proper certificates and vouchers; and declaring an emergency.

Ordinance 34-02: introduced by Zumbar/Roller: an Ordinance authorizing and directing the Director of Public Safety and Service to submit a grant application on behalf of the Alliance Fire Department to the Federal Emergency Management Agency (FEMA) not to exceed the amount of $10,630, and if awarded the grant, to enter into a contract to purchase training materials and subscription service for the Fire and Emergency Training Network; and declaring an emergency. Motion and second to suspend rules: Rule Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED

OLD BUSINESS

Ordinance 13-02: introduced by Luther: an Ordinance vacating the north south alley south of Hartshorn Street being the second fifteen foot north south alley between Hartshorn Street and the north boundary of a fifteen foot east west alley south of Hartshorn Street and west of McKinley Avenue for a distance of approximately one hundred twenty feet. Motion and second to adopt: Roll Call: unanimous: ADOPTED

Ordinance 14-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 3659 and 3660 and a vacated alley located on Hartshorn Street in the City of Alliance, County of Stark and State of Ohio. Motion and second to adopt: Roll Call: unanimous: ADOPTED

MISCELLANEOUS BUSINESS

Motion and second to schedule a Special Session of City Council on March 27, 2002 at 5:00 p.m. in the second floor conference room of the City Administration Building to discuss and/ or act on Ordinance 33-02 and any other business which Council has the authority to decide. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADJOURNMENT: Noting no further business to come before this Council, President Benincasa adjourned the meeting into Executive Session at 7:44 p.m.
