MINUTES OF THE MARCH 4, 2002

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

City Council was moved to the Firehouse Theatre. The wheel chair lift was not working at City Hall.

The meeting was called to order by President Benincasa at 7:00PM. Phillips gave the invocation and led the meeting in the Pledge of Allegiance

ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Phyllis Phillips, Mark Roller, Doug Schwarz and Alex Zumbar present.

MINUTES: Motion & second to receive and file the minutes of the February 19, 2002 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Motion & second to receive and file the minutes of the February 19, 2002 work session of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

COMMUNICATIONS:

    1. Letter from Mayor Toni Middleton to Department Heads and Elected Officials dated February 12, 2002. Re: Records custodian.
    2. Ohio Municipal League Legislative Bulletin #6 dated February 15, 2002.
    3. Letter from Ohio EPA to Mayor and Council dated February 19, 2002. Re: Public notice for NPDES Permit for Marlington Local Schools.
    4. Letter from John Blaser, Director of Public Safety and Service, to Michael Ogline, Councilman at Large and Mark Locke, Council Clerk dated February 20, 2002. Re: Planning Commission approval of Ordinance 07-01.
    5. Minutes from the February 20, 2002 Alliance City Planning Commission meeting.
    6. Ohio Municipal League Legislative Bulletin #7 dated February 22, 2002.
    7. Letter from John N. Teeple to Alliance City Council dated February 25, 2002. Re: Expressing his disappointment in the defeat of Resolution 18-02.
    8. Letter from Mayor Toni Middleton to City of Alliance Employees dated February 25, 2002. Re: Condition of City finances.
    9. Notice from Ohio Division of Liquor Control to Police Chief Dordea, et al. Concerning transfer of liquor license from Strike Line Corp., DBA College Plaza Lanes, 1425 S. Mahoning, Alliance to Durbin College Plaza Lanes LLC, DBA College Plaza Lanes, 1425 S. Mahoning, Alliance indicating the necessity for Council to respond to indicate whether or not they request a hearing on or before 03/28/02.
    10. Letter from Mayor Middleton regarding the receipts collected through the Mayor’s Office during the month of January 2002 totaling $603,150.55

Motion and second to receive and file all communications tendered to Clerk Locke MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADMINISTRATIVE REPORTS:

Mayor Middleton: the Mayor gave his State of the City address (copy included in communications).

Safety Service Director Blaser: reviewed a proposal he received from Will Dent of ABCD to keep the taxi service in Alliance; spoke in favor of the following Ordinances: 17-02- no action tonight, 23-02, 25-02- asked for action tonight, 26-02.

Law Director Zumbar: no report

Auditor Dordea: reviewed the monthly Auditor’s Report and reviewed the different fund types (copy included in communications).

STANDING COMMITTEE REPORTS:

Utilities: Phillips: reviewed the Water and Sewer Advisory Board meeting from this morning; asked for action tonight on 26-02.

Streets and Alleys: Luther: asked Council to set a Public Hearing on Ordinance 24-02 for April 15, 2002 at 7:45 P.M. in Council Chambers. Motion was made and seconded for the Public Hearing: Roll Call: unanimous: APPROVED.

Community Development: Schwarz: No report

Properties and Land: Alihassan: No report

Safety and Judiciary: Roller: Roller moved to have Clerk notify Ohio Division of Liquor Control that a hearing on the liquor license transfer from College Plaza Lanes. was not requested. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Asked for action tonight on Ordinance 23-02.

Planning, Zoning & Housing: Ogline: Asked for action on Ordinances No.’s 10-02, 012-02 & 20-02; reviewed and asked that a Public Hearing be set for April 15, 2002 at 7:30 P.M. in Council Chambers. Motion was made and seconded for the Public Hearing: Roll Call: unanimous: APPROVED.

 

Finance: Zumbar: Asked for action on Ordinances 21-02, 22-02, 23-02 25-02 and 26-02.

* Per a change in the Ohio Revised Code roll call on Ordinances can now be done with a simple call of yea or nay.

Ordinance 10-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 6048 through 6051 and part of Outlot 16 located on North Union Avenue in the City of Alliance, County of Stark and State of Ohio, and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED

Ordinance 11-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 12651 and 12652 located on Dogwood Trail in the City of Alliance, County of Stark and State of Ohio.

Ordinance 12-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 6904 and 6905 and lots 10593 through 10596 located on South Arch Avenue in the City of Alliance, County of Stark and State of Ohio, and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED

Ordinance 13-02: introduced by Luther: an Ordinance vacating the north south alley south of Hartshorn Street being the second fifteen foot north south alley between Hartshorn Street and the north boundary of a fifteen foot east west alley south of Hartshorn Street and west of McKinley Avenue for a distance of approximately one hundred twenty feet.

Ordinance 14-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 3659 and 3660 and a vacated alley located on Hartshorn Street in the City of Alliance, County of Stark and State of Ohio.

Ordinance 17-02: introduced by Zumbar: an Ordinance setting wages and benefits for City employees while on military duty; and declaring an emergency.

Ordinance 20-02: introduced by Ogline: an Ordinance accepting and approving the replat of lot 2374, outlots 203 through 205, and part of outlot 202 located on South Union Avenue in the City of Alliance, County of Stark and State of Ohio. Ordinance 21-02: introduced by Council as a Whole: an Ordinance authorizing and recommending to the Stark County Commissioners the termination of the tax abatement agreements with Chatwin's Group, Inc. DBA Alliance Machine and Patriot Forge; and declaring an emergency. Motion and second to suspend rules: Roll Call: unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED.

Ordinance 22-02: introduced by Council as a Whole: an Ordinance authorizing and recommending to the Stark County Commissioners the continuance of the tax abatement agreements with American Steel Foundries and Robertson Heating and Supply; and declaring an emergency. Motion and second to suspend rules: Roll Call: unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED.

Ordinance 23-02: introduced by Roller: an Ordinance ratifying an agreement to the contract with the Teamsters Local No. 92, Police Patrolmen’s Bargaining Unit of the Alliance Police Department, (hereinafter the "Union"); and declaring an emergency. Ordinance 25-02: introduced by Zumbar/ Alihassan: an Ordinance authorizing and directing the Director of Public Safety and Service to request qualifications for and enter into a professional services contract with a qualified professional engineering firm for design services for a new bridge at Kidwell Lake in Silver Park in an amount not to exceed $24,000; and declaring an emergency. Ordinance 26-02: introduced by Zumbar/ Phillips: an Ordinance authorizing and directing the Director of Public Safety and Service to request qualifications for and enter into a professional services contract with a qualified professional engineering firm for design services for repairs to the #2 digester at the Wastewater Treatment Plant in an amount not to exceed #36,000; and declaring an emergency.
