MINUTES OF THE JUNE 3, 2002 REGULAR MEETING OF THE ALLIANCE CITY COUNCIL The meeting was called to order by President Benincasa at 7:00PM. Ogline gave the invocation and led the meeting in the Pledge of Allegiance ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Phyllis Phillips, Mark Roller, Doug Schwarz and Alex Zumbar present. MINUTES: Motion & second to receive and file the minutes of the May 20, 2002 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. COMMUNICATIONS: Alliance Municipal Income Tax Comparative Recapitulation of 2002 to 2001. Ohio Municipal League Legislative Bulletin #15 dated May 17, 2002. Notice from Ohio Division of Liquor Control to Police Chief Dordea, et al. Concerning liquor license application for Speedway Super America, LLC, dba Rich Oil #3769, 642 E. State Street, Alliance indicating the necessity for Council to respond to indicate whether or not they request a hearing on or before 06/17/02. Thank you from Mary Beth Hunter for Council’s endorsement of the SARTA issue. Notice of Hearing from the Ohio Division of Liquor Control for the renewal of permit for Shelly R. Bartlett, dba Dukes Place, 760 E. Oxford Street. Hearing will be held on June 19, 2002, 11:30 a.m., at Canton City Hall, 218 Cleveland Avenue SW. Ohio Municipal League Legislative Bulletin #16 dated May 24, 2002. ADMINISTRATIVE REPORTS: Mayor Middleton: No Report Safety Service Director Blaser: Reviewed and asked for action tonight on Ordinances 76-02 and 77-02; reviewed Ordinance 78-02; explained that Ordinance 79-02 will save the City approximately 25% on road salt; reviewed and asked for action on Ordinances 82-02 and 83-02. Law Director Zumbar: reviewed Ordinance 81-02 and tendered the back-up documentation to the Clerk to receive and file. It was moved and seconded to receive and file the documentation: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Auditor Dordea: reviewed the Cumulative Income Tax Comparison and History of Medical Claims Report. (Copy included in communication). Planning, Zoning & Housing: Ogline: Reviewed the Planning, Zoning & Housing Committee meeting of May 23, 2002. The Committee recommends adoption of Ordinances 71-02 and 81-02. Stated that the committee did receive evidence of the effects of a sexually oriented business on the community. Moved that a public hearing on Ordinance 81-02 be set for July 1, 2002 at 7:30 p.m.: second: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Utilities: Phillips: reported that the Water Sewer Advisory Board toured the Sewer Treatment Plant this morning and will tour the Water Treatment Plant next meeting. Spoke in favor of Ordinance 78-02. Safety and Judiciary: Roller: Roller moved to have Clerk notify Ohio Division of Liquor Control that a hearing on the liquor license application from Speedway Super America, LLC, dba Rich Oil #3769, 642 E. State Street, Alliance be requested in Canton due to the close proximally to a park. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Community Development: Schwarz: Recommended adoption of Ordinances 76-02 and 77-02. Finance: Zumbar: spoke in favor of Ordinances 78-02 and 80-02. PUBLIC SPEAKS: John Minear, Waste Management of Ohio, 1700 N. Broad St., Fairborn, Ohio: Waste Management’s bid on the refuse contract. Jim Coffey, J&J Refuse, 3596 SR 39 NW, Dover, Ohio: J&J’s
bid on the refuse contract. Hope Crow, 253 E. Main St., Alliance: asked that she be permitted to use chasing lights around her business sign- she was referred to the Board of Zoning Appeals. THIRD READINGS: Ordinance 64-02: introduced by Luther: an Ordinance vacating the east west alley between Clark Avenue and Miller Avenue and the north south alley between West State Street and Chestnut Street in the City of Alliance. SECOND READINGS Ordinance 71-02: introduced by Ogline: an Ordinance to amend the Zoning Map of the City of Alliance by zoning property located on the east side of South Mahoning Avenue between East State Street and Lake Park Boulevard that was annexed to the City of Alliance from Smith Township of Mahoning County without zoning from unzoned to two family residence district (B2), and light industrial district (I1) under the Alliance City Zoning Ordinance Ordinance 72-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 143 through 146, 3588, 3589, 4800, and 4801 and vacated alleys located between Clark Avenue and Miller Avenue and between West State Street and Chestnut Street in the City of Alliance, County of Stark and State of Ohio, and declaring an emergency NEW BUSINESS Ordinance 73-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 3342 through 3344 located on South Union Avenue in the City of Alliance, County of Stark and State of Ohio, and declaring an emergency. Ordinance 76-02: introduced by Schwarz: an Ordinance authorizing the City of Alliance to enter into an agreement with the County of Stark, Ohio, and the City of Massillon for the purpose of continuing the participation of the City of Alliance in the Stark County Home Ownership Made Easy (HOME) Consortium for the period of FY2003-2005 and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 77-02: introduced by Schwarz: an Ordinance changing the position of Director for the Office of Planning and Development from 35 hours per week to 40 hours per week to supervise HOME Consortium work; and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 78-02: introduced by Zumbar/Phillips: an Ordinance amending Ordinance 19-02 an Ordinance authorizing and directing the Director of Public Safety and Service to advertise for bids and enter into contracts for the construction of influent screening improvements at the Wastewater Treatment Plant in an amount not to exceed $460,000; and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 79-02: introduced by Zumbar/Luther: an Ordinance authorizing and directing the Director of Public Safety and Service to enter into an agreement to participate in the Ohio Department of Transportation’s contract for the purchase of sodium chloride, and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 80-02: introduced by Zumbar: an Ordinance making appropriations and transfers of funds to provide for necessary expenses and adjustments; and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 81-02: introduced by Ogline: an Ordinance providing for the licensing and regulation of sexually oriented businesses and employees. Adopting Alliance Codified Ordinance Chapter 764 et seq.; and declaring an emergency. Ordinance 82-02: introduced by Council as a Whole: an Ordinance authorizing and directing the Director of Public Safety and Service to enter into a contract for residential refuse pick-up and disposal service, and declaring an emergency. After much discussion a motion and second to suspend the rules was made: Rule Call: Unanimous for rules suspension. No other action was taken. Ordinance 83-02: introduced by Council as a Whole: an Ordinance ratifying a contract with the Alliance Professional Fire Fighters Association Local No. 480 (AFL-CIO), and declaring an emergency. .
