MINUTES OF THE JULY 1, 2002

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

 

The meeting was called to order by President Benincasa at 7:00PM. Roller gave the invocation and led the meeting in the Pledge of Allegiance

ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Phyllis Phillips, Mark Roller, Doug Schwarz and Alex Zumbar present.

MINUTES: Motion & second to receive and file the minutes of the June 17, 2002 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

COMMUNICATIONS:

Notice from Ohio Division of Liquor Control Re: The hearing scheduled for June 19, 2002 for the Speedway SuperAmerica LLC application has been cancelled. The application was cancelled.

Notice from Ohio Division of Liquor Control to Police Chief Dordea, et al. Concerning liquor license application from Haethem F. Abdlrasul, DBA Mom’s Drive Thru indicating the necessity for Council to respond to indicate whether or not they request a hearing on or before 07/18/02.

Minutes from the June 19, 2002 Alliance City Planning Commission meeting.

Letter from Mayor Middleton regarding the receipts collected through the Mayor’s Office during the month of June 2002 totaling $607,396.93.

Motion and second to receive and file all communications tendered to Clerk Locke MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADMINISTRATIVE REPORTS:

Mayor Middleton: Absent

Safety Service Director Blaser: Acknowledged Jim Reese as the new Alliance City Fire Chief; explained and asked for action tonight on Ordinances 95-02 & 96-02; explained Ordinances 97-02 & 98-02.

PUBLIC HEARING: at this time Council proceeded on with it’s scheduled Public Hearing on Ordinance 91-02 scheduled for 7:15 P.M.07/1/02.

President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Upon observing no response by any to speak in favor of the Ordinance, Benincasa made three (3) calls for all those wishing to speak in opposition of the Ordinance. Upon observing no response by any to speak in opposition to the Ordinance, Benincasa declared the public hearing closed at 7:18 P.M.

Law Director Zumbar: reported on the hearing for the Rich Oil liquor license-THE City opposed the application- the commission is taking it under advisement; passed out Ordinance 100-02 for the MLM annexation; advised that Council amend Ordinance 81-02- Section 5 paragraph A7- take out "or parcel of real estate used for residential purposes."- add "(R1, R2, R3, R4 & R5). There was a motion and second to amend the Ordinance as recommended: Roll Call: unanimous: ADOPTED

Auditor Dordea: absent- Assistant Auditor Bob Kitoe read a letter turning over the transcript of proceedings on the MLM annexation. There was a motion and second to receive and file the documents: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

STANDING COMMITTEE REPORTS:

Properties and Land: Alihassan: No report

Streets and Alleys: Luther: asked for action tonight on Ordinance 97-02.

PUBLIC HEARING: at this time Council proceeded on with it’s scheduled Public Hearing on Ordinance 81-02 scheduled for 7:30 P.M.07/1/02.

President Benincasa made three (3) calls for all those wishing to speak in favor of the Ordinance. Dave Mitchell, 700 W. Beech St., Alliance and Steve Carlisle, 861 Grace, Alliance both spoke in favor of the Ordinance and felt it needed to be passed tonight. Benincasa made three (3) calls for all those wishing to speak in opposition of the Ordinance. Upon observing no response by any to speak in opposition to the Ordinance, Benincasa declared the public hearing closed at 7:38 P.M.

Planning, Zoning & Housing: Ogline: asked for action tonight on Ordinances 81-02, 71-02, 73-02, 74-02 & 75-02. Asked that Ordinance 94-02 be referred to Planning Commission.

Utilities: Phillips: reported that there was no quorum at this morning’s Water- Sewer Advisory Board meeting. The plant tour was cancelled.

Safety and Judiciary: Roller: asked for action tonight on Ordinances 95-02 & 96-02.

Community Development: Schwarz: spoke in favor of Ordinance 100-02.

Finance: Zumbar: spoke in favor of Ordinances 98-02 and 99-02.

Ordinance 73-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 3342 through 3344 located on South Union Avenue in the City of Alliance, County of Stark and State of Ohio, and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED.

Ordinance 74-02: introduced by Ogline: an Ordinance accepting and approving the replat of part of lot 10050 and lot 10051 located on Parkway Boulevard in the City of Alliance, County of Stark and State of Ohio, and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED.

Ordinance 75-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 7745 and 7746 located on Buckeye Avenue in the City of Alliance, County of Stark and State of Ohio. Motion and second to adopt: Roll Call: unanimous: ADOPTED.

Ordinance 71-02: introduced by Ogline: an Ordinance to amend the Zoning Map of the City of Alliance by zoning property located on the east side of South Mahoning Avenue between East State Street and Lake Park Boulevard that was annexed to the City of Alliance from Smith Township of Mahoning County without zoning from unzoned to two family residence district (B2), and light industrial district (I1) under the Alliance City Zoning Ordinance.
