MINUTES OF THE DECEMBER 16, 2002

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

The meeting was called to order by President Benincasa at 7:00PM. Luther gave the invocation and led the meeting in the Pledge of Allegiance

ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Phyllis Phillips Mark Roller, Doug Schwarz and Alex Zumbar present.

MINUTES: Motion & second to receive and file the minutes of the December 2, 2002 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Motion & second to receive and file the minutes of the December 5, 2002 special meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

COMMUNICATIONS:

Water and Sewer Department Financial Report for November 2002.

Minutes of the December 2, 2002 Water and Sewer Advisory Board meeting and notice of their January 6, 2003 meeting.

Memorandum dated December 2, 2002 from Andrei Dordea to Joe Amabeli, Mike Dreger, Dan McGannon and Jeff Porter. Re: 2002 physical inventory.

Memorandum dated December 2, 2002 from Andrei Dordea to all department heads. Re: 2002 year-end closing.

Minutes of the December 4, 2002 Alliance City Planning Commission meeting.

Letter from the Ohio EPA to Mayor and Council, City of Alliance dated December 6, 2002. Re: Inspection of Alliance POTW.

Minutes from the November 19, 2002 Board of Zoning Appeals meeting and agenda for their December 17, 2002 meeting.

Letter from Mayor Toni Middleton to R. Mark Locke dated December 16, 2002 asking Council to approve the following commission appointments: Mr. Donald Kline- Alliance City Planning Commission; Mr. Richard Burton, Mr. Larry Pyers, and Mr. Vince Obman- Revolving Loan Commission; Mr. Eugene Thurman- Alliance Board of Park Commissioners.

Memo from Andrei Dordea, City Auditor dated December 16, 2002. Re: pre-audit conference for 2002 single audit of the City of Alliance on December 19, 2002 at 3:00 P.M.

Motion and second to receive and file all communications tendered to Clerk Locke. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

ADMINISTRATIVE REPORTS:

Mayor Middleton: Thanked Council for all their work in 2002; spoke in favor of Ordinances 164-02, 166-02, 167-02; announced the first meeting of the Comprehensive Land Use Committee on December 18, 2002 at 3:00; announced that the County Commissioners will be meeting on December 19, 2002 to approve the enterprise zone for Winkle; invited all to attend the community tree dedication on December 20, 2002 at 7:30 P.M.

Safety Service Director Blaser: reviewed Ordinances 168-02and 172-02 and thanked all department heads for staying within their budgets in 2002.

Law Director Zumbar: reviewed Ordinances 168-02 and 171-02.

Deputy Auditor Kittoe: reviewed the operational budget and Ordinance 172-02.

STANDING COMMITTEE REPORTS:

Properties and Land: Alihassan: no report

Streets and Alleys: Luther: Motion and second to have a Public Hearing for Ordinance 163-02 on February 3, 2002 at 7:30 P.M. in City Council Chambers; MOTION PASSED.

Planning, Zoning & Housing: Ogline: asked for action tonight on Ordinances 162-02 and 164-02.

Utilities: Phillips: no report

Safety and Judiciary: Roller: reported that the Safety and Judiciary Committee met and are introducing Ordinance 171-02 tonight and explained the reasoning.

Community Development: Schwarz: spoke in favor of Ordinances 166-02 and 167-02.

Finance: Zumbar: announced the Finance Committee will meet on December 19, 2002 at 4:30 P.M. to review the Trial Balance Statements; spoke in favor of Ordinances 161-02, 164-02, 166-02, 167-02, 168-02, 169-02, 170-02 and 171-02.

SPECIAL REPORT:

Mayor Middleton introduced Tom Liber of Ingenium Packaging who reviewed the plans for their new plant to be built in Commerce Park.

THIRD READINGS:

Ordinance 161-02: introduced by Zumbar: an Ordinance making temporary appropriations for 2003 for the General Fund, Water Fund, Sewer Fund and other City funds, and authorizing the Auditor to draw payments from those appropriations upon receiving proper certificates and vouchers; and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED

SECOND READINGS:

Ordinance 159-02: introduced by Alihassan: an Ordinance adopting Alliance Codified Ordinance Section 361.01 ET. SEG. "Residential Parking Permit" and declaring an emergency.

NEW BUSINESS:

Ordinance 162-02: introduced by Ogline: an Ordinance accepting and approving the replat of part of outlots 504, 587 and 588 located on West Main Street in the City of Alliance, County of Stark and State of Ohio, and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED

Ordinance 163-02: introduced by Luther: an Ordinance vacating part of the east west alley west of Haines Avenue for a distance of approximately two hundred forty three feet and declaring an emergency. Motion and second to refer to Planning Commission: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Date of the Public Hearing was changed from February 3, 2003 to January 21, 2003.

Ordinance 164-02: introduced by Ogline: an Ordinance authorizing and directing the Director of Public Safety and Service of the City of Alliance to enter into a contract with the Stark County Regional Planning Commission to provide fair housing services to the City of Alliance, and declaring an emergency. Ordinance 165-02: introduced by Ogline: an Ordinance accepting and approving the replat of part of outlots 504 and 587 located on West Main Street in the City of Alliance, County of Stark and State of Ohio.
