MINUTES OF THE AUGUST 5, 2002 REGULAR MEETING OF THE ALLIANCE CITY COUNCIL The meeting was called to order by President Benincasa at 7:00PM. Zumbar gave the invocation and led the meeting in the Pledge of Allegiance ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Mark Roller, Doug Schwarz and Alex Zumbar present. MINUTES: Motion & second to receive and file the minutes of the July 15, 2002 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. COMMUNICATIONS: Auditor’s reports through May 31, 2002. Auditor’s reports through June 30, 2002 Letter from Ohio Division of Liquor Control dated July 16, 2002. Re: 50% of licensing fee distributed. Minutes from the July 17, 2002 Alliance City Planning Commission meeting. Letter from Mayor Toni Middleton to Clerk Mark Locke dated July 18, 2002 asking Council to approve appointments to the Comprehensive Land Use Steering Committee. Notice of hearing on the following liquor license: Shelly R. Bartlett dba Duke’s Place, 760 E. Oxford St. Alliance. Hearing to be held August 30, 2002, 9:30 a.m. at the Canton City Hall. Notice of hearing on the following liquor license: Bad Bat, Inc. dba Bier House 2347-55 South Union Avenue, Alliance. Hearing to be held August 30, 2002, 10:30 a.m. at the Canton City Hall. Letter from the Stark County Town Hall on Race Relations Steering Committee announcing a Community of Color Town Hall to be held September 5, 2002 from 5:30 – 9:00 p.m. at the Canton Urban League. Minutes from the July 1, 2002 Water Sewer Advisory Board meeting and notice of the August 5, 2002 meeting. Letter from Mayor Middleton regarding the receipts collected through the Mayor’s Office during the month of July 2002 totaling $625,537.70. Motion to add Sammeh Alihassan to the list of members on the Comprehensive Land Use Steering Committee. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Motion and second to receive and file all communications tendered to Clerk Locke. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Motion and second to approve the Mayor’s appointments to the Comprehensive Land Use Steering Committee. MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. ADMINISTRATIVE REPORTS: Mayor Middleton: explained and asked for approval on Ordinance 106-02; explained and spoke in favor of Ordinance 108-02. Safety Service Director Blaser: reviewed some of the complaints received for J&J Refuse and explained how they were being handled; reviewed Ordinances 105-02, 107-02 109-02 and 110-02. Law Director Zumbar: handed out and reviewed Ordinance 112-02; handed out an amended version of Ordinance 111-02. Auditor Dordea: reviewed Auditor’s reports through June 30, 2002. Planning, Zoning & Housing: Ogline: asked that Ordinance 94-02 be adopted tonight. Utilities: Phillips: absent Safety and Judiciary: Roller: No report Community Development: Schwarz: No report Finance: Zumbar: spoke in favor of Ordinances 107-02, 108-02, 109-02, 110-02, 111-02 and 112-02. PUBLIC SPEAKS: Daniel Cherry, Jr. 1215 Jersey St., Alliance- informed Council of a drainage problem at the corner of Jersey and Oak. THIRD READINGS: Ordinance 94-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 9010 and 9011 located on North Walnut Avenue in the City of Alliance, County of Stark and State of Ohio. Motion and second to adopt: Roll Call: unanimous: ADOPTED. SECOND READINGS Ordinance 103-02: introduced by Luther: an Ordinance vacating 24th Street between South Rockhill Avenue and the north south alley east of South Rockhill Avenue in the City of Alliance. Ordinance 105-02: introduced by Council as a Whole: an Ordinance approving the draft revised Solid Waste Management Plan of the Stark- Tuscarawas- Wayne Joint Solid Waste Management District; and declaring an emergency. NEW BUSINESS: Resolution 106-02: introduced by Council as a Whole: a Resolution to celebrate the American character. Motion and second to adopt: Roll Call: unanimous: ADOPTED. Ordinance 107-02: introduced by Luther/ Zumbar: an Ordinance amending Ordinance 97-02 authorizing and directing the Director of Public Safety and service to advertise for bids and enter into contracts for services to complete and carry out the 2002 Comprehensive Road Resurfacing and Overlay Program in an amount not to exceed $460,000; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 108-02: introduced by Schwarz/ Zumbar: an Ordinance authorizing and directing the Director of Public Safety and Service to enter into a Professional Services Contract with URS Corporation for professional planning and engineering services for the proposed new Amtrak intermodal passenger station for an amount not to exceed $15,700; and declaring an emergency. Motion and second to suspend rules: Roll Call: Unanimous for rules suspension. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 109-02: introduced by Roller/ Zumbar: an Ordinance authorizing and directing the Director of Public Safety and Service to enter into a contract for the purpose of purchasing five vehicles for the Alliance Police Department through the Cooperative Purchasing Programs of the Ohio Department Transportation or to advertise for bids and enter into a contract with another vendor at the lowest and best price, but for a cost not to exceed $80,000 in any case, and declaring an emergency. Motion and second to adopt: Roll Call: unanimous: ADOPTED Ordinance 111-02: introduced by Zumbar: an Ordinance authorizing the second amendment and restatement of an outstanding 1984 issue of Industrial Development Revenue Bonds (Carnation Mall Project) in the original principal amount of $10,000,000 initially issued to finance a portion of the costs of a commercial development project for the original borrower, the Alliance Mall Company, an Ohio Limited Partnership; authorizing the execution and delivery by the City of Alliance, Ohio of a first amendment to loan agreement, confirmation of assignment and security agreement, paying agent agreement, subordination agreement and closing documents in connection therewith and such second amended and restated bonds; confirming authorization for the replacement of such outstanding bonds with such second amended and restated bonds, and related matters; providing for the repeal of Ordinance No. 57-02 passed on April 15, 2002; and declaring an emergency.
