MINUTES OF THE APRIL 1, 2002

REGULAR MEETING OF THE ALLIANCE CITY COUNCIL

The meeting was called to order by President Benincasa at 7:00PM. Zumbar gave the invocation and led the meeting in the Pledge of Allegiance

ROLL CALL: Sammeh Alihassan, Brant Luther, Mike Ogline, Phyllis Phillips and Alex Zumbar present.

Motion and second to excuse Roller and Schwarz: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

MINUTES: Motion & second to receive and file the minutes of the March 18, 2002 regular meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS. Motion & second to receive and file the minutes of the March 27, 2002 special meeting of Alliance City Council: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Letter from the Ohio EPA dated March 13, 2002. Re: Stark County, Paris Township sludge site for sludge from Alliance WWTP.

Minutes from the February 19, 2002 Board of Zoning Appeals meeting and the agenda for their March 26, 2002 meeting.

Letter from Auditor Dordea to Alliance City Council dated March 19, 2002. Re: note legislation.

Copy of a Resolution from the Stark County Commissioners approving the annexation of 10.607 acres in Washington Township.

Minutes from the March 26, 2002 Alliance City Planning Commission meeting.

Letter from the Stark County Democratic Executive Committee dated April 1, 2002 requesting our most recent regulation ordinances regarding placement of political signs in the community.

Letter from Mayor Middleton regarding the receipts collected through the Mayor’s Office during the month of March 2002 totaling $591,865.94

ADMINISTRATIVE REPORTS:

Mayor Middleton: No report

Safety Service Director Blaser: reviewed changes in substitute Ordinance S17-02; stated that the Administration is not in favor of Ordinance 28-02;

Law Director Zumbar: the Supreme Court has dismissed the Alihassan vs. Mount Union College case; he is in the process of reviewing an amendment to the Industrial Revenue Agreement with Carnation Mall.

Auditor Dordea: read the Fiscal Officers Certificates for Ordinances 40-02, 41-02 & 42-02 (copy included in communications).

Planning, Zoning & Housing: Ogline: No report

Utilities: Phillips: Reported that new rules for spreading sludge are currently being reviewed by the Waste Water Treatment Plant.

Community Development: Schwarz: Ogline spoke in favor of Ordinance 39-02.

Finance: Zumbar: reported on the March 25, 2002 combined Safety & Judiciary and Finance Committees, they are recommending defeating Ordinance 28-02.

Ordinance 27-02: introduced by Ogline: an Ordinance accepting and approving the replat of lots 11918, 11919 and part of lot 8161 located on West Main Street in the City of Alliance, County of Stark and State of Ohio.

Ordinance 28-02: introduced by Zumbar: an Ordinance authorizing and directing the Safety Service Director and Auditor to pay the sum of #9,385.53 to Norman L. Retterer; and declaring an emergency. Motion and second to adopt with intent to defeat: Roll Call: unanimous: DEFEATED

Motion and second to refer to Planning Commission: MOTION PASSED BY ACCLAMATION OF ALL MEMBERS.

Ordinance 36-02: introduced by Zumbar/ Luther: an Ordinance authorizing and directing the Director of Public Safety and Service to enter into a contract for the purpose of purchasing two new three quarter ton pickup trucks and snow plows for the Alliance Street Department through the Cooperative Purchasing Programs of the Ohio Department of Transportation or the Ohio Department of Administrative Services or to advertise for bids and enter into a contract with another vendor at the lowest and best price, but for a cost not to exceed $52,000 in any case and declaring an emergency.

Ordinance 37-02: introduced by Zumbar/ Phillips: an Ordinance authorizing and directing the Director of Public Safety and Service to enter into a contract for the purpose of purchasing a new one ton utility truck for the Distribution Department through the Cooperative Purchasing Programs of the Ohio Department of Transportation or the Ohio Department of Administrative Services or to advertise for bids and enter into a contract with another vendor at the lowest and best price, but for a cost not to exceed $24,000 in any case and declaring an emergency.

Ordinance 38-02: introduced by Zumbar/ Phillips: an Ordinance authorizing and directing the Director of Public Safety and Service to enter into a contract for the purpose of purchasing a new bucket truck for the Distribution Department through the Cooperative Purchasing Programs of the Ohio Department of Transportation or the Ohio Department of Administrative Services or to advertise for bids and enter into a contract with another vendor at the lowest and best price, but for a cost not to exceed $114,750 in any case and declaring an emergency.

Ordinance 39-02: introduced by Schwarz/Ogline/Zumbar: an Ordinance accepting the proposed annual consolidated plan for the City of Alliance pursuant to the FY-2002 Community Development Block Grant Program in an amount not to exceed $864,000.00.

Ordinance 40-02: introduced by Zumbar/Luther: an Ordinance providing for the issuance and sale of notes in the aggregate principal amount of $905,000, in anticipation of the issuance of bonds, for the purpose of improving Main Street from Union Avenue to Liberty Avenue by installing electric lighting and traffic control devices, constructing water mains and sanitary sewers, replacing, reconstructing and installing curbs and gutters and relocating overhead utilities, together with all necessary appurtenances, and declaring an emergency.

Ordinance 41-02: introduced by Zumbar/ Luther: an Ordinance providing for the issuance and sale of not to exceed $550,000 notes, in anticipation of the issuance of bonds, for the purpose of paying costs of acquiring real estate and interests in real estate in order to permit the widening of West State Street from a point approximately 100 feet west of Freshley Avenue to a point approximately 100 feet east of South Western Avenue, including engineering costs associated with such acquisition, and declaring an emergency.

Ordinance 42-02: introduced by Zumbar/ Luther: an Ordinance providing for the issuance and sale of not to exceed $900,000 notes, in anticipation of the issuance of bonds, for the purpose of extending West Main Street Extension from Freshley Avenue to Sawburg Avenue by grading, paving, draining, constructing sanitary and storm sewers and waterlines, installing curbs, gutters, roadway culverts, and widening and otherwise improving Freshley Avenue from State Street to its intersection with the Norfolk Southern Railroad right-of-way by grading, paving, installing curbs and gutters, and reconstructing driveway approaches, constructing storm sewers, together in each case with all necessary appurtenances and related improvements and the acquisition of any real estate or interest therein that may be required, and declaring an emergency.

Ordinance 43-02: introduced by Zumbar: an Ordinance authorizing and directing the Safety Service Director and Auditor to pay the sum of $391.00 to Norman L. Retterer; and declaring an emergency.
